The First Tier Tribunal not only delivered a verdict on Rangers tax case, they also nailed the issue facing an SPL Commission on the non-registration of player earnings.  Certain HMRC assessments were upheld and some declined, as we expected.  The findings:

Some payments were taxable and liable to NIC

Some payments were loans to players and “remain recoverable and represent debts on their estates”

Non-registration of side-letters [with the SFA and SPL]was incompatible with both authorities’ policing and disciplinary powers

The appeal “reduced substantially” the tax demand but upheld that “that advances in favour of certain players are taxable and liable to NIC”.  So HMRC can look to recover much of the EBT outgoing from recipients, whereas the tax and NIC elements will perish with the liquidated company.

I didn’t expect the FTT to report on the non-registration of side letters but they were categorical on this:

“Side-letters, of course, had not been registered with the football authorities, the SFA and SPL. The spirit of their rules was that the whole contract terms should be registered. Suspiciously, no evidence was led as to who decided that the benefits in terms of the side-letters should not be registered. Non-registration of side-letters was incompatible with both authorities’ policing and disciplinary powers. For example any fines imposed on players would customarily reflect the disclosed wage. Non- disclosure would thwart the authorities’ powers.”

The report is anonymised and no indication is given as to which elements of the demand were upheld, which were denied, or the quantum of the demand.

  4. Surely the Loans would be money owed to OldCo and not HMRC. Obviously they are not Loans and no one is going to pay them back but would not The Liquidator be legally obliged to collect on these Loans to pay the small tax bill & Ticketus. If he does institute Legal Action there could be some very interesting stories emerge. I don’t see this as good news for the Huns at all.

    The SFA does not need to do anything. They are not compelled to act on any SPL investigation.

     

     

    My guess is that the stripping of cups and titles will be enough.

     

     

    All other titles and cup wins Sevco will claim with full SFA approval.

    The monies are recoverable from the former players and their estates…..

     

    If I were a former player and the trust came to me to recover the ‘loan’ money that I knew was never a loan, my lawyers’ phone would be lighting up.

     

     

    A few law suits from a few former players claiming that they were lead to believe that these loans were not re-payable and I see the case being blown wide open again.

     

     

    Will all the players pay back their loans without resisting? Not a chance

     

     

    The question is WHEN would these loans need to be paid back to the trust? If no deadline given, this could go on ad infinitum (or ad nauseum even)

     

     

    This is far from case closed from and HMRC perspective.

    Don’t know if HMRC will appeal. As things stand, they will get more money off ex-Rangers players than dead Rangers. They will have the bigger picture to consider. Can they afford to let this stand and lose the tax from untold hundreds of people who had exploited this loop-hole?

    Charles Green was instructed after visiting UEFA and the ECA to deny that the SPL has any jurisdiction over them. I expect the SFA to eventually concur.
