World class deficit of self-awareness

The word of the day is anosognosia, def. a deficit of self-awareness.

While discussing his Fit and Proper examination by the SFA, Dave King told the media that “If the level of detail that was applied to me was applied to Craig Whyte then he would never have taken over the club.  The club would have had a chance.”

It was Dave King’s job to examine Craig Whyte’s Fit and Proper status, not the SFAs!!!  Dave King was on the board which approved Whyte’s takeover.  The SFA were not and should not have been involved in determining the suitability of Whyte’s appointment, which was the exclusive responsibility of the Rangers board.

The SFA subsequently sanctioned the club for failing to carry out its duty in this respect.

Let’s look at that quote again and allocate responsibility:

“If the level of detail that was applied to me was applied to Craig Whyte [by me, when it was my job to do so]then he would never have taken over the club.  The club would have had a chance.”

There is no Fit and Proper test.  Criteria are published to allow clubs to determine the suitability of appointments.  Whyte did not meet the suitability required.  If anyone on the Rangers board had taken the trouble to check Whyte’s credentials (which they had a fiduciary and SFA obligation to do so), and informed the SFA of their findings, Craig Whyte would have been stopped in his tracks.

A note to my friends in the media:

Guys, ignoring stuff like this is why people said you were compliant with Whyte, Green and Murray.  Don’t come back a year from now and say you didn’t know.

Dave King is a gift.  You know what he’s going to do, you know how this ends.

Walk for Tony

As most of you will know, RWE lost his son, Tony Conway, earlier this year to MND.  12 of Tony’s friends are walking 100km tomorrow and Sunday, from London to Brighton.  If any CQN’ers are local, they’re looking for moral support more than money, so here’s the route they’re taking.  They start on Twickenham Road at 9:40 tomorrow morning, hoping to reach Brighton around 7:00 on Sunday.

Tony appears to have inspired a lot of people, which is a none too shabby legacy.

    When Neil was getting the darkside thrown at him…Celtic FC should have threatened to quit the game….to call footballs bluff and….at the same time…kicked the lid off the can of worms that is SCOTLAND…the country that time forgot….who knows where we might be today?….I think we would have been out of here already…nobody at the top of the club is from an uppitty-Tim background so…back of the bus for the whole clum I’m afraid…until the Celtic fans realise the power that they could wield.

    apropos of nothing and merely an option:

     

     

    D King (family trust vehicle) LENDS sevco £20m (possibly in several tranches). One of the repayment conditions is that repayments are made through a third party (say DK UK 5088 ltd) and that sevcos repayment liability is discharged when funds move to 5088.

     

     

    5088 have 100 years in which to return funds to the family trust but are still liable for the debt (interest to be decided).

     

     

    In the meantime DK UK 5088 has £20m to play with outside of his home port of S Afrique.

     

     

    What’s that? You need another £10m? Coming shortly….

     

     

    You may find similar approaches have been adopted in the past by a Mr King which he didn’t get quite right and which cost him £41m to SARS. Has he got it right this time?

    When Celtic were pressured to act on the police abuse of fans in the Gallowgate they made a statement offering support to any fans that required it. I contacted them. The full support consisted of an offer from Celtic to pass my details onto the police. When I replied to say I had already did that by making a complaint against the police and was asking for support, Our Heart’s supporting Head of security Ronnie Hawthorn’s reply was not too similar to our great thinker TD67.

    i agree.great lad.thinks about the game a lot,comfortable taking a ball under pressure,scored 2 in quarter final,4 in semi(then got benched Mr Frail!),1 last night and made 2 others.he was on loan at East Stirling,regular games has improved him.been with us for a long time.hopefully next season we will see more of him,The young lad Nesbitt looks a good yin too.

    Anosognosia? Bit harsh, seriously a Brain malfunction? Mythomania perhaps I thought but Then I thought it does explain a lot, (that infamous R30,000 per annum tax return furinstance). See I had a perusal of Dave King’s activities a few years back and found a South African Judge had labeled him a GSL and that he was fighting a war of attrition with SARs and the NPA (South African National Prosecution Service).

     

     

    This latest bout of the Kingmania had me wondering how it had all panned out, as you know Mr King seems to be promising a heck of a lot these days, maybe things worked out okay for DK.

     

     

    So I went and did a re-perusal. Now I didn’t go into any great fishing expedition, mainly because of the lack the time and expertise to do so, and as we are talking about DCK’s actions and finances we are talking about a riddle, wrapped in a mystery, inside an enigma. Still it was an interesting re-cap and brought things up to date for me.

