Ellis throws administration a legal curveball

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

    A bit of common sense has to be applied here.

     

     

    As I asked earlier, what have HMRC done a deal on?

     

     

    No one knows the outcome of the Huns appeal against the tax bill, so how can ‘a deal’ be struck when the amount is not known?

     

     

    Who is the deal with?

     

     

    Craig Whyte admitted last week he twice tried to settle with HMRC and was told where to go – he then made derogatory comments about HMRC in the same interview. Do you think HMRC have suddenly had a change of heart on the matter?

     

     

    Craig Whyte is the owner of Rangers. How can he walk away with £3.5m when the administrators have not made any decision on what bid, if any, they will accept for the club?

     

     

    Apparently, the biggest bid on the table is £12m. If for talking sake this bid is accepted by the administrators and Whyte agrees to do a deal to sell his shares and the assets – £12m will result in creditors getting around three pence in the pound, and not 10p.

    Over the weekend there has been little or no news regarding Rangers and that tax case,has there been a solution to all their problems,have they miraculously been absolved of all their wrongdoings.

     

     

    Anyway the point I’d like to make is, Never again should Rangers directors in fact,Any directors of any football club in the SPL, be appointed to top jobs in the SPL,SFA,there is far too much temptation for anyone to take their eye of the ball,and allow a little leeway to any club they were previously been linked too,a very big temptation for anyone.

     

     

    It beggars belief that a person who has admitted to receiving an EBT should be appointed to the head of an organisation that runs Scottish Football,Would the ex manager of Scotland have received an EBT when in the appointment of RFC,I think he would have benefitted along with the others that received them. Would Gordon Smith have been in receipt of an EBT?,more than likely.And too think they all had top jobs at Hampden,again,it beggers belief.

    If the huns are liquidised the administration part is irrelevant. If not then a multitude of other factors should see them thrown out of the SFA but that will not be pursued by most but Celtic should definitely pursue and not just be seen to pursue.

     

     

    So Rangers IA cannot stagger along within the SPL if the game is to retain any semblance of integrity and not just within Scotland but Europe too same with a parachuted Newco.

     

     

    The Germany system is pretty similar to what the FFP is hoping to achieve.

     

     

    Any compromise at the level of fraud we are talking about leaves the FFP a dead duck and UEFA open to accusations from governments and national associations and that it is a vehicle for crime.

     

     

    I know that we will all have to wait for the answers but not much longer.

    The Rangers situation appears to so complicated that only a very few people will know the full extent of there debt.I think before it is all finished certain people may well be prosecuted.What we are witnesing is the unravelling of one mans naked ambition.The drive to win the European cup drove him to go beyond the norm and we know he spectacularly failed in his quest for european glory.To call the man clever because he built a multi billion empire is probably correct.However,at the same time he was deeply flawed and his flaws are now coming home tro haunt him.H.H.

    This is about responsibility. Someone who holds a position of responsibility amongst our support has to be more careful, and if they let themselves down they also let down a large number of our fans.

     

     

    I said the other night, I spent a great evening on Saturday with a guy called Matthew Marr, a former Labour Party spin doctor, who resigned after saying some rather unflattering things about Alex Salmond at a politics award dinner.

     

     

    He didn’t have to be told what he did. Didn’t need it pointed out. Nor what he had to do. He realised a guy in a position of responsibility such as his could not survive in the circumstances, and he quit the following day.

     

     

    Our support is not a broad church but a collection of churches, with some synagogs and mosques, atheists and even Jedi’s (oh yes) thrown in. We are not an arm of the Catholic Church, and we certainly are not sworn enemies of the Protestant one. Some of the greatest men in our history were of the Protestant faith, including the greatest.

     

     

    I don’t find it funny when people wish death on others because of their religion, and there are people on here today who are defending something which, for me, has no defence. It might have been a joke, not intended, misconstrued – and you have demonstrated BRILLIANTLY how that could happen – but perception is reality in this game, and there’s simply no alternative course of action here.

     

     

    Our supporters will be whipped with this for a long time to come. This is bigger than one person, and whether or not he’s mates with people on this site. This is the reputation of the Association and, by default, a large section of our support.     The woman, well-dressed and businesslike, resembled nothing more than the secretary she was. The man was a study. He was affected by an eye problem and carried a stick but he was familiar to many Glaswegians and a close friend of the celebrated.

