Whyte and D&P prepared for hostile HMRC

Much of the response from Duff and Phelps to last night’s revelations by Mark Daly on the BBC website centred around their fees.  BBC revealed that partner, David Grier, emailed Craig Whyte to say, “We propose to cap our fees in respect of an (sic) CVA or Administration to £500k, however, we request the ability to discuss with you an additional payment in respect of our total time costs, in so far as this does not impact on your position.”

Contracting to cap fees at £500k when you subsequently bill creditors £3.5m for your own time plus £2m legal costs would embarrass many of us, though not everyone.  Duff and Phelps added a caveat that they could discuss additional payment as long as it did not impact on Craig Whyte’s position, which they perhaps did.

The more interesting part of the exchange between Whyte and Greir is their preparation for “HMRC being hostile”.

Craig Whyte:

“I’d like to speak to David [Whitehouse] and Paul [Clark] to make sure that they’re comfortable with the fact that we might end up with HMRC being hostile (I suspect this will end up being the case so you should go into it with your eyes open)”

David Grier:

“Agreed.”

It is fascinating to wonder how comfortable Mr Whitehouse and Mr Clark were with Craig Whyte’s plans in the event HMRC were hostile.  HMRC are Rangers largest creditors.  Administrators run the company in the interests of the creditors, not the shareholders.

Three days after this email exchange Rangers went to court to insist Duff and Phelps were appointed administrators instead of an appointment by HMRC.

Last week Duff and Phelps denied they have a conflict of interest concerning this administration.  They are currently negotiating a CVA with HMRC and other creditors.

  23. Alternative view on Tax and apologies if i’m off topic

     

     

    Fed up of hearing that Rankers have done no wrong in terms of “doin” HMRC and we have seen the figures in terms of public sector cutbacks etc, that should have brought it home to them how serious it has become unfortunately it hasn’t.

     

     

    Here is a wee alternative in a currency they “might” understand, and I don’t want to get into politics of the armed forces etc etc but am putting myself in the position of being an average Joe and of serving/served in Afghanistan. I will have done my duty and seen things and maybe lost friends in very trying circumstances. I have now been feted at ibrokes, paraded in front of the fans and rightly or wrongly (“bear with me”) for my heroism and doing my job which has made me feel good and appreciated.

     

     

    However, below is a sentiment from a well known inflatable, inflatable website and probably goes a long way in explaining what most of their fans think:

    Now I have enclosed a statement below which I researched online:

Military figures say that lives are being lost in Afghanistan because troops have to travel by land, making them vulnerable to roadside bombs.”

     

     

    These troops could have been better protected by using helicopters to provide air cover or for transporting them around the warzone.

     

     

    So for £75M in UNPAID TAX this is what they could have had at their disposal:

     

    HELICOPTERS

     

    1) Lynx Wildcat – price £16m each, so would pay for nearly 5 state of the art military helicopters; carries up to 22 troops (Total 100+moved at one time)

     

    2) Apache avg price £37m so 2 of the finest military helicopters in the world. (doesn’t carry troops)

     

    3) Chinook £23m each so that’s 3 troop carrying multi-purpose. 33-55 troops (165 in total) (C4 News – only 20 chinooks available at one time so their tax default could have increased capacity by 15% which is huge)

     

    4) Merlin £14m each so 5 could have been bought 24 seated or 45 standing up;(120-225 at the one time)

     

    Combination of 2 chinooks and 2 merlin =£74m

     

     

    FlightGlobal states that Britain has 30-35 helicopters in Afghanistan so if best case scenario this non payment of tax has had the effect of denying these troops and the country of 17% more capacity and operational ability to avoid IED devices etc.

     

     

    ARMORED VEHICLES

     

    Or alternatively the “Foxhound” armored vehicle that survives IED’s, £75m could have bought 83 of them which based on the order for 300 by the British Government would be 28% greater & alot more protection for soldiers on the ground.

     

     

    I’m sure if given the decision of being paraded at ibrokes or a choice of the above based on my research what would you think they’d have chosen?

    Sorry, but I would. I hope my love of football is important to my support of Celtic. Yes, Celtic is a family with wider objectives than merely winning football trophies, but its first priority as a football club must be football. Its other charitable and off field activities may be exceptional if not unique in football but given the finance other organisations could, and many do, carry out similar work. Therefore, for me it is imperative that football’s sporting standards are maintained and that is the greater issue in all of this current Scottish debacle. Celtic supporters have always held a universal view and have influence far beyond the walls of Parkhead (Carrow Road just a few days ago for example). Their horizons have always been broader than the mere boundaries of Glasgow’s East End.

     

    By the way, I am also heartily sick of this whole circus but feel I must persevere in the hope that I can influence the outcome for the good of the game of football.
