Billy Dodds nails Rangers on tax

Billy Dodds, who was named by the BBC as a beneficiary of Rangers Employee Benefit Trust, wrote in today’s Sunday Herald on the subject.  He alleges Rangers paid him money, which should have been taxed as income, through an EBT.

Dodds wrote, “David Murray came to me and asked if I would receive a payment that was due to me, after tax, through the EBT trust.   And I said that I would.   It was money that was owing to me when I had six months left on my contract and I moved to Dundee United. After the tax was deducted, that money was put in the trust fund.”

What happened to the “tax… deducted” is the crucial question.  Dodds is clear.  This was money due to him through his contract of employment which should have been taxed.  The seriousness of the allegations against Rangers just cranked up a notch – and from a surprising source.

    You may be aware that the Celtic Supporter Trust had a meeting with Neil Doncaster and Iain Blair of the SPL on Tuesday 8th May. A note of that meeting, subsequently amended after a clarificatory phone call from Mr Doncaster can be found at:

    During the course of that conversation the issue of Membership of the SFA arose and, as I understand from Messrs Doncaster and Blair, membership of the SPL required membership of the SFA. I see from Article 6.2 of the SFA Articles that a club is automatically registered as an SFA member by dint of SPL Membership being granted. However, I am unclear as to whether ‘membership’ of the SFA is synonymous with holding a licence from the SFA.

     

     

    I then noted that the SPL Articles were themselves subject to SFA articles according to:

     

     

    96. Nothing in these (SPL) Articles shall relieve any Member of the Company from its obligations as a full member club of the SFA to comply with the applicable articles of association of the SFA for so long as it remains a member of the SFA. Each Member shall (in so far as it is lawfully able and permitted by the exercise of its voting powers to do so) procure that the Company observes and complies with all relevant articles of association of the SFA applicable to it.”

     

     

    This suggests to me that SPL clubs are ultimately governed by the rules of the SFA and (as an aside) I note the following in the SFA Memorandum and Articles:

     

     

    Article 5.1 Obligations and Duties of Members which, under Article 4.3 applies to the SPL as well as its member clubs, states that

     

     

    5.1 All members shall observe the principles of loyalty, integrity and sportsmanship in accordance with the rules of fair play”

     

     

    the pursuit of which was the purpose of the CST meeting with Mr Doncaster.

     

     

    As a result of the foregoing on Membership I am writing to seek clarification on the application of the SFA Club Licensing [1] process that SPL clubs are subjected to annually and how this process would apply to a Newco granted Membership to the SPL.

     

     

    The information on the SFA web site introduction, and in the actual licensing documentation, states that SPL clubs are subject to the UEFA FFP Rules/criteria and SFL clubs are subject to National Club Licensing.

     

     

    Can you confirm that in the event of a Newco being granted SPL Membership and so SFA Membership:

     

     

    That a Newco will be subject to the SFA Club Licensing Process?

     

    If so and because the UEFA FFP rules apply, can you confirm that under UEFA rules the licence is not transferable and so a new license for a Newco would be required?

     

     

    Under what circumstances a club license could be granted as a Newco would fail the requirement to supply accounts for the past three years, the same provision that would exclude a Newco being able to qualify for a license to play in UEFA competitions? (leaving aside other reason why Rangers themselves would not qualify)

     

    Would a case for an exception be made to UEFA as provided for by Annex 1 of UEFA FFP?

     

     

    Would the SFA make the exception case and on what basis?

     

    If UEFA FFP does not apply, does National Club licensing apply and under what circumstances would a license be granted to a Newco given that the National Club license criteria on accounting carries a similar provision to UEFA FFP in terms of requiring three years accounts to be supplied as an entry level requirement. (National Club Licensing 8.1.1 and 8.1.2 refers)

     

    Is there another process for licensing a Newco that might be used to grant a license?

     

     

    If a license were not granted exceptionally or otherwise by the SFA, would a Newco be able to play in the SPL?

     

    Would the SPL, as suggested in Article 96 referred be bound by SFA rules or could they ignore the licensing requirement and allow a club to play in the SPL unlicensed?

     

     

    I would be grateful if you could answer my questions in order to help shed some light on behalf of the members of the Celtic Trust in particular, but also Scottish football supporters in general, on the way football is governed in Scotland to ensure that integrity, sportsmanship and probity take paramount place.

    Call it a score,gross,and a tenner,nett,for the sake of argument.

     

     

    He duly received his tenner,and as far as he is concerned,that is all he is interested in. Can’t blame him for that.

     

     

    However,I think he is being somewhat disingenious here as he will undoubtedly have sought professional advice on this where he would probably have been told that regardless of legality,he was in the clear. Rangers would be liable,and not him.

     

     

    He should have kept quiet. The numbers involved are such that his part would have been forgotten.

    Loving this hot weather, one of my girls luckily had a birthday party yesterday which went very well and, after it, we just stayed in the garden drinking with a few firends. Quite a few of the neighbouring gardens were similarly enjoying the warm outdoors.

