Clyde FC point SFA and SPL to contractual and judicial facts

I received updates direct from last week’s Scottish Football League meeting shortly after it concluded.  My information was that Neil Doncaster in particular was given a torrid time and that the mood among clubs was firmly against agreeing to place Sevco into the First Division.

Within a couple of hours it was clear that many in the media had been given a different impression and that if the vote was taken then, a ‘healthy majority would vote in favour’.  To a degree I think we are all susceptible to messages we want to hear but it has been a feature of this debacle that executives from the national bodies have given clear guidance to the media that ‘Newco’ would be voted into the SPL, as it was, or now into the First Division.

On more than one occasion I’ve heard “You might have heard different, but Neil Doncaster told me….”

There is no shortcut for legwork and attention to detail.  On this subject, credit to STV, who present informed information on how Friday’s vote is likely to pan out, with references.  Of the 30 clubs in the SFL, the report 14 have declared an intention to vote against plans to plant Sevco into the First Division, one will abstain and one has (incorrectly) been told they are ineligible to vote.  Another 14 are yet to declare.

It seems likely that the SFL vote will go the way of the SPL vote.  There is a desire to retain the sporting element to our game among clubs, if not among administrators.

In a statement yesterday Clyde FC nailed several of the myths behind threats made to SFL clubs:

“We have obtained a copy of the Settlement Agreement signed up to by the SPL and the SFL in April 1998 – it is clear that the agreement is not ambiguous in this regard and there is no scope for the SPL to fail to meet the obligations to the SFL except by deliberately breaching the agreement… We have concluded that it defies credibility that the SPL clubs would instruct the SPL to deliberately breach a legal agreement.

“The matter is made worse because of the extent of uncertainty which hangs over Sevco. There is no need to prepare an exhaustive list of the issues as they are well publicised, however the extent of outstanding sanctions that may or may not be levied against a club which has yet to obtain SFA membership, together with the increasing number of possible commercial and legal challenges to the transactions to date simply presents a significant risk to the ability of the club to fulfil its fixtures in any league. Given that some of these matters are in the hands of the governing bodies it seems inexplicable that they are left hanging.”

In short, the Scottish Football League has a binding contract with the SLP which they are entitled to enforce.  Clyde also refer on the matter we have discussed here for many weeks, Sevco are trying to buy a SFA membership which has significant outstanding disciplinary issues against it which could see the membership suspended.  Instead of providing clarity, the SPL and SFA have refused to set deadlines of proceed with hearings.

We can speculate if SFA chief exec, Stewart Regan, will inform SFL clubs in person on Friday of plans to disband judicial oversight from our game instead of asking Lord Carloway’s panel to reconvene.

Despite the valiant efforts of many football fans and clubs, our game has been ruined by years of destructive, self-serving, leadership.

Meant to add , was fortunate to meet joe mcbride on a few occasions , a celtic class bloke , I saw him Score a goal against hibs at easter road which will stick with me all my days . back to goal, controlled the ball on his thigh , swivelled and met it perfectly to nearly burst the net . A great goal from a great player R.I.P JOE MCBRIDE.

  3. Just caught the sad news about Joe McBride.

     

     

    We are all prisoners of the chains and shackles which bind us to Celtic from our memories of early supporting. My boyhood was spent watching the Lions grow up whilst I remained in childhood. When I conjure up an image of Celtic from the 60s it always involves Jimmy or Bobby getting to their respective bylines and throwing in a ball which was inevitably steered towards goal by Joe McBride. He was a magnet for the ball and made defenders look slow of wit.

     

     

    I spoke to him at the same event that TTTT attended and despite my reverting to child like wonder at being in the great man’s presence, Joe spoke with us for longer than he needed to in order to fulfill his functions. He was still giving more than he needed to the cause.

     

     

    One of the things that used to frustrate me was a memory of an article, written by Brian Glanville, which was grudgingly complimentary towards Jock and the Lions but, because Glanville was a big Italophile, he diminished our 67 win by bemoaning the absence of Luis Suarez from the Inter line up. I got the impression that BG did not know nor much care about Joe McBride’s absence from our team.

