Ellis throws administration a legal curveball

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

    Willie Collum insists morale is high amongst Scottish referees at present, despite two high-profile resignations from the game.

     

     

    Category One officials Steve Conroy and Charlie Richmond have both recently decided to stand down, despite having refereed in the Scottish Premier League this season.

     

     

    Nearly 18 months on from a strike by the country’s top officials over unfair criticism, FIFA-listed ref Collum believes the picture has changed for referees.

     

     

    “I think it [morale] was low for different reasons,” said Collum. “Certainly the morale of the referees just now is good. We’re performing well.

     

     

    “I’ve just returned myself from a Europa League quarter final between [Metalist Kharkiv] and Sporting Lisbon. For a Scottish refereeing team to go so far in Europe is excellent.

     

     

    “I am also part of the Euro 2012 team with Craig Thomson, which is fantastic. Scottish refereeing is thriving.”

     

     

    Following the refs’ strike, the Scottish Football Association launched its Respect campaign, aimed at improving relations between officials, managers and players.

     

     

    Asked if he felt the initiative had been a success, Collum said: “I think without a doubt. I think there has been more respect shown to referees. I think we’ve felt that as a body in general through the discussions we have had.

     

     

    “I think it has been an easier time for me personally. I don’t think I have been involved in as much controversy. I’ve certainly been enjoying my refereeing. No matter how difficult games are, it’s always important to enjoy it.”

     

     

    Despite the campaign, a number of managers have found themselves in trouble with the Scottish FA for comments made about referees both before and after matches.

     

     

    Collum though has some sympathy for those who speak out in the heat of the moment. “It’s disappointing but I think managers are sometimes asked their opinion very near the end of the match,” he said.

     

     

    “When the match finishes, right away they are asked their opinion. Sometimes people say things they think they maybe shouldn’t have said.”

     

     

    Referees have often been called upon to explain certain decisions following games but, following a previous failed attempt to communicate with fans, Collum doesn’t believe such a scheme would be beneficial.

     

     

    “We’ve trialled that through the Whistleblower,” he said. “It really became a ground for referees to apologise for decisions. I am not so sure I would need to come out and explain decisions.

     

     

    “We are very happy to talk to the clubs and talk to the players. Every manager in Scotland has the opportunity to come and speak to the referee at the end of the match and engage us about decisions or anything that happened in the match.

     

     

    “We are happy to speak. We are happy to speak to the players, the coaches and, at events like this, the media.

     

     

    “I don’t know if putting a microphone in the referee’s face five, ten or 15 minutes after a match would bring benefits for anybody.

     

     

    “Referees are under pressure. But so are players, coaches and managers. So are directors and chairmen. Everybody in football is under pressure to produce results.”

    Me,I’m no accountant-as I said-but I can see bo way back for them in their current form.

    I definitely recommend it, Petra is almost impossible to explain. A bit like the 1st time you view the players running out at Paradise. Amazing.

     

     

    There’s also a holiday inn at the dead sea and that puts you half way between most sites in Jordan, From there you are 30 mins to Bethlehem & 45 mins from baptism site. The whole landscape here is incredible. I wont go into it but there is a story regarding an angel in the Koran that explains why it is the way it is. I often go up to Karak and from the top of the hill in the castle you have views all the way down across the mountains and over the dead sea to Israel. Amman is ok but i would choose Aqaba over it.     IMO ,liquidation was the plan all along ,to stiff HMRC and the wee bonus of ridding ragers of all the sold off future revenue streams ,small creditors (collateral damage ).

     

    Could a knight of the realm do what has been done over Govan way in the last year ,could a bank ,no but what if someone knew someone who could .

     

    Also the peepil don’t just want a ragers in the SPL ,they want a strong ragers competing for titles (they don’t do second place very well ).

     

    When the cowards aid the newco to waltz straight back to where the peepil belong ,what’s to stop them having a share issue to raise cash for their new team (how many hurtin bears would dig deep for the new debt free owners ,to put Timmy right back in his place ) plenty I say .

     

    Will a multiple points deduction for the newco survive a court case ?

     

    Think on this how many contracts have this lot tried to have ripped up this year alone .

     

    IMO when the debts are dumped and only then will the real investment come into view ,maybe the newco changing hands one more time just to keep up the pretence .

    SSN reporting that Shaun Derry has lost his appeal from the weekends red card against Man Utd, the huns of England.

     

    Firstly AY was offside, secondly it was a dive that any hun would have been proud of.

     

    So given the chance to correct a wrong decision, the FA have decided to make a third mistake for the same decision.

     

    These suits running football are killing the game for the fans.