     

     

    To re-cap……

     

     

    It all really started in late 1990s when DCK made a tidy sum by selling his shares in a specialist vehicle he had very cleverly set up (no really, it was from what I can gather a very smart piece of business) it was called Specialised Outsourcing, DCK sold his shareholding and made somewhere north of £50M. Thing is the company went pop a short time afterwards and it would leave a couple of outstanding issues that would come back to haunt DCK… Should he have paid tax on the money (was it revenue or capital) and were the other stakeholders in the business “shafted”?

     

     

    ”Angry institutional shareholders [of Specialised Outsourcing] racked up massive losses while revenue authorities tried to reconcile King’s apparent enjoyment of a wine farm, a Ferrari and a private jet with his modest reported income.

     

     

    So SARs got the investigation ball rolling….

     

     

    Up to then DCK thought he had been quite clever, he had various activities to “spread” the cash – he invested some money in Scotland, (in amongst other enterprises the famous Glasgow Rangers) had Off-shore Trusts, Jets, Cars, property, businesses etc, etc, etc.

     

     

    As the investigation hots up and DCK becomes aware and he realizes he could have been a wee bit smarter, his strategy needed a re-think. So why not…“present a blind alley to any revenue investigation”.

    Now here’s the thing, SARs start seizing and freezing DCK’s assets in South Africa and abroad. His palatial houses and businesses in SA, his private jet in France, his offshore trusts Millions upon Millions of assets.

     

     

    DCK was in full defense mode now, the saga took over a decade but DCK was basically fighting on three fronts

     

     

    SARs – His Tax Evasion – Wee tax case

     

     

    NPA – Fraud and Racketeering

     

     

    SARs- Was his Specialist Outsourcing “windfall” Revenue or Capital – Big Tax Case

     

     

    So how did it turn out and is DCK a fit and proper person to run a Scottish Football Club and can he invest the £30M he initially promised or even the £16M he promised at the time of RIFC PLC’s general meeting.

    It ended up…

     

     

    Wee tax case – He was found guilty of Tax evasion and a few other things amounting to 80+ years in gaol.

     

     

    The NPA case collapsed due to lack of evidence/witnesses

     

     

    The big Tax case looked to becoming a landmark decision going all the way to the High Court, (Many well heeled Sud Afrikans did not want DCK to loose that.)

     

     

    So a plea bargain was agreed, the money and assets seized and frozen in the Big Tax Case, DCK agreed to surrender, both sides dropped that case, DCK also paid just short of £1M pounds in cash to SARs. So the gaol term could be commuted.

     

     

    Now here’s the thing, there is a myth that DCK was done for tax avoidance and he “wrote out a cheque” for £42M to satisfy the debt – job done.

     

     

    Not so, the money he parted with to keep himself out of gaol was 1M pound-ish the rest of the reported £42M, had been assets seized and frozen by SARs.

     

     

    As for willingly handing these assets over, well the wine farm is a good case in point.

    DCK, got rid of all employees, cut-off all power to ensure all products and production failed and literally liquidated the business, this “sabotage” and his belligerent and non-compliant approach, was to ensure SARs wouldn’t easily realise any assets.

     

     

    Now if you read the SMSM you would be forgiven if you thought that that David King ponied up £40 odd Million to pay for his back-taxes and all was okay.

     

     

    How solvent did that leave DCK…

     

     

    Well I believe DCK managed to keep some of his homes and some of his unaffected businesses are going concerns and as things stand DCK is a licit Businessman.

     

     

    He is chairmen of MicroMega, a company that offers service provisions for many SA local authorities and it is currently expanding. How much of shareholding DCK has I don’t know but the Company turnover something in the region of £40Million and has pre-tax profits of around £4Million.

     

     

    That makes DCK the Chairmen of a successful business, probably a multi-millionaire, however it doesn’t put him in the Mike Ashley League and it certainly doesn’t explain where the £16Million he promised the new Rangers in December is coming from.

     

     

    What about his promise to challenge Celtic? Well the £30M per annum over the next three seasons he would need to even start thinking the New regime at Rangers could compete with Celtic would seem to be a pipedream. Unless DCK can conjure up some significant funds from who knows where?

     

     

    I suspect there is significant funds it won’t be from DCK, I get the feeling even if he did produce such funds, there would be considerable interest among some SARs folk.

     

     

    So is it Anosognosia or Mythomania or just plain aul snake oil… We’ll see, but I would go with your advice to the SMSM and your (always unerring) prediction.
