Day of reckoning draws close for Rangers

Companies have a statutory duty to produce financial reports in line with commitments made to shareholders.  The failure of Rangers to fulfil those commitments was put down to a lack of clarity over the future outcome of the on-going tribunal with HM Revenue and Customs.  As a consequence of this failure, trading in Rangers shares have been suspended by the Plus Stock Exchange.

The Plus Stock Exchange also told Rangers broadcast partner, STV, they were “currently conducting an investigation into the circumstances under which Craig Whyte’s seven year disqualification from acting as a director in 2000 were not disclosed at the time of his appointment to the board of Rangers FC on May 6, 2011”.

Rangers today suggested there was “little, if any, tangible benefit for the club to be a listed company”.  This may be true but the benefit of a listing is heavily weighted towards shareholders and creditors, who should have received structured financial information in a timely manner.  Shareholders have also been denied the opportunity to attend an Annual General Meeting, which, in line with stock exchange rules, should have been held before 31 December 2011.

Many of you have watched Rangers speculate wildly for over two decades with the feeling that they would crash and burn.  This has been a painful period for those who follow clubs who stick to budget, unprepared to take a seat at the roulette table.  The day of reckoning draws closer.

    Appeal for a witness to an incident in Kinloch Street after the Aberdeen game 23 October 2011

     

    Witness appeal

     

     

    On 23 October 2011 after the game against Aberdeen there was an incident in Kinloch Street when a disabled Celtic supporter and his son were arrested by mounted police officers for allegedly shouting abuse at the Aberdeen fans while leaving the stadium. During his arrest the man was being held by the neck by a male officer mounted on a horse. When he was released to be grabbed by other officers on foot, the officer knocked the man’s glasses off. The man’s teenage son attempted to help his father and was also arrested. His younger son (13) was crying and in distress and during that time a female officer screamed in his face and threatened him with arrest. The child was subsequently abandoned outside the park and a steward had to wait with him till his mother could be contacted to come and collect him.

     

     

    During the incident a female Celtic supporter asked the mounted officer, who was holding the man, for his number as she appeared to be objecting to the way the man was being treated. He apparently did not reply to her and left the scene shortly thereafter. This lady, who was in the 40-60 age group could be a helpful witness as the man and his son have now been charged with breach of the peace.

    But can they ignore a body of supporters including Associations/Trusts etc?

     

     

    Probably! But it would be a little more difficult for the SPL if they went armed with a legal opinion that the remit for this decision requires a GM and the passing of a Qualified Resolution Requiring 90% or more rather than a Board matter requiring a 51% vote from 6 members consisting of a representative from Celtic, Dundee Utd, St Johnstone, can’t remember other club, a legal representative and CEO of SPL. Or if it is deemed a Board matter then approaching the SPL on the basis of changing the rules articles to tighten them up prior to any liquidation event.

     

     

    We can be sure that the rules/articles will change after the fact and most likely have been written in readiness so another member cannot take advantage of them as they stand.

     

     

    A premptive strike would, IMO, be the best tact. Only supporters can organise this as no matter our clubs position I don’t think they can be seen to act before such an event takes place.

The short answer is no PLC can “Hate the Huns” there Legal responsibilty is to the shareholders only, morality will only exist in so far as it exists in Law unfortunatly, so retibution is is in the hands of HMRC only, do not ever ever ever expect the SFA to do anything that benifits us over the Rangers

    When you remove £20m of Sky tv income from the Spl you remove any possibility of the turkeys voting for christmas.

     

    Could Motherwell, Hearts, Kilmarnock etc suffer potential loss of £1-2m per year without removing wages and survive?

     

     

    Lord alone knows what Romanov is up to but are any of the clubs in the process of clearing out players and or reducing the wage bill? Don’t think so.

     

    These folk are going down the stank along with RFC unless they all get together and protect their cash cow. Celtic are left on their own unless those with a model that could cope without the tv money vote against it with Celtic. I for one cannot see any other club being able to cope and even if they did do they want to inccur the wrath of the estbalishment?

     

     

    Celtic are lobbying for a 3rd division start but this means the tv money goes out the window with Rangers.

     

     

    My favoured model would be to take the 6 titles, 2 league cups and 1 scottish cup that we should have won, give newco a fair go in the new league set up.

     

     

    Mind you, if we gave it a few years without Rangers and enough clubs survived we may discover Scottish Football is better without them. For that to happen we need enough to vote for RFC 2 starting in division 3 and have them survive. What level of input would sky be prepared to give to keep the ball rolling? Any new league set up would need to be run on every club adhering to zero debt policy. If RFC 2 start in div 3 I would say that a fair few of the 2 club supporters (eg Morton and Rangers) would side with their provincial team. RFC 2 may find it hard to climb the leagues but I would hazard a guess at them maintaining 10k supporters IF they retain Ibrox. A club like this in the lower divisions might climb within 3 seasons. They may get back the support they had during the triumphalist years but it may be the case that some permanently defect to the Mortons of this world. That scenario is sustainable for Celtic and Scottish Football but short term funding for the turkeys would need to be found.

     

     

    Maybe I shouldn’t call them Turkeys if we need them to be reasonable mind.

    I almost agree with you except reading Article 14 it states it is a matter for the GM passing a Qualified Resolution requiring 90% rather than a Special Qualified Resolution requiring 83%.

     

     

    I also believd that Celtic will take the stance you believe they will but they may well be a lonely voice shouting in an empty room.

     

     

    Paul67 believes this is a reserved matter for the SPL which requires a majority were selected representatives vote. I also believe this is the SPL’s view.

     

     

    I think it would put pressure on the SPL to enforce their own rules and articles rather than bend them to suit a Newco. As I stated in last post getting the CST/CSA and possibly other clubs supporters organisation who would be against a Newco being transferred the oldco’s share would be a good idea. Premptive strike armed with legal opinion either to make sure the rules/articles are enforced or armed with the evidence that the SPL require to call a GM to pass a Qualified Resolution tightening the rules prior to the Newco situation arising.

     

     

    Celtic cannot be seen to act prior to the liquidation event occurring.

    In years of reading this site, your idea here, that the Associations should pony up some dough and arm themselves with legal opinions on whether the HMRC FC should be allowed a straight jump back into the SPL as a NewCo is the best I have ever read on here. Easily.