     

     

    Flax Flaherty and Irene McDonald were taking part in a ritual that seems unthinkable nowadays. The newspaper seller and the Celtic secretary were carrying the wages to Parkhead where they would be put into brown envelopes and distributed to some of the best players in Europe.

     

     

    Flaherty may have been the unlikeliest of bodyguards but he would almost certainly have been able to identify any potential robber. Flaherty knew people. His pitch at Queen Street station brought him into contact with the mass of football life.

     

     

    He became friendly with Jock Stein simply because the future Celtic manager passed through the station so often as a player. Stein, who led Celtic to unprecedented success, was driven to Dunfermline for his first interview for a manager’s job by Flaherty.

     

     

    “It is an extraordinary insight into how close football people once were to the fans,” says Kevin McCarra, whose ‘Celtic: A Biography in Nine Lives’ features the story. Flaherty, he recounts, ran a supporters’ club and was an agent for Celtic Pools but the vendor’s familiarity with players and management was renewed on a daily basis. Flaherty would take papers out to Parkhead for players to peruse after training and attended faithfully to the task of delivering the Noon Record to Neilly Mochan, the Celtic trainer, before the start of the afternoon’s racing.

     

     

    “Flax symbolises a different time,” says McCarra. “He met Stein because players took the train in those days. Stein was given a Ford Anglia by Celtic when he started coaching but before that he would use Queen Street station regularly. He also gambled in a bookies next to the station so Flax and Stein were never far apart.”

     

     

    The notion of two people walking towards Parkhead with the players’ wages is now absurd. The sums involved would mean that any cash would have to be transported by pack horse. “But it symbolises how a fan could be part of the club,” says McCarra, whose book contains a photograph of Flaherty clutching the European Cup in 1967.

     

     

    McCarra’s book seeks to address aspects of the club and its history through different personalities. The Celtic nine are: John Glass, who chaired the meeting that launched Celtic into existence; Willie Maley, player and long-time manager; Jimmy McGrory, extraordinary centre-forward and later manager; Bob Kelly, an influential chairman; Stein; Flaherty; Billy McNeill, player and manager; Fergus McCann, who saved the club; and Martin O’Neill, the manager who took Celtic to the UEFA Cup final in Seville.

     

     

    The result is a brilliant, expansive portrait of a club and its heroes down the years. McCarra has also captured moments that will never occur again as the sport has changed dramatically. He points out: “Celtic won the league in 1972 and the next week there were 20,000 inside Parkhead.”

     

     

    The present economic climate is difficult yet Celtic and Rangers have both managed to sustain a hugely significant presence of season-ticket holders. But there is a distance between fan and celebrity. “Neil Lennon would have no problem interacting with the fans as Stein did,” says McCarra, who interviewed the Celtic manager for the O’Neill chapter. “But the idea that he would need a lift from a fan to a job interview is risible.”

     

     

    McCarra was impressed by Lennon’s character and candour when he interviewed him. He accepts that Lennon also speaks directly to a Celtic experience.

     

     

    “It is a bit early to put him alongside the nine in the book but he has the maverick streak that characterises the rest of them,” he says. “He is a strong character. When people talk of the awful situations that surround him and whether he will leave Celtic, I believe he is so thrawn he won’t go. He doesn’t back down whether it is in Northern Ireland or in Glasgow.”

     

     

    The route to greatness for Lennon as a manager must go through Europe. “There is a challenge for Lennon at Celtic to try to find a way to create some sort of success in Europe. I believe he is keen to meet that challenge. Where would he go if he left Celtic now? A mid-table club in England? He has the chance at Parkhead to test himself and his ideas in the Champions League.

     

     

    “He certainly seems to be a motivator, too. Celtic may have been flat in the League Cup final against Killmarnock but he certainly had his team up for the match on Saturday at Rugby Park. His players tore Killie to shreds. I imagine he is a manager that players react to strongly.”

     

     

    Another contender for a place in an expanded Celtic history would be Peter Lawwell, the chief executive, who has faced strong criticism from some fans over his financial prudence. “He was obliged to create a new financial model,” says McCarra. “The Martin O’Neill years were a lot of fun for Celtic fans but that scale of spending could not continue.”

     

     

    Celtic, he said, have invested wisely in the scouting operation and that has paid dividends with such as Emilio Izaguirre, Biram Kayal and Victor Wanyama. “It is a steep march upwards for Celtic. They need intelligence both in the sense of information and how to use it,” he says.

     

     

    This hard climb is the modern reality. The stroll seemed easier when Flax was heading out from the city centre.
