Summary of Rangers situation

1379

In response to some of the more excitable comments from yesterday it might be worthwhile painting the possible scenarios for Rangers.

No Sale

If Bill Miller is unable to complete the sale (remember, he’s not even paid the deposit and has no intention of doing so), the club will reach the end of the season and run out of money.  It will then either expire completely or Duff and Phelps will try to cut a deal with Ticketus to allow Rangers to sell season tickets and retain more of the money than they are currently due.

Rangers could continue to operate in administration for a while to come; Motherwell were in administration for one week short of two years.  The club would be unable to afford player wages after they return to normal in 1 June so would be forced to pare the squad back, whether the ban on player registration remains or not.

Miller completes purchase and the SPL vote him into the league

If Miller completes his purchase, as it stands, the SPL board will have discretion to transfer an insolvent club’s share in the league to a Newco.  Neil Doncaster has pinned his colours to the mast on this issue, Steve Lomas explained St Johnstone’s willingness to also vote Newco in.  Celtic will vote against which means if either Motherwell or Dundee United vote in favour of Newco, they will be allowed into the league.

I have no doubt that both Motherwell and Dundee United will vote in favour of Newco.  The SPL will vote to introduce a new procedure for dealing with Newco on Monday but it’s far from clear this proposal will get enough support.

For Miller, there are complications with this issue.  He would inherit all football and financial penalties due for Rangers and would also be expected to pay Rangers football debts – around £3.5m.

You can largely ignore the £160k Fit and Proper fines from the SFA but the SPL inquiry into Improper Registration of Players for over a decade will be the biggest charge in the history of British sport.  We should be looking at fines commensurate with the financial benefits accrued and multi-year sporting punishments.

If the SPL rule amendments Newco are rejected on Monday (as I expect), there are some who are concerned SPL board will impose lighter penalties than those suggested by Neil Doncaster’s new rules.

Alternatively, Miller could tell the SPL to stuff it and apply to the Scottish Football League.  Ally McCoist has already threatened this in response to the already-imposed fines and the notion is popular among Rangers fans I know.  If the did this, Newco would not have to pay Rangers football debts and would be subject to no penalties or player registration bans.  They could budget for three years of lower-league football and then tool up for the summer of 2015.

You can expect some though talking from Rangers on going to the Third Division in an attempt to spook the SPL into offering limited, single-season penalties.

Among the many unknowns, we can be sure of a few things:

Rangers Football Club, established in 1872, is finished.

Some form of phoenix will happen, if not for next season, then probably by 2013.

The SPL will complete the inquiry into Improper Registration of players, whether Rangers exist or not.  If a Newco is granted Rangers SPL share, penalties will be punitive.

Notions that ‘Rangers’ are going to emerge debt-free, strong and able to compete as though nothing has happened is simply nonsense.  Their club is dead.  They will start a new club, it will either be back in the SPL unhindered in 2015 (or 16) or will be in the SPL next season, heavily burdened for many years to come.

My prediction is for the latter.

This whole situation is wrong in so many ways. Am I the only one who has trouble explaining the situation to my children?

Children have such a refreshing innocence and honesty.

I try to instil in mine that if they do something wrong, i.e. cheating, then they must apologise and suffer the consequences. This is a very basic thing that all children have to learn.

What kind of message are rangers sending out to children?

Craig Whyte has stated he will not pay his fine.

Bill Smith is going to divide the business and ‘get rid’ of the debt and everything will be rosy.

McCoist demanding to know who was behind the punishment.

    They’ve not paid their bills

    They’ve not paid their taxes

What about all the people and businesses who have been wronged? they have hardly been mentioned in all of this. This is not a victimless crime.

What would be best for rangers? …………………….that they apologise for what they have done, and they cease to exist, so that I can easily and happily explain to my kids that there are indeed consequences of wrongdoing.

  8. Thought Big Vic had a shocker last night. Lost count of how many times he was intercepted/ lost the ball. He was far too lackadaisical last night. He really needs a shake at times. The game last night was total garbage. Did think Bangura was unlucky at times. He is lacking match fitness & confidence. Confidence is a valuable commodity in football. Just look at Torres. That is why I can’t understand how Lenny didn’t throw in young Dylan straight in after his buddies wondergoal. Now Watt isn’t getting a sniff when he must be high on confidence- don’t get that.

