Then there were two: Rod Petrie steps forward

Hibernian chairman, Rob Petrie, yesterday told BBC Radio Scotland “Integrity is beyond purchase”.  It’s incredible to think that we live in times where this is actually news.

It’s hard to imagine how anyone would go about arguing with Rod on this matter.  Kilmarnock chairman, Michael Johnston’s recent comment, “The [SPL] clubs are mindful of a sporting integrity aspect but the commercial benefits may outweigh that” offers the alternative view, but the logical conclusion of Petrie’s argument is stark.  If integrity of top clubs can be purchased, what about officials, referees and players with bookmaker friends?

We can assume Hibernian will join Celtic in voting against admitting a Newco directly into the SPL, should such a vote occur.  Five clubs in total are required to block such a proposal.  With Petrie declared against, would Romanov at Hearts vote for Newco?  His previous public pronouncements suggest he would relish the opportunity to take on one of the big Glasgow clubs.

Dundee United and Aberdeen are two other clubs under significant supporter pressure.  Both teams are also keen to change the 11-1 voting rule, which would be possible without a Newco.

Rangers, Kilmarnock, St Johnstone (through manager Steve Lomas) have all declared in favour of admitting a Newco, I expect Motherwell and St Mirren will do the same.  Ross County and Inverness may fancy adding Dundee into next season’s relegation fight instead of Newco but there has been no indication how either club would vote.

The 7th May vote was the best chance of getting Newco provisions voted through.  The more time clubs have to consider the decision the more susceptible they will be to supporter lobby.

I am of the view that SPL chief, Neil Doncaster, will not allow himself to become aware if Rangers have a prima facie case to answer as a result of the SPL inquiry into contractual arrangements until after a vote is taken.  Deadline for clubs to respond to the inquiry passed over five weeks ago. A simple check of submissions against SPL records is all that is required. Even if each clubs issued an all-clear, the inquiry should have reported.

Doncaster perhaps has no idea of the flood that will come his way soon and wash away all of these questions. His opportunity to act before events overtake him is limited.

  4. I saw Danny scoring a couple of times. Once aginst Queen of the South (may have been Paul McStay’s debut) a less than spectacular effort still the look on Danny and Charlie Nicholas’ faces was priceless when the ball trickled over the line.

     

     

    Safe to say Daniel had a scoring record comparable with another Celtic legend – Neil Lennon, no less!

    Is it just the clubs that vote?

     

    Why does one need a vote? Isn’t it against the rules?

     

    Doesn’t Celtic participating in the Vote even for a “No” legitimize the vote?

     

    Why are the huns allowed to vote? Isn’t that a conflict of interest.

     

    So say it comes down to it.

  7. I went to St Columbas in Maryhill around 1969, was shipped of to Nazareth House in Aberdeen think around 1973.

     

     

    Supporting Celtic in those days was very hard, cant begin to describe the abuse I used to get.

    Danny McGrain was the best fullback we ever had, genuinely world class.

     

    He is also one of the nicest down to earth people on the planet.

     

    I still think how lucky we were to keep such a great player.

     

     

    I see the Rams Head in Maryhill getting a mention. There used to be nothing better than walking out of there after beating the Huns and seeing the mutants hanging about outside the First and Last.

  12. Thanks 67 :-) My road was always full of rangers supporters buses when they were at home. I do remember going into Ibrox for the last 20 mins of their last home game of the 67/68 season. It was just like the Tommy Burns season 1995/6 where we were thrashing teams but they were scraping 1-0s. If they beat Aberdeen in this game then they’d probably win the league (and no 9 in a row) but they drew 2-2. My mates and I learned the knack of smug triumphalism masquerading as objective criticism of the deficiencies of the Huns. It was a relief to make it home and then roll about the floor laughing.

    Met Willie Young the ref at the same event he was very good to talk to. He said he insisted that linesmen did make any class other than offside that he and he alone would make an other decisions including throw-ins.

    Danny McGrain wasn´t there!!

     

     

    He was a colossus for Scotland and even though he was played out of position to give Jardine a game he was always brilliant. I don´t think I´ve ever seen such a focussed player and such a force in a Scotland jersey, quite the opposite of King Kenny, although to paraphrase Mark Twain, reports of Dalglish underperforming for Scotland were greatly exaggerated.

