Can there be any surprise at tonight’s news that police are now investigating alleged harassment of members of the SFA Judicial Panel?  On the way home tonight I almost drove off the road when I heard Scotsman journalist, Tom English, on Radio Scotland tell us Rangers knew who sat on the judicial panel a day before Ally McCoist demanded to know who they were on Rangers TV.

Now the SFA inform us the panel members’ identities have been “compromised”.  There was no suggestion their identities were hidden until McCoist fanned the flames on Tuesday, these individuals were not subject to a witch hunt or harrassment.  The Association added “all three panel members have reported intrusion into their personal and work lives, including abusive and threatening communication.”

In Scotland we now have an Offensive Behaviour and Threatening Communications Act.  The Act criminalises “behaviour likely to lead to public disorder which expresses or incites hatred”.   We’ll now see how the law works in this country.

  4. MCCoists outing of the independent panel coupled with the incitement of the lowest common denominator of the rangers support has had the expected consequences for the individuals concerned. The threats and offensive behaviour these individuals have been subjected to are a direct result of Mccoists approach. None of this would have happened without his emotional intervention ; the fact that he knew the panels names and yet demanded they be named and shamed in the media was a calculated attempt to intimidate the people involved. Correctly the Police have stepped in to provide advice and precautions to those affected.

     

     

    The next task for the Police is to investigate Mccoists role in all of this ; I would not be surprised if Stephen House of Strathclyde Police has already been informed of this action by MCCoist.

     

     

    I hope no harm comes to these individuals and th perpetrator Mccosit is brought to justice.

    The three-man SFA Judicial Tribunal which handed out swingeing penalties to Rangers – one of which was a year-long transfer embargo – included one of the most highly regarded QCs in Scotland, Telegraph Sport can disclose.

    Gary Allan – described by a colleague in the Faculty of Advocates as “out of the top drawer in the profession” – was joined by Raith Rovers director, Eric Drysdale, and former British Forces Broadcasting football commentator, Alastair Murning, on the tribunal, whose rulings were announced late on Monday night.

     

     

    The sanctions imposed by the tribunal included a life ban from Scottish football and £200,000 in fines for Craig Whyte, who took control of Rangers from Sir David Murray last May, and £160,000 in fines plus the transfer embargo imposed on the club. The outcome triggered furious reactions from Rangers supporters and strong criticism from the club’s administrators, Paul Clark and David Whitehouse of Duff & Phelps.

     

     

    Ally McCoist, the Rangers manager, joined the chorus of condemnation on Tuesday – saying that the embargo “could kill the club” and asked: “Who are these people? I want to know who these people are.”

     

     

    In a worrying development on Wednseday night, it was reported Strathclyde Police have given security advice to the trio. In a statement, the SFA lamented a “wholly irresponsible betrayal of confidential information” that had left the panel at risk. An SFA spokesperson said: “We are deeply concerned that the safety and security of judicial panel members appointed to a recent tribunal has been compromised by a wholly irresponsible betrayal of confidential information.

     

     

    “The judicial panel consists of volunteers from across the spectrum of sport and business in Scotland. They are appointed on the basis of anonymity yet all three panel members have reported intrusion into their personal and work lives, including abusive and threatening communication.

    Clark and Whitehouse will meet SFA administrators on Thursday to discuss the course of their appeal against the sanctions but last night they were still awaiting a written account of the reasons for the judgement.

     

     

    Allan was originally appointed as an Appeal Chair member of the Judicial Panel in October last year, but he was also asked to be ready to serve on tribunals “in matters of complexity” such as the charges brought against Whyte and Rangers, which included bringing the game into disrepute and other breaches of rules and articles.

     

     

    At the time of his appointment, the QC said: “The Scottish Football Association has worked very hard and very carefully and it has devised a robust disciplinary code and process which it is confident will address the future and some matters which may have caused concern in the past.”

     

     

    Murning’s is a face familiar to many long-time Rangers season-ticket holders in the forward rows of the Main Stand at Ibrox. For several years he sat on the media gantry in front of the stand, reporting on matches for BFBS. He is a care-home operator.

     

     

    Drysdale has been a Raith Rovers shareholder since 1984 and connoisseurs of the ironies frequently thrown up by these procedures will no doubt note his 32 years of service with RBS, the bank whose rescue by the government represented the biggest bailout in British history.

     

     

    His own club revealed losses of £80,000 in the financial year to June 2011, with a similar shortfall projected for the current year. Raith are third bottom of the Scottish Football League’s first division and manager, John McGlynn, has endured tough budget cuts. “The question is – does Kirkcaldy want a football club, because it’s nearly coming down to that,” he said earlier in the season.

     

     

    McCoist also spoke on Tuesday of the option of Rangers quitting the Scottish Premier League and applying to join the SFL. “I am leaning towards it myself,” he said. “It would be an unbelievably drastic measure and it will have an incredible impact on Scottish football – and not for the good – but if they are going to continue to impose sanctions on us and make things extremely difficult for us to defend ourselves then maybe, just maybe, it might be the right thing.”

     

     

    However, the chance of Rangers joining the likes of Raith was discounted by the SPL and SFL on Wednesday. An SPL source said: “The first problem for Rangers is that if they stay in existence in their current form, they would have to give two years’ notice of resignation, but if they become a newco, that creates other problems which will not be simple to resolve.”

     

     

    The SFL’s chief executive, David Longmuir, said: “Well, the first thing I have to point out is that we don’t have a vacancy at present, although if Rangers were to drop out of the SPL for any reason, the likelihood is that two clubs would go up from our league. If that happened and Rangers, in one form or another, applied to join the SFL, then we would have a vote of member clubs, as we have had in the past. It might well be that the other clubs would welcome Rangers whose facilities, I believe, would meet our requirements.”

     

     

    Meanwhile, off the field, Telegraph Sport understands that a handwriting expert, who works with English forces, has been called in to assist Strathclyde Police with their investigation into Whyte’s takeover of Rangers. In the High Court in London on Tuesday, the Ibrox administrators raised a £25 million action against the club’s former lawyers, Collyer Bristow.

     

     

    Gary Withey, a former partner of Collyer Bristow and Rangers’ company secretary under Whyte, was accused by Mark Phillips QC – acting for Duff & Phelps – of having forged Whyte’s signature on a letter that stated that Collyer Bristow held funds relating to the takeover when, in fact, they did not.

     

     

    Meanwhile Strathclyde Police have dropped an investigation into a complaint by the chief correspondent of Channel 4 news, Alex Thomson, that he had been threatened physically by other journalists after arriving in Glasgow to cover the story. In a blog entry that was widely repeated in newspapers and such media sites as UK Press Gazette, Thomson wrote: “What I didn’t expect were the insults (and in at least one case, a direct physical threat) not from fans but from Scottish journalists. Sarajevo, Mogadishu, Kabul, Islamabad, Tripoli, Baghdad… I could bore you with more – in none of these places have I ever got this interesting reaction from local journalists. Only in Glasgow.”

     

     

    However, Strathclyde Police found no evidence to support Thomson’s complaint. “Frankly, it was laughable,” a source told Telegraph Sport.