Thankfuully the Thai Tims cheered up tepid proceedings last night.

  15. The Ghood will prevail on

There are many aspects to this that confuse my wee brain, but notably:

    1. How can the newco exist in the SPL next season if it hasn’t an SFA licence? I was made aware that this license couldn’t be transferrered from one legal entity to another. (Also there is the SPL license).

    2. Regarding the improper registration of players, how can a newco, which has shed the skin of the oldco, be liable for the actions of a separate legal entity? If it is liable for punishment over double contracts, then why, for instance, is it not also liable for all the financial debts of the oldco, including the big tax bill when it hits?

    Any illumination greatly appreciated!

    I am seething….

I tell mini BT we don’y hate but they drive me to it..

I can’t believe they allowed that crap on the radio…

  17. Stv report on possible CL opponents from Grant Russell ( or have I got it the wrong way round) ” Rankers haven’t been recommended for a UEFA licence”. Nothing like dumbing down the crime!!!

  18. “Clubs are not allowed to change their legal form or structure in order to obtain a licence, simply by ‘cleaning up’ their balance sheet while offloading debts – thus harming creditors (including employees and social/tax authorities) as well as threatening the integrity of sporting competition.

Any such alteration of a club’s legal form or structure is deemed to be an interruption to its membership of a UEFA member association and, consequently, three years must pass before a club can apply again for a UEFA licence. In other words, the three-year rule is designed basically to avoid circumvention of the club licensing system.”

“If a club sets up a new company simply to avoid paying its debts or obligations then they would almost certainly fail the three-year rule [for obtaining the required Uefa licence] This is to ensure clubs do not simply create a ‘newco’ and leave the previous entity in charge of dealing with debts.”

and you are right they allowed it!!! if they had wanted to the delay would have let them cut the scum off before they were heard

  21. Theotherhalf:

Had similar experience with a mate up from England in last few days- he knows nothing about football. He is no mug when it comes to money matters. I told him about the hun tax case & their debts. He said they were obviously doomed. Not necessarily, I said. He looked bewildered. I explained to him about the corrupt historical landscape of Scottish football & the traditional links between the cheatining huns & the establishment. He still looked bewildered…what about justice? Justice? He repeated a number of times.

  22. The idea that a newco demoted to division 3 is the lesser of two evils (the other being allowed to remain in the SPL with incredibly tough ‘sanctions’) is not even close to being true.

    Think of it this way.

Almost 45 years ago we won the European Cup, the same year something else happened, i.e Rangers lost to Berwick Rangers. That match is still trotted out year-in, year-out as a way of retaining interest in the early rounds of the Scottish Cup.

Rangers by dint of their own superiority complex will need to win every game for the next three seasons or their fans will turn on them. Can anyone imagine what their reaction being if they’re at Ibrox, drawing with Alloa or Albion Rovers or even Dundee, at half-time never mind full-time?

Three years of torture for their fans. Nothing to gain from playing against Stenhousemuir and Stranraer and everything to lose. Four chances for each of these wee teams have of taking points against Rangers, four cup finals for them whereas for Rangers, it’ll be just drudgery.

Wednesday evening fixtures at Brechin or East Fife. The prospect of a draw, let alone a loss ever present.

Therefore, Rangers will have to burn a hole in their pocket so as not to face the prospect of a mass exodus from the support. Three years in easy street making big profits will not be an option for if they lose even 1 games in a season, their fans will expect nothing less than 36 wins out of 36 games, otherwise they’ll be demanding the manager be fired.

    Just as our fans would.

Everything to lose and nothing to gain, and that is even before they’d be promoted 3 seasons later into the SPL. The Scottish Cup and the chance to play a team in the SPL would almost be seen as light relief in this context.

I hope they crash and burn.. I hope Scotland if they support them does the same…

  24. A 3 year Euro hiatus does seem too lenient on clubs deliberately avoiding tax & payment of debts. IMO.

Although it wasn’t a very good game last night, once again Kris Commons stood out for me. He is a very clever player with a sublime touch at times and a thunderbolt of a shot. When he drifted out of the picture earlier on in the season I thought he’d be off sooner than later. I would dearly love to see him regain his fitness and his appetite. He could be a major player for us next season. Come what may!
