CVA plans melt in April heat

Duff and Phelps and any prospective Rangers buyer quoted have been making confident noises about a CVA being agree with creditors, we’ve even heard the club could be out of administration next week.

The mood changed yesterday when the SPL announced potential sanctions for a Newco to be admitted to the league following liquidation and increased sanctions for clubs in administration, which would only affect Rangers were they to remain under court protection until the start of next season.

Duff and Phelps now say, “the fact that such measures are being considered at such a sensitive point in the sale process at Rangers is disruptive and regrettable”.

It’s time for Duff and Phelps to follow through with all those confident noises and agree a CVA with creditors.  If HMRC are open to the idea, conclude a deal, there is no need to wait for the FTT verdict.  If HMRC will not agree to a CVA, which is my understanding, drop the pretence and tell us how you plan to proceed.

Is it too late to suggest they just pay their bills and save everyone all this trouble?

    So if we presume that all these are passed………

     

     

    Does rule 7 (non-payment of income tax and NI) remain with a club that has had it’s share automatically transferred under rule 2 (the club remains fully recognised) and hence would a newco RFC be unable to sign players until THIS YEAR’S tax and NI are paid in full (seperate from the EBT stuff)?

    If the SPL are just going to invent new rules so that a Newco can sashay straight in, the next question is what can be done to prevent a Newco Rangers from getting its dancing shoes on in time.

    The Newco won’t owe any tax – the oldco will. That’s the horror of this whole proposal: the Newco starts afresh.

    As things stand there is no tv deal for next season and beyond. There is a deal on the table but unsigned. That was the point I was trying to make in last blog, if celtic let it be known to sky/espn that they will oppose new deal if the cheat’s charter is approved, and will not co-operate with the tv companies from april 30th onwards then sky/espn will not sign new deal and withdraw. We could also do something similar to any prospective league sponsor thinking of taking over from Clydesdale next year.

    I don’t see how newco Huns can keep their history. Just being passed the oldco’s share in the SPL doesn’t mean they have the history too.

     

     

    Efforts to stymie these proposals should ignore the huns. Our attack should focus on the principle and morality of any club being allowed to dump their debts and start straight away back in the top division.

    I know only to well what it was like doing that A9 as a kid. I know guys from further north in places like Wick & Thurso who go to every home game all season, Weekend or Midweek its a privilege. Hats off to them.

     

     

    A return to Saturday 3.00 KO’s would be excellent. Your right for the money we get from them why do we bother. Changes on the way? HH

    Looks like honesty and integrity beaten by greed.

     

    If these proposal are agreed I will never set foot in another away ground or Hampden again.

     

    Celtic should fire a warning shot across the other teams by informing them that they won’t handle any more away tickets. I know that we all love the club and don’t want to see us disadvantaged by playing with no fans at away games but nothing else works but withdrawing money.

     

    The other clubs will vote these proposals in for the money, well what they get in one hand we should take away with the other.

     

    Celtic FC ourselves alone literally.

    Agreed – and the 2 year notice should hit Mr Doncaster’s desk on the 31st-May – Then strike…

     

     

    There is a general lacklustre feel about English Premier Football at the moment, the ascendancy of La Liga, the traditional powers in Germany and Italy are resurgent, this doesn’t help. With EBTs, FFP amongst other things ready to hit this is a great time to start a British league run by the FA, the premier League (the FAPL is sometimes incorrectly refer erred to as the English Premier League, and sometimes correctly referred to by the sponsor’s name.)

     

     

    The Scotland national team has advanced to the dizzy heights of 48th in the World, way behind Wales, ROI and England time to bin the underachievers. There is a British Football team at the Olympics and there should be at Senior Internationals, imagine the Welsh would like to see Bale, Ledley, Ramsay and Mathews in a competitive International squad.

     

     

    They way forward for Scottish Football……………..

     

     

    STEP #1

     

     

    It could start by the FAPL remaining the same but changing it’s name to the Barclays’ PL 1

     

     

    The Welsh teams playing in England, a few select Scottish clubs and the top teams in the Championship would combine to make the Barclays’ PL 2.

     

     

    The FA would run the British National team leading to a competitive National team for top Scottish talent to play in.

     

     

    STEP #2

     

     

    There could be promotion and obviously it follows demotion.

     

     

    From Barclays’ PL2 to Barclays’ PL1 it would remain the current English set-up as Championship to Barclay’ PL i.e. The two top teams promoted then the play-offs for the other place.

     

     

    Relegation would be slightly different, although it would remain the same for teams relegated from Barclays’ PL 1, teams relegated from Barclays’ PL2 would return to their original Home Countries Division.

     

     

    I don’t think it should be the bottom English, Scottish & Welsh teams that are demoted but the bottom teams to ensure a true meritocracy, to that end maybe more teams should get relegated, say six or eight allowing for in-form clubs throughout Britain a chance to play at the top.

     

     

    So basically an exciting reorganisation of Football in Britain, the FA will run British Football at the top level but the EFL, the SFL and the FAW would carry on.

