Sine die Murray for Rangers lying and cheating

953

“The appeal is dismissed.” With those words at the Supreme Court in London at 9:52 this morning, Rangers tax cheating was established as fact. The charlatans who manipulated Scottish football fans were shown to be the disgrace they are.

Rangers made unlawful payments, totalling many millions of pounds, to footballers, who, by the club’s own admission in court, they would have been unable to recruit if they had to pay tax and National Insurance contributions for.

They lied to HMRC.

They also hid documents from HMRC, which only came to light during a City of London Police raid on Ibrox.

They hid documents from the SPL and SFA, failing to honestly register dozens of players.

They cheated the tax man.

They cheated the welfare state, the NHS, the police, councils, schools. They cheated the Army and other services.

The SPL’s (now called Scottish Professional Football League) Commission into these matters must now be set aside. It was conducted on the assumption that Rangers acted legally. Lord Nimmo Smith was clear that his conclusions were predicated on this point.  A fresh commission is required, we cannot just allow the biggest cheats in British sporting history wander off into the distance.

The SFA has failed to call Sir David Murray to account, or the other directors of Rangers, who had explicit responsibility to ensure the club acted within the laws of the land and within the rules of football, both of which it failed to do.

Murray should be sine died. God knows, I cherish every moment Dave King controls things at Ibrox, but he was a director of Rangers with legal responsibility for its actions. They should all be censured.

Celtic declared all payments to Juninho to the SFA and paid the tax when the scheme was exposed as being dodgy. No sporting advantage was gained. Chris McLaughlin BBC hang your head in shame.

Chris McLaughlin dragging Celtic into things via the Juninho EBT is one of the best things that can happen here.

    Why?

    Because, as I understand it:

    1. There was no attempt at hiding what or how Juninho was being paid in terms of registration or side letters.

    2. Celtic played no part in setting up Juninho’s trust or had anything to do with it. It was already established when he arrived at Parkhead.

    3. EBT’s are legal if administered properly (as someone is very fond of telling us) and Juninho requested that his wages be paid there.

    4. As the Supreme Court affirmed this morning, there is nothing wrong with having your employer pay wages or any other remuneration to a third party as long as the tax is paid on said sums.

    5. Everyone knows that Brian Quinn (God bless his cotton socks) reviewed the arrangements with Juninho and had Celtic declare the payments and pay the tax (whether it was to Juninho personally or to a trust is of no relevance).

    6. I would be more than happy to invite the SFA/SPFL/HMRC/The Salvation Army and anyone else to contrast and compare this course of action in terms of procedure, honesty, transparency and accountability to the paper shredding, side letter denying, non tax conforming, letter misplacing, question evading, account manipulating general cheaters over at Ibrox and Murray House.

    Things to attend to there.

Firstly I’d like to thank you for all your efforts re res 12 it sounded like a monumental effort by everyone.

I would have to respectfully disagree that it would only matter if we were dependent on said income. The £10M that was quoted in 2014 is a lot of money regardless if we as a club are dependent on it or not and I don’t believe our board want to hinder that club/rivalry too much so that it would jeopardise the substantial income stream it provides.

Sustainable income plans is one thing but that needs to come with transparency and accountability.

How on earth did they get their license to play in Europe prior to liquidation , DK passed the fit and proper test.

The people ( no pun intended) running our game have shown themselves not to be trusted in terms of transparency or accountability and them and the structure that protects them needs rebuilt from the bottom up.

Now that the cheating we all knew about is official, it’s high time Celtic PLC put the boot in and demand consequences.

Celtic were the prime target of this systematic cheating.

  23. SFA Statement –

The Board of the Scottish FA notes the judgment of the Supreme Court and wishes to clarify the implications of this final legal decision from a football regulatory perspective.

In light of the Inner House of the Court of Session decision, the Board of the Scottish FA sought external senior counsel opinion to ensure a robust and independent consideration of all implications of today’s judgment.

The Board received written advice from Senior Counsel, amplified when the QC attended a full meeting of the Board to discuss his conclusions.

Specifically, Senior Counsel was asked to anticipate whether a determination in favour of HMRC, as announced today, could imply that there had been a breach of the Scottish FA’s Disciplinary Rules as they applied at the time of the EBT payments.

The clear opinion of Senior Counsel is that there is a very limited chance of the Scottish FA succeeding in relation to any complaint regarding this matter and that, even if successful, any sanctions available to a Judicial Panel would also be limited in their scope.

Accordingly, having had time to consider the opinion from Senior Counsel, and having examined the judgment of the UK Supreme Court, the Board has determined that no further disciplinary action should be taken by the Scottish FA at this time.