     

     

    The Lisbon win is a thing of beauty and I would not want to spoil the drama of that occasion by changing one thing. But, I tell you, that if Joe McBride had played against that defence, we’d have been 3:1 up at half-time and smoking cigars by the 60 minute mark.

     

     

    He was that good at performing the simplest and hardest job in football. And on top of that innate skill, he managed to remain a humble gentleman able to set boyish daft eejits at ease.

     

     

     

    Joe McBride was some man.

    the sale of assets – as revealed in the Duff& Phelps report – points to an enormous under-valuation. even £5.5M didn’t make any sense in terms of previous valuations, imagine you owned a property that would cost £100M to rebuild but it was only worth £5M? doesn’t make sense!

     

    but it turns out that the cheatinbassadome and moses(birlin’ in his grave) park AND the car park have a combined value of less than £3M!!!!

     

    Cee lo is sitting on a gold mine, obviously the only thing that would screw the plan is if they get voted straight into Div 1. He doesn’t want this, he wants oblivion but he doesn’t want to be held responsible.

     

    Right now the MSM are so far away from Minty, it’s as if he wasn’t there, he’s ancient history! Whyte has faded into the background but he’s still there. The MSM will report the demise and disappearance of the most corrupt club in history as being the fault of every other club.

     

    Meanwhile CW will pick up a very fat cheque, Cee lo will be well rewarded and Minty will get his friends in low places (Jabba et al) to blame everyone but himself.

    I hear you mate and agree, Farry, Peat & Ogilvie are all disgraceful cheats. The reason rangers (past tense) are in this mess is because they are still trying to cover up the crimes they committed.

     

    I firmly believe that the reason Ogilvie, Reagan, Doncaster et all are still in their castles is because Green / D&P / King etc know that they knew about the 2nd contracts / EBT’s and other info yet to surface and have evidence to the fact.

    God bless Joe McBride. A beautiful, humble man and one of the all-time great goal-scorers. He would have been one of the certainties for selection in Lisbon if he’d been fit but he did play his part in the campaign and he’s unquestionably one of the Lions.

    all of them are complicit in whats going on now then you never will, if these men were as outraged as the fans are they would have had him gone long ago,

    with the threat of boycotting unless this is done,our leaders are hiding behind

     

    doncaster, regan and ogilvie and there like, they have the power to remove them

     

    so why are they not exercising these powers why?

  19. Joe McBride’s injury was the reason Willie Wallace was signed from the Hearts.He scored 221 league goals and amazingly only 2 Scottish caps – unbelievable.

    Wallace, William Semple, was trying to work a transfer to Rangers as he was a big fan. Jock signed him in early December when Rangers were playing abroad.

     

    Joe went down with his knee injury at the end of December.

     

    We were unlucky that we didn’t get to see what would have been a dynamic partnership, but lucky we had a ready made replacement with a cannonball of a shot and a nose for a goal.

    THE SPL have issued placement money to each club for last season – with the exception of soon-to-be-liquidated Rangers.

     

     

    Ally McCoist’s side finished second, which would have guaranteed them a cash sum of £900,000, but it has emerged that Charles Green’s Sevco Scotland Ltd will be lucky to see £25,000 of that sum.

     

     

    The ruling body’s financial year ends in May but certain payments, such as the Uefa Solidarity money, won’t arrive until late August or early September.

     

     

    While the 11 other clubs have already received payments, Rangers’ money has been frozen by the SPL and they will ensure that it will be used to pay member clubs who are owed money by the fallen Glasgow giants. The largest chunk will go to Hearts, who are due £800,000 from the £1.5m sale of Lee Wallace and that balance is due later this month, at which point the Edinburgh club will be recompensed.

     

     

    Celtic are also due £40,337 but have yet to make a claim for it to the SPL. Dundee United are owed more than £30,000 and it’s believed that they have applied to the Hampden bosses to have that money diverted into their account.

     

     

    As soon as Rangers were forced into administration in February, the SPL Board decided that they would hold on to Rangers’ money in order to settle their domestic football debts.

     

     

    They’re able to do that due to the offset rule in their constitution, which allows them to withhold prize money if a club defaults on payments to other members.