     

     

    In this nice middle class street where we live, some of the locals are organising a Jubilee street party which, obviously, I am boycotting. The other half has already informed the neighbours that I wont be attending because I hate the Royal family (as a form of revenge because she has been asked to do the face painting and my girls want to attend-it’s just a party to them. I’ll explain why they need to despise the Royals when they get older).

     

     

    Anyways, about 10.50 pm, merry, satisfied and a tad drunk, I suddenly stand up, cup my hands over my mouth then shouted loudly, “FECK THE JUBILEE!” with the ‘u’ replacing the ‘e’ to add emphasis.

     

     

    Cue silence from all the happy, adjoining, garden murmurings!

     

     

    Next move for me is to Coventry, I suspect, whether I like it or not! Serves me right for moving away from my roots!

    I noticed this wee story in the latest edition of Donegal Town’s monthly paper, the imaginatively named Donegal Times. It’s a wonderful example of the widespread nature of the Celtic family and might be of interest to the old timers and historians amongst us:

     

     

    Great-grandson finds relative’s Celtic medal in Donegal Town

     

     

    A great-grandson of a renowned Celtic footballer of the 1920’s was thrilled to find his ancestor’s championship medal in a local pub when he visited recently during his honeymoon. Brendan Cahill, who lives in Brooklyn, was in Donegal Town with his new wife Marybeth when, totally fortuitously, they called into the Tir Conaill Bar on the Diamond.

     

    Talking to owner John McCafferty, the conversation veered towards Scottish football “My great-grandfather played for Celtic” ventured Brendan – “What was his name?” – “Charlie Shaw”.

     

    “Wait a minute” says John, and away he goes, to return minutes later with a special memento. What was it only the medal won by Charlie playing for Celtic in the 1922/23 season.

     

    The medal has been kept at the Tir Conaill Bar for many decades and it’s story goes back ninety plus years when, in 1920, the grand-uncle of John McCafferty left Donegal for Glasgow during the political upheavals which were taking place in Ireland at the time.

     

    John takes up the tale : “Jim McGahern was the uncle of my father, the late Sean McCafferty. Back in the troubles, Jim left for Glasgow, where he shared a room with a man called Charlie Shaw. Charlie worked as a railwayman in Glasgow, and my uncle noticed that he was good with a football. As he was a Celtic supporter himself, he suggested that Charlie try out for the Celtic football club. Charlie did, and he was signed straight away. He promised my uncle the first medal he won – and that is how the medal came to Donegal. Charlie won twelve medals with Celtic, and the one in the Tir Conaill is dated 1922-23.”

     

    John has been running the pub since 2008, following in the footsteps of his father Sean who died some years ago. Sean, who took over the pub from Jim in 1968, was an ardent Celtic fan, regularly travelling to matches right up until the age of 82. The family have been supporters of Celtic for many decades and the pub is popular with Scottish visitors who are always interesteded in seeing old photos and other Celtic memorabilia from days gone by.

     

    The gold medal, which is still in it’s original padded box, says on the front: “Scottish Football Association” and on the back, “Won by Celtic FC 1922-23. C. Shaw”.

    Neil Doncaster wants NewClub in the SPL, I think deep down Celtic want NewClub in the SPL, the media knobjockeys want NewClub in the SPL, God knows, the other SPL chairmen want NewClubin the SPL badly…. that’s fine, we can accept that. The problem of course is that events have transcended what any of those people want. The NewClub that they want in the SPL is no more. Any veneer of respectability, dignity, integrity, that NewClub the ‘institution’ may have had, has been burned back so much that the scabs and weeping sores of a deeply corrupt and distasteful organisation have been revealed for all to see. Even the media knobjockeys are slowly realising that RFC(IA) (as they knew it) are dying in front of their eyes, and they simply cannot sweep all of this under the carpet and pretend it didn’t happen.

     

     

    From my own POV – at the start, I never wanted to actually see Rangers die. I’d have been happy enough if they’d found a Rangers-minded benefactor who took them on, paid their debts, took it on the chin and they tried to bounce back. I never, ever wished a ‘Third Lanark’ on them…. that is, until…. (not in chronological order!)

     

     

    1. Haudit & Daudit so blatantly ripped the pish with ZERO compulsory redundancies at an organisation bleeding cash.

     

    2. When Ally McCoist made his dog whistle ‘who are these people’ speech – when he knew fine well who they were, and that his club had signed up to an ‘anonymous panel’ scheme.

     

    3. When threats were made to the ‘outed’ panel.

     

    4. When Sandy Jardine opened his mouth and the hordes marched on Hampden.

     

    5. When Rangers appealed the original SFA sanctions.

     

    6. When Rangers took civil court action against the SFA.

     

    7. When they attempted to sign Daniel Cousin.

     

    8. When their fighting fund had so many f**king typo’ errors on their roll-up bannerstand. Fuds giving graphic designers a bad name.

     

    9. When Sandy Jardine announced that Rangers, and their supporters, wouldn’t forget those clubs who were seen to be against them.

     

     

    There’s a ton more, but there’s no need to go through all of the stuff that has happened since Feb 14 which has made me change my mind, and makes me want to see the f**kers nuked.
