Ellis throws administration a legal curveball

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

    Put it this way, if Joe were the recognised spokesman for all the support, rather than just a section, the weight of that wider office would insist on a higher degree of care. PR would be a full time component..

     

     

    As it is, something said by one person representing a part of the support (and I have no idea how many) can be seized on and exploited by those who wish to make trouble for the club as a whole.

     

     

    More than a change of personnel is required to address the issues that surface as problems.

  6. Not having any accountancy background I may be well wrong but I thought that a company in administraion HAD to be made solvent in order to continue trading. RFCiA clearly aren’t, according to their administrators on Friday so they, therefore, shouldn’t still be trading!? Any takers?

    As you’ll have noticed, there’s a lot of ‘background noise’ on the blog today, so that also partly explains the lack of reply.

     

     

    As for your second question about why D&P, et al, are so upbeat about the proposects of der Hun: there should be no surprise in that: it’s their job: it would be more curious if they were coming away with the line that “RFC(IA) is a dead duck, everyone. Don’t waste your money on it. We will be closing things down in a few days/weeks, so just bide your time …”

    It was a fine feeling this morning to hop out of bed a remember that Celtic are the Champions again. Magic.

     

     

    I see the CQN conversation has is turning towards the make up of next season’s SPL and note the ‘outrage’ of one anonymous SPL Club Chairman, following the rebuff on the voting issue from Rebuff & Phelps, that the Adminstrators have got a vote at all.

     

     

    Guys like Yorkston at Dunfermline and Johnstone at Killie have their “once in a lifetime opportunity” to change the game.

     

     

    Rather than look at ways to transform quality, re-engage fans or accelerate the development of young people, they want to make a cash grab.

     

     

    Debt is a shareholder issue. they took the debt on, and they ought to jolly well put more capital into their clubs if their debt supported business plans have bombed. That’s the deal for shareholders.

     

     

    And if you can’t afford to invest to remove the debt? Well, you sell up, and hand over to someine who can make it work. Put up the capital, or bring in new shareholders.

     

     

    But no, not these two charming rogues. No, they see an opportunity to take a chunk out of other folk’s revenue. A dirty deal to give a Newco entry to the SPL in exchange for the voting power to redisribute the cash in the game.

     

     

    To be quite clear, I have no particular beef with the suggestion that there is a better way to distribute the cash. But there are two problems with that in isolation:

     

     

    1) There isn’t enough cash in the game. Redistributing it essentially doesn no more than rearrange the deckchairs on a ship heading for the rocks.

     

     

    2) The clubs in the vanguard – Killie and Dunfermline – are irreparably screwed with debt two or three times their annual revenue. Their creditors want their money back. Any cash redistributed to these clubs simply takes money out of the game, and reduces the quality of the game accordingly.

     

     

    If these guys want more of the football money, they need to get their clubs’ finances in order first. Motherwell? St Mirren? St Johnstone? Good clubs, run within their means. Money given to these clubs will be spent adding value to the game. that’s a good thing.

     

     

    Some of the others? Toxic.

     

     

    On a Newco Vote: My clear understanding from the Horse’s Mouth is that Celtic will vote against a Newco entry. Celtic though think that the other clubs will vote in favour, with most being a shoo in to support a Newco application. Hibs, Dundee Utd and Aberdeen are the floaters.

     

     

    It will come down to the moral judgement of Petrie, Thompson and Milne, each of whom are swithering. It is even possible that the whole vote shenanigans are caused by the anxiety that there isn’t yet enough votes to guarantee Newco safe passage, with the usual suspects terrified of what their world will look like with no Rangers to feed off.

     

     

    What’s best for Scottish football is not necessarily what’s best for John Yorkston’s Dunfermline, or for that matter, The Battered Bunnet’s Celtic. The game needs to be regrounded on strong values, not short term cash. Newco in the SPL heralds the start of Franchise football, with the game representing little more than a series of exhibitions played around the country for the benefit of no one.

     

     

    At this time it serves us all well to be talking to supporters of other clubs. It is their clubs afterall that will determine the shape of senior football in Scotland next season and far beyond.

    Then again the same company is responsible for rankers becoming Scotland’s Shame, since it bankrolled them on the proviso that they would no longer employ Catholics.

    The 31st of March rule with regards financial administration does not exist with regards to obtaining a license domestically.

