Offensive Behaviour and Threatening Communications Act

311

Can there be any surprise at tonight’s news that police are now investigating alleged harassment of members of the SFA Judicial Panel?  On the way home tonight I almost drove off the road when I heard Scotsman journalist, Tom English, on Radio Scotland tell us Rangers knew who sat on the judicial panel a day before Ally McCoist demanded to know who they were on Rangers TV.

Now the SFA inform us the panel members’ identities have been “compromised”.  There was no suggestion their identities were hidden until McCoist fanned the flames on Tuesday, these individuals were not subject to a witch hunt or harrassment.  The Association added “all three panel members have reported intrusion into their personal and work lives, including abusive and threatening communication.”

In Scotland we now have an Offensive Behaviour and Threatening Communications Act.  The Act criminalises “behaviour likely to lead to public disorder which expresses or incites hatred”.   We’ll now see how the law works in this country.

  1. Sue Barker: Who is this mystery sports personality?

McCoist: I don’t know but I think these people should be named and abused and threatened.

  2. The reason that the judicial panel should remain anonymous is exemplified by the threats which have inevitably followed disclosure. McCoist has way overstepped the mark. He raised the tension and in full knowledge that the knuckle staggers would put 2 and 2 together and come up with 1690, he accused the panel of acting intentionally in punishing his club perhaps pushing them over the brink.

But who believes McCoist was unaware of their identity? One of the names mentioned is a respected counsel who lives very near Sally. Now he is under personal threat and whatsmore his professional status will be under threat – how many Hun jury members will put their prejudices to the fore?!!

They are going down. However, as Manchester demonstrated they never lose without trying to make life a misery for everyone else. Marches, walkouts, protests will inevitably turn to violence. So enjoy their demise but be careful…

  3. 'crushed nuts?' 'Naw, Layringitis!' on

we’ve won, there will be no march, no boycott, no gathering of ideas, no significant cash, not even a wreath on the grave. They will walk away and deny they were ever there in the first place. The world will continue to turn, the universe will continue to burn, but ranjurz(ia) will be no more.

“I think that if Alex Thomson can prove his claim about the threatened violence towards him, then Strathclyde Police may be in for a very tough time.”

In the stuff I read he didn’t threaten Thomson personally (for obvious reasons, as he can barely function) but he was encouraging other people to do it – and we know the lunatics that think Legless is the font of all wisdom.

Hmmm,I take your point, but I doubt it refers to that as surely the police wouldn’t find internet incitement to violence to be laughable.

Not in view of recent legislation.

    But you’re probably right.

Surprising,as I would expect my collar felt if I wrote similar.

  9. Paul – Threats might be an offence under the new Act but unlikely to be the ‘Offensive Behaviour at Football’ offence (which you’re quoting) as that has to be on the way to or from or at a match – but it could be the ‘Threatening Communications’ offence – which covers threats of serious violence or threats inciting religous hatred.

  10. The only thing that is keeping a smile on my face is that police suspect that a dead man found in a zipped holdall has died in suspicious circumstances.

On a lighter note, for anyone interested…

Is it just me that reckons the SFA are going to have a lot of explaining to do to UEFA over the shunannigans of the past 2 decades??

Their situation is surely precarious. A bigger fish than an over ambitious bigoted juniors club from Govan.

In all my years of following Scottish football, never and I mean never have I heard such an unparalleled vindictive and frankly sinister diatribe from anyone involved in our game as we witnessed last evening from Mr McCoist.

Let’s be clear here, this was a call to arms, a rallying call to the bears and knuckle draggers, who sadly are all too numerous within the fan base of RFC(IA).

If this had been Mr Lennon, before his interview had finished, Editors and opinion writers would have already been securing front and back page space for their articles on how he should be ran out the country back to where he came from, a lifetime ban on his being involved in any club in Scotland.

Some would also be calling for police involvement for these comments would have broken several laws on incitement and public order.

Instead what did we get this morning and since? Apart from Jim Spence on Radio Scotland the majority of hacks excused his ranting and incitement as nothing more than someone who had been through so much stress calling for transparency and openness.

We now know that today on several RFC(IA) fan forums the members of the disciplinary panels have been named and in some cases their business interests disclosed as well as address printed. Strathclyde Police have also been reported to have visited these indivuals and given advice on security measures to ensure their safety.

This is Scotland in the 21st century, a country that prides it’s self on its tolerance. Mr McCoist was very aware of his audience; he worked at the BBC and ITV for many yrs. and knows full well the impact his statement would have. This was not an off the cuff remark and he should be dragged over the coals for this shameful display, not his first this season btw. Anyone remember his comments after the Aluko hearing? On that occasion he named the members of the panel and escaped censure.