  12. Presumably Neil Doncaster is desperately trying to save the television deal because he is terrified of life without it. I can understand that he would want to save it because he regards the SPL as a trade association and he is responsible for keeping it afloat. Of course what he cares about is money.

     

     

    But as others have asked, is this at any cost? Is sporting integrity just to be ditched for the sake of a TV deal?

     

     

    Here Mr Doncaster needs to take a step back and realise that a professional football league is only a trade association up to a point. Its members don’t compete in the same way as the members of a real trade association (here’s our product, we’re launching it onto the market, we have our price structure in place, we hope it does better than our rivals’ product). Sport isn’t like that.

     

     

    He said on Channel 4 News on April 3 that there was no suggestion of the SPL favouring one club. And then he comes up with a set of new proposals that favour one club. He says the clubs decide the rules and his job is to apply them without fear or favour. Then he tries to change the rules to favour one club, and walks away saying he won’t make any further comment. He is really seriously compromised.

  13. Passing through Barra last week I was amazed at the efforts of the Hoops supporters from Vatersey/Barra who’s journey down to the game appeared to involve:

    and the same all the way back again, all to see Celtic playing a home game in the SPL. Hats off.

    I had a load of bills and credit card debts to pay at the end of last month, as is usually the case. I gave all those making demands upon my money a choice of either receiving 2% of what I owed them and continuing to supply me with their goods and services, or to receive nothing at all from me as I would be transferring all my assets into my wife’s name. Strangely they all declined both offers and told me to pay up or else.

     

     

    Why is it one rule for me and another for Rangers? Would someone please explain.

     

     

    In other news… I heard this morning that Mothercare is to shed potentially hundreds of jobs from its Early Learning Centre stores across the UK. But I haven’t heard of any prominent politicians imploring the company’s major creditors to bend over backwards in order to help save this British institution. I’d be grateful if someone would post a link to the article reporting any such comments by senior politicians.

    ECA and UEFA sign new Memorandum of Understanding

     

    Thursday, 22 03 2012

     

     

    A renewed Memorandum of Understanding for the period 2012-2018 was signed today between ECA and UEFA on the occasion of the XXXVI Ordinary UEFA Congress in Istanbul, Turkey.

     

     

    The memorandum was signed by ECA Chairman Karl-Heinz Rummenigge and UEFA President Michel Platini. It paves the way for a fruitful relationship between Europe’s football governing body and the association of European football clubs.

     

     

    The new agreement will run from 22 March 2012 until 30 May 2018 and includes the following points:

     

     

    Insurance

     

    Pending FIFA’s takeover of such package on a worldwide level, UEFA will establish an insurance covering the injury risk of players while on international team duty. This insurance is valid for all players registered with a European club, irrespective of their nationality, and for all matches mentioned in the international calendar, including both official and friendly matches as from June, for the start of the UEFA EURO 2012 in Poland and Ukraine.

     

     

    Participation of clubs in the benefits of the UEFA EURO

     

    Clubs will now receive an increased amount of € 100 Million from the UEFA EURO 2012 revenues, as recognition of the significant contribution of clubs to the success of the tournament. This amount will be further increased to € 150 Million for the UEFA EURO 2016 in France.

     

     

    Good Governance / club representation in decision-making process

     

    In the future, the Club Competitions’ Committee, composed essentially of club representatives, will have a “Referral Right” on all decisions affecting club competitions. This reinforces the involvement of clubs in UEFA’s decision-making process.

     

     

    International Calendar

     

    To support the proposed future international calendar (so-called Status Quo Plus) that will be presented to the FIFA Executive Committee next week for approval. This calendar should basically be made up of 9 double-headers over a 2 year period with no single friendlies. The August friendly match date would be removed.

     

     

    Commenting on the agreement with UEFA, ECA Chairman Karl-Heinz Rummenigge said:

     

     

    “Today is a historic day for European club football. With this agreement, UEFA clearly recognises the importance of clubs and the significant contribution they make to the success of national team football. The agreement reflects an improved balance between national team and club football and is a great success for the European football family. I sincerely thank UEFA President Platini for his willingness to reach such an agreement with the clubs. Not only ECA, but all clubs in Europe should be proud of this great achievement. We all look forward to continue building the future of European football together with UEFA.”

     

     

    UEFA President Michel Platini added:

     

     

    “I am delighted that this memorandum of understanding is bringing together key stakeholders of the football family. UEFA, its national associations and the clubs have shown unity on several important matters which affect international football. This demonstrates the excellent working relationship we have with clubs and represents a true success in further strengthening the unity of the football family.”

    I was just thinking this myself – The SPL seems completely stitched up, focussed only on TV money, but the SFA is the overall governing body, and could stop all of this in it’s tracks. They are still the final adjudicator on the player registration issue as well, so this still has a long way to run.

    Couldn’t Celtic legally argue that any contractual obligations were no longer applicable given the SPL’s abandonment of sporting integrity? I am not well versed in business / contractual law but can’t see how Celtic’s contractual obligation could be upheld given the ethical morass an automatic inclusion of a Newco the SPL would create. UEFA will undoubtedly need to rule on such an issue it’s either fair play & sporting integrity or allow underhand shenanigans to win the day.
