CAS drives horse and cart through FFP efforts

230

The Court of Arbitration for Sport (CAS) found against Uefa and in favour of Manchester City in their Financial Fair Play (FFP) case, head last month. CAS found that Manchester City broke FFP rules by failing to cooperate with Uefa and were fined 10m euro, with no ban from European competitions.

Manchester City successfully argued that the more serious charged against them occurred either more than five years ago, and were therefore time-barred, or were not conclusively established.

This is a serious blow for Uefa who must now consider how robust their FFP regulations are when a case of this magnitude can be set aside by CAS.  If the Association does not have the tools to enforce FFP rules within a five-year period, wither the rules need to go or monitoring tools need to be significantly enhanced.  Otherwise, clubs who follow the rules. like Celtic, are competitively penalised.

Get rid of any notions of corruption behind this decision.  It went against Uefa, they did not fold, the three arbiters at CAS were not bribed either.  This is purely about how difficult it is to prosecute complex cases.  These rules are relatively new and have never before been tested like this.  Time to redouble efforts.

Happy Birthday, Oldtim, 81 today!  Dave was a young 65 when he chose the name ‘Oldtim’, which as we are all getting older now seems quite funny.

  3. I don’t share your thoughts on this P67. Truth is FFP is a world away from where we are as a Club. FFP is the Bayern’s and Juve’s of Europe trying to keep the City’s and PSG‘a from challenging them.

The Clubs that demanded FFP are the same clubs that have tried to stop Clubs like us from getting into the CL.

BRB – yes I have booked table for 4, just me and Big Jimmy going.

2pm at the Howgait formerly the Lee.

  5. Anyway, bought my season ticket this morning. There was a few spare seats particularly in the upper Jock and Lions stands but I’d expect that anyway. The north and main stand have sold well.

I’m very confident we’ve outsold Sevco by a distance.

  6. Good luck to Jack Hendry on going on another loan deal, again fan power along with Liam Henderson made sure there time was up at Celtic, and being realistic if Celtic paid £500,000 for Ajer and a bid comes in for £15 million and 2 players 2 then to me that’s a steal,

  7. The Battered Bunnet on

FFP-wise, UEFA have found that the combination of time bar, obstructive members and slow coach processes add up to diluted outcomes.

Man City obtained a financial benefit from both the undeclared income and the revenue from participation that amounts to £100’s of millions. A €10M fine is irrelevant.

The bottom line is, so long as penalties are financial and not sporting, nothing is against the rules if you can afford to pay the fine.

UEFA look terribly foolish. Expect any attempt to redraft the rules to be vigorously resisted by the ECA and the FAs of the big leagues.

Given that the football economy is being trashed by Covid-19, the likelihood is that there will be no effective FFP applied for the foreseeable future, whether there was any before or not.

  8. Had FFP came into effect 20 years ago and been applied – Rangers could still be alive.

I’m perfectly happy for badly run clubs to go to the wall.

  9. BRB – I cannot remember if I gave Paul67 my mobile on registering, if so then Paul can you supply BRB with my Mobile and email address.

BRB – if Paul emails you my mobile number text me or mail me on email what ever suits.

  11. Again, a very hoopy birthday to the most generous, warm hearted individuals I have met in my life. An honour and privilege to call OldTim my friend and boosing buddy for many years at the CQN Golf Day at Aberdour, especially good thing about this day, I actually get to buy Dave a Gin or two…:)

Have a hooptastic day Dave and hopefully see you soon…

    Until we meet again…

    Keep the Faith!

    Hail Hail!

  12. A very Happy Birthday to OldTim67, have a wonderful day. Looking forward to catching up with you and the rest of the crew in the BV when I’ve completed my 12 weeks of penance, 4 down 8 to go.

A special well done to your mammy for holding out that extra 24 hours so that you weren’t born on the 12th. 😉

  13. Hi Lennybhoy,

Any news to report fella? Forster still a bit of a dance? Incomings??

  14. How can Man City,be cleared ,and fined 10 million EUROS?. Either they broke FFP rules ,or they did not.

  15. Again a Happy Hoopy Birthday to OldTim67 81 years young.

FFP effectively dead in the water, this judgement and Covid-19 will mean no one is ever punished, the rich can afford the fines, peanuts to them, scandalous

    Happy Birthday Oldtim

About time you grew up and got sense and started acting like a responsible adult !!!!!

Maybe bump into you at a game sometime.

I go into the kerrydale bar before the game and sit in area 144.

  19. BIG WAVY on 13TH JULY 2020 11:50 AM

Nothing new to report, as I have posted previously, do not rule out Forster returning but there are no guarantees.

    Keep the Faith!

    Hail Hail!

    —/

My understanding is that they were fined for not complying with the investigation.

The alleged breaches of FFP were deemed not to be proven or outside of UEFA’s remit.

Yes. Tosh was my mate. His granny was a neighbour of mine in Kirkton Avenue. Hopefully we can meet up soon, for a pint, blether and catch up.

David66 of this parish, is another Kirkton Avenue Corpus Christi bhoy. He is a youngster, in the year below me. 😊🍀💚

  22. Never had the pleasure of meeting you but so many good things are said about you on here that I had to join the others in wishing you a very Happy Birthday. Appears that a few good people share 1939 as a birth year.
