Someone kindly directed me to the audio file from BBC Radio Scotland’s Sportsound programme last night. Under recent scrutiny for his role, while general secretary and director of Rangers, in the alleged improper registrations of Rangers players with the SFA, he gave BBC reporter, Chick Young his thoughts on the matter.
While the BBC gave a robust defence of Mr Ogilvie stating that he was not in any way guilty of wrong-doing in relation to tax matters, which I am happy to accept, the entire debate never touched the question which has the potential to invalidate over a decade’s worth of football results.
Article 12.1 of the SFA’s Articles of Association states, “all payments, whether made by the club or otherwise, which are to be made to a player solely relating to his playing activities must be fully recorded”. The redacted EBT agreement published last month by The Sun suggested Rangers would pay the player £1200 appearance money.
The SFA should have no interest in whether tax is due on this money, which is a matter for HM Revenue and Customs, they should only be concerned as to whether Rangers submitted details to the SFA of any payments made in connection to football, including appearance money.
My Young, perhaps trying to help, explained that Mr Ogilvie, as company secretary until 2002, had administrative responsibilities, but took on a legislative role on becoming general secretary that year. This suggests Mr Ogilvie had primary responsibility to ensure Rangers complied with the necessary legislative requirements, including registering payments to players.
Should have mentioned earlier, Mr Young suggested Rangers EBTs “could actually prove, bizarrely, to be one of the great coups of all time”.
He’s not wrong there.

Traynor cottoned on to the fact that s Div 3 start would actually be to Rangers benefit in yesterday’s DR.
It does so on 2 counts.
1 players wages will be a lot less giving a Newco time to stabalise whilst winning.
2. It is the right thing to do and by accepting this Rangers start to recover some of the dignity tbey are so proud of and have lost.
If they were to go one step further and apologise to Scottish football for the damage done to it then total acceptance becomes possible not just of them by those wronged but within themselves by knowing their true nature and working to change it.
If they are forced there kicking and screaming “what about?” they will have learned nothing.

Zheng Zhi and his ineligibility problem
Could they both be connected? Was Zheng Zhi dressed up as Kris Commons last year to circumvent his ineligibility problem and unable to do so this year which is why we see the “real” Kris Commons this year.
Has anyone seen them both in the same room?

This coming Monday the Administrators are back at the Court of Session, seeking an administration order of all things. Yes, a strange situation. The best explanation seems to be that they are now seeking to be appointed by the court and not by the company. This will remove any of Whyte’s influence.
Given there was a clause inserted when the contracts were varied to reduce player wages that allowed them to become free transfers should Whyte emerge as the owner then they have not exactly been acting in his interests. And given their assertion that his floating charge is also worthless, could we see Whyte step in to object to their appointment?
Given that they were looking to actually sign Cousin, they have retained an on-loan player in Kyle Bartley who cannot be argued to form part of the value, and have paid off Dunfermline and others as well as continuing to accrue costs when in fact the likelihood of trading out of the malaise is generally agreed to be nil, and are already in dispute over the Collyer Bristow money, could HMRC step in and seek an alternative court appointment?
Would the pension fund people also disputing the cash also find reason to present D&P is unacceptable court appointees.
Above all that, could Brogan Rogan Trevino and Hogan and The Battered Bunnet find reason for us all to turn up en masse and issue our own objections?!