     

     

    With Bobby Lennox, Danny led the Celtic team in the post nine in a row years and helped usher in the new crop of Celtic youngsters like Tommy Burns, Roy Aitken and George McCluskey. His enthusiasm was infectious and as he ran his heart out every week his example was followed to the man and we saw a Celtic team that never gave up. He was always a big presence on the field of play. Great to see he is still so involved at the club.

    Medication does wonders if you ‘fit in’ to the generic diagnosis which circa 80% of diagnosis correctly falls into. The problem is the remaining 20% is ‘fumbling in the dark’ from a diagnostic and prescriptive medication perspective, that’s when people suffer as processes and more ‘out of the box’ prescriptive medication are not considered.

     

     

    Remedy is broader understanding/flexible solution of the 20% from a medicational cure perspective.

    Interesting: that argument had not occurred to me. I haven’t time to analyse the situation in detail tonight but after a quick look at the Articles and Rules of the SPL, while I understand why you say the above I don’t think it’s entirely clear that is the position.

     

     

    Consider this:

     

     

    In the ‘Interpretations’ section of the Articles, which sets out the defined terms used in both the Articles and Rules, ‘Club’ is defined as follows:

     

     

    Club means the undertaking of an association football club which is, for the time being, entitled, in accordance with the Rules, to participate in the League

     

     

    ‘Member is defined as follows:

     

     

    Member means a person who or which is the holder of a Share

     

     

    So far so clear.

     

     

    Rule A 2.1 says:

     

     

    The League shall consist of 12 leading association football clubs in Scotland.

     

     

    So we are already contemplating a situation in which you can be a Member without being part of the league. Much less clear; in fact an entirely unsatisfactory situation. How do the Rules resolve it?

     

     

    Rule A4 says:

     

     

    Membership of the Company

     

    ….

     

    The owner and operator of a Club ceasing to be entitled to play in the League shall cease to be a member of the Company and shall relinquish its Ordinary Share at the end of the relevant Season in accordance with the Articles of Association.

     

     

    What can we make of this? If RFC plc sells the Club to a NewCo (apologies to those who don’t like the term but it’s essential here to distinguish between the club and its owner), RFC plc “shall cease to be a member of the Company”, and shall also “relinquish its Ordinary Share”. But when do these things happen?

     

     

    As we learned above, being a Member depends on holding a share in the Company (being The SPL Ltd). So when does RFC plc relinquish its share? Apparently, “at the end of the relevant Season”. Predictably, the Articles are silent on the meaning of ‘relevant Season’, but when a Member sells its Club during the close season, one could certainly argue that the previous season is the ‘relevant’ one. In other words, RFC plc would be deemed to be a Member with immediate effect.

     

     

    It would be infinitely better if clause A4 had a ‘do not pass Go’ provision: the addition of “with immediate effect” after “member of the Company” would have done the job. I think its at least possible that a court would be willing to construe that phrase rather than legitimise the nonsense of a ex-football club becoming a key participant in a vote the SPL’s future.

     

     

    Article 6 is also relevant:

     

     

    A Share may only be issued, allotted, transferred to or held by a person who is the owner and operator of a Club and if a Member shall cease to be the owner and operator of a Club then such Member shall cease to be entitled to hold a Share.

     

     

    Is a Member which is not entitled to hold a Share under Article 6 entitled to attend and vote at a General Meeting of the League? I think that is a rather shaky proposition. The phrase “Members entitled to attend and vote” is used elsewhere in the Articles (implying that a Member might not so entitled).

     

     

    Finally, Article 15 is also highly suggestive, as it states that where a Member ceases to be entitled to participate in the League, and the Board requests it to transfer its share, it shall have “no rights in relation to that Share” from the date of the request. Unfortunately this clause is restricted to relegated clubs but as the Articles are silent on the situation of a Member which has lost its entitlement to participate by other reason, the argument could be advanced that RFC plc should be treated likewise.

     

     

    None of this is conclusive; in the face of such incompetence in the drafting of the Articles and Rules, certainty is hard to find on all but the simplest of matters. Still, I believe there is enough here for a minority of clubs voting against the transfer of the RFC share to a NewCo to launch a robust legal challenge to that transfer, if the support of RFC was essential to the vote being carried.

     

     

    Were that situation to arise, it is hard to believe that such a challenge would not be made; whether it would succeed must for now remain an open question.

This is the house we are staying in at the minute!!!!! I was away with wee oscar feeding the ducks in Regents Park at the time!! Doh!
