Ticketus secure their £40m of tickets

None of you will be surprised at today’s opinion from the Court of Session in Edinburgh that Rangers’ deal with Ticketus cannot be set aside, despite some absolutely pitiful reporting to the contrary.  It’s fine to get things wrong every now and then, we all get Duff information on occasion, but please….

It’s worth recording, Ticketus may only have paid £20m + vat but the tickets they own are worth in the region of £40m. High risk investments require a high return.

Rangers’ administrators argued that the deal inhibited their ability to rescue the company but the heroic Blue Knights submitted a bid accommodating Ticketus, undermining the administrators’ argument. If only the Blue Knights were in a position to strike a deal with Craig Whyte they could be regarded as helping the situation instead of being hapless fools.

Next up is HMRC, who have not capitulated and agreed to accept a few pennies in the pound.  They have not agreed to accept anything less than all monies owed.  Soon after that we will hear that no court has been able to set aside Craig Whyte’s security over Ibrox.  The most underappreciated man no longer in Scotland remains the only person with a reasonable chance of phoenix-ing Rangers.

The first 26,000 (approx.) tickets sold to each Rangers game for the next three years are owned by Ticketus.  In the event a phoenix occurs, Rangers will have to revert back to budgets from their glory days of the 1950s – we will soon be told this is a great omen.

If you are going to Ibrox on Sunday, take care and enjoy your visit.  Take photographs of the occasion and send them in, we’ll perhaps use them on a future edition of CQN Magazine.  It may prove to be the end of an era.

    Re Ibrox, whats the one thing we know as a given fact before a balls kicked?

     

     

    The huns will have the veins pumping out of their heads as they run out onto the pitch, ‘prepared for war’ as one gable wall in Belfast still reads.

     

     

    As much as it pains to say it, believe it and think it, we HAVE to pick the team with that in the forefront of our minds.

    I fear Lennon will do just that but go with Samaras up front clinging on that increasingly distant memory of January 2011. My feelings toward Samaras have much subsided since he came out and admitted he didnt think he was much good up front and then went on to explain why he liked playing on the left.

     

     

    I appreciate that honesty and it was refreshing to hear, because he wasnt running out on that pitch, not scoring or doing much else and sauntering off thinking ‘im great’ like our very own, beloved Gary Caldwell would.

     

     

    I happen to agree with him, that he is a bit of a weapon on the left.

     

     

    Who though, should we pick out of;

     

     

    Brozek – Unknown quantity. Awfully big risk to put someone like that and someone the players dont know in an unfamilar territory could elimate any cohesion from our play. On the other hand whilst the hun management might know a bit about him having scouted him, the hun players wont. Do they sit off, close him down, show him left or show him right? That uncertainty could just be crucial.

     

     

    Stokes – Does he have the positional discipline or knowhow to lead the line by himself? He had the opportunity to show his manager why he has been wrong for 2 years in leaving him out of most big games last week and flopped big time, although he harried marginally more than Hooper.

     

     

    Hoops – I think we are all agreed he needs a spell on the sidelines. He looks jaded and out of ideas. The last time he looked so lethargic a spell on the sidelines made his season – should we bench him now and then ask the question about why it happens at a later time? Should we ask him to give us whatever is left in the tank for 90 more minutes in the knowledge the lad is damned clinical in games he has the right level of motivation and focus for? (chose to word it that way deliberately).

    Others may have commented already, but the tenor of your article does not reflect the decision released today at the Court of Session.

     

     

    The judgement is not an easy read and fairly involved in places but I’d summarise my view of it as follows:-

     

     

    1. The Court has refused to give a direction in relation to the ability of the Administrators to tear up, specifically, the Ticketus contract (due principally to the Court not having sufficient detail on the commercials involved (i.e. detail of the bidders offers) to justify this).

     

     

    2. The Court has provided general guidance on the approach of the Court if the Administrator chose to deny a contract and the matter was subsequently challenged at the Court by a concerned creditor (e.g. Ticketus). In very simple terms, the Court has said it would not easily rule against the Administrator’s actions.

     

     

    3. The Court has opined that Ticketus’ arrangements are personal to The Rangers Football Club plc. In other words, those arrangements would not be binding on any newco that played football from Ibrox.

     

     

    4. The Court has not involved itself with the contention by the Administrators that the Ticketus’ arrangements fall foul of company law (specifically those directed at financial assistance for public limited companies) and could be annulled.

     

     

    5. It appears Ticketus have sought to rely on principles of English law (on the basis their agreements with The Rangers Football Club plc are stated to be English law) being applied on matters concerning assets based in Scotland. The Court has not supported that view (this is what the ‘trust’ arrangements discussed in detail in the judgement are all about).

     

     

    6. If a creditors contract was torn up, the creditor would have a claim for breach of contract. That claim would be against the company in administration and for damages. If Ticketus, as appears the case, is an unsecured creditor – what is the difference. They will be either an (a) an unsecured creditor for their entitlement to monies under their contract or (b) an unsecured creditor for their entitlement to damages under their contract. Unless their contract is annulled (see comment 4 above), they still are heavily involved in any CVA arrangement.

     

     

    Where does this leave things? I expect it is but one judgement in what will become a long list of judgements as matters take their course.

     

     

    Ticketus will have deep pockets and will likely challenge any attempt to leave them without their financial return to the highest courts. All of this will cost a lot of money and take a lot of time. It’s a mess, with no sign of clarity coming any time soon.

    the markets the place I’ll probably go after the game, It’s prob my local, it’s there or the horseshoe, anywhere else Is a no go. the Markets not as good as It used to be though and as I said in my last post, It’s where the huns will come hunting, I’ll watch it at one of my pals house first then go In, we’re all tims and you can sing and shout what you want, not a pub In Ayr that you can do that, the towns crying out for a pub or social club.