This man has shown over the previous 12 months that he has neither dignity nor class and has proved that he will resort to the vilest, nastiest and frankly repugnant behaviour if it serves his purpose and further endears himself to the most inarticulate among the followers of RFC(IA).

A horrible man who has neither morality nor empathy.

In John Powell’s book, Through Seasons of the Heart, he has a thought for every day of the year.

This was his thought at Christmas.

“There is an old Christian tradition that God sends each person into this world

with a special message to deliver

with a special song to sing for others,

with a special act of love to bestow.

No one else can speak my message, or sing my song, or offer my act of love.

These are entrusted only to me.

According to this tradition, the message may be spoken, the song sung,

the act of love delivered only to a few,

or to all the folk of a small town,

or to all the people in a large city,

or even to all the people in the whole world.

It all depends on God’s unique plan

    for each person.

. . . Your message has been heard in my heart,

Your song has warmed my world,

And your love has brightened my darkness . . .”

    http://www.dailymail.co.uk/sport/football/article-2135281/Police-called-SFA-panel-receive-threats-Rangers-ban.html#ixzz1t67yXAUa

Poilce have been called into Hampden to deal with threats issued against the men responsible for hitting Rangers with a one-year transfer ban.

And the entire judicial panel system has been thrown into turmoil after one of the volunteers ‘outed’ by internet thugs was pushed to the brink of resignation by the ugly backlash.

Following a rash public demand by Rangers manager Ally McCoist that the SFA name the individuals who sat in judgment on the insolvent Ibrox club, the identities of all three were published on message boards and via social network sites.

Rash demand: Rangers manager Ally McCoist called for the panel to be named

All three panel members, as well as directors of the SFA, have now reported receiving abusive and threatening communications – threats considered serious enough to merit action by Strathclyde Police.

An SFA spokesperson, pointing the finger firmly at whoever leaked the identities of the independent judges, said: ‘We are deeply concerned that the safety and security of Judicial Panel members appointed to a recent Tribunal has been compromised by a wholly irresponsible betrayal of confidential information.

‘The Judicial Panel consists of volunteers from across the spectrum of sport and business in Scotland. They are appointed on the basis of anonymity, yet all three panel members have reported intrusion into their lives, including abusive and threatening communication.

‘This has been extended to directors of the Scottish FA. It culminated tonight in a visit by police, who are taking seriously the threats made.’

Sportsmail knows the names of the three independent adjudicators, appointed from a list of around 100, who have made themselves available to hear cases at Hampden.

But we will not be identifying them – for the same obvious reason that McCoist, who could easily have used private channels to get the information from one of the Rangers representatives present at the Hampden hearing, should not have demanded that they lose their anonymity.

It is understood that one of the three is considering his position and has revealed he has received advice from Special Branch regarding suspect packages.

Targeted: Officers were summoned to Hampden after identities were exposed

The individual also released a statement saying: ‘I can’t discuss anything about the case for reasons of confidentiality.

‘I hope that, when the statement of reasons is published by the SFA, responsible people will understand the reasons for the decision.

‘I have no axe to grind with any football club.’

Former Rangers owner Sir David Murray’s company has been ordered, meanwhile, to hand over all paperwork relating to the takeover by Craig Whyte.

Administrators Duff & Phelps are suing legal firm Collyer Bristow for £25million over their handling of the buy-out and the Court of Session has been told Murray will provide all e-mails, faxes, file notes concerning the deal.

  19. As part of their fightback against the SFA, has anyone heard yet if TFPLG has asked to have his name removed from the Hall of Fame at Hampden?

They should start a new section and call it the Hall of Infamy!

Who else would be up there I wonder……

  20. my grandfather is now in Craig Whyte class as he was also Sine Die by SFA because he went to league of Ireland ( not recognised by fifa then) he travelled Ireland and made a few bob playing for Bray Wanderers for 2 years, then came back before the war and played junior footie, saved 3 penos (not shoot out) in one match a record at time. anyway he was celtic reserve goalie in earlie 30’s and ended up getting one first team game against Raith Rovers in the league cup before he decided some good cash in Ireland playing first team and not being down the mine weekdays then training then playing reserves for biscuit tin money.

  21. What a shambles those penalties were tonight.

  29. What a superb irony (providing that the panel members remain unharmed) that McCoist has possibly hastened the downfall of his beloved Peepil, by his sheer

stupidity and ignorance. A rudderless shameful excuse for a Football Club brought to it’s knees by cheating, and now potentially mortally wounded by incitement to cause violence and harm, from their very own master.

A despicable cheat of a player, who demonstrated a masterclass in simulation before the word was even used in football terms.

    A fitting epitaph.