     

     

    The rule about adequate financial returns does exist however as well as a MANY other criteria as you well know but cloaked in non committal language.

     

     

    I would suggest that with RangersIA at the moment have transgressed more than enough of these but the appetite is not there to pull them up about it.

     

     

    But as you point out has this has not been adhered too previously with regards to clubs that have fallen into administration so RangersIA should be given the same leeway.

     

     

    Do you reckon that Scotland is on the road to European obscurity for a few years if a Rangers Newco were to be parachuted into the SPL or will UEFA tolerate this behaviour ?

    What a lot of nonsense being written about Joe O’Rourke.

     

     

    First of all, I’ve a conflict of interests here, because I know Joe O’Rourke, although I haven’t spoken to him in at least ten years.

     

     

    Many years ago, before my parents considered me old enough to go to Celtic Park without adult supervision, a young bhoy who desperately wanted to be there every week, received a match programme every Monday afternoon, courtsey of Joe O’Rourke. I don’t think I ever told him just how much that meant to me, but if you’re reading this Joe, it was only a small thing, but it made it far easier for me to accept I couldn’t get to see Celtic every week. Just the idea that someone who WAS there had got me a programme from Celtic Park made me feel like I was still part of the Celtic family, even though I couldn’t physically be there.

     

     

    Years later, when I left for university in England, Joe made sure that the local Celtic community knew who I was and asked them to look out for me. As far as I’m concerned, Joe O’Rourke is a good man. One of the best.

     

     

    Having got that out of the way, in my opinion, all Joe is guilty of is forgetting, probably momentarily, that his tweets are read by people who bear him malice, as well as friends. He made an unguarded comment, the type of which most of us have made at one time or another if we’re being honest with ourselves. The difference here is that Joe’s words were written, not spoken, and available for all to see who weren’t part of the conversation.

     

     

    I also refuse to believe that there is any genuine outrage out there about what he said. Most of the outrage is actually coming from peepul who are delighted by the comment, because in their minds it validates their own prejudices.

     

     

    Dark Mingwall, whose website routinely carries beyond parody anti-Catholic sentiments of the nastiest kind, is heavily involved in the Blue Knights bid for Rangers and is regularly put in front of the TV cameras to speak for their supporters. I don’t see any outrage about his involvement.

     

     

    I realise that may be perceived as whataboutery, but it’s important to not lose sight of the motivation of most of the peepul calling for Joe’s head on a plate. These same peepul claim the Famine Song is just “banter.” Seems like they can give it out, but they can’t take it.

     

     

    Someone mentioned earlier that (and I’m paraphrasing here) as a Catholic they were angered by Joe’s tweet. As a Catholic myself, I cannot share that anger. The centre and summit of the faith is the Eucharist, Christ’s sacrifice in atonement for our sins. Closely related to that is the concept of reconciliation and forgiveness. We are commanded to forgive our brother seventy times seven times. So as a Catholic, once someone has sincerely apologised, whether their contrition is perfect or imperfect, a line must be drawn under it and a fresh start with a clean slate made. I’ve no problem with saying what he said was wrong, but that doesn’t mean he should now be hung out to dry.

     

     

    Sadly, I’ve no doubt Joe will be forced ultimately to resign from his post with the CSA, but that is more an indictment of the thought-crime society we live in than it is of the character of Joe O’Rourke.

    the SPL are doing all they can to make the product they offer attractive to the TV companies and the paying public – so obviously they need to avoid 10 pt deductions but if they want real competition surely they should be awarding RFC 10 pts at the start of next season?

    Nice 1 mate, is that the weather changing now with you, you’ll be itching to get out more after watching the masters i bet. All good here although left work at 7am today, ended up on a drip in the hospital for a couple of hours and got an injection to my butt, bad reaction to a mosquito bite, my whole arm is swollen.   25. Just how much money would an SPL side lose with no RFC in the league? In terms of home gates, 1 or 2 games a year when they get an additional 4,000 or so fans through the gates.

     

     

    Let’s say that’s 8,000 fans in total. There will be additional costs associated with a larger gate, so let’s assume they make £20 per ticket. And let’s add on a couple of quid a person for any incidental spend.

     

     

    So that’s 8,000 * £22 = £176,000.

     

     

    And that’s pretty much a maximum figure. In some seasons there will only be one home game.

     

     

    Now how much could each club gain out of a different distribution of tv money, added to the increased potential for prize money and, for some, European football?
