Blame King and Murray board for approving Whyte, not SFA

There’s an industry of deliberate misunderstanding in Scottish football (and on the pages of CQN).  One of the last vestiges of this is the SFA’s fabled Fit and Proper Test.  There is no test, never has been a test and in all likelihood, never will be a test.  It was almost certainly a figment of some under-informed journalist, who provided the concept enough currency for it to endure in the imagination, despite many, many, people explaining reality.

To be a director of a football club you need to be Fit and Proper, you do not sit or pass a test.

It’s a bit like:

To do a job you need to speak English, you do not sit or pass an English language test.

If you accept the above job assuring your employer you can speak English, and you can’t, you are likely to be fired.

If you accept a job as a director of a football club, assuring the SFA you are Fit and Proper, and you aren’t, the SFA will ban you from football and discipline the club for failing to ensure a director was Fit and Proper before appointment.

This morning the incessant campaign continues to throw reputational damage on anyone who would be inclined to point out that Dave King contravenes the eligibility rules on becoming a football club director.  This is different from being Fit and Proper, which is a subjective assessment, Mr King is simply ineligible.

The reasons for his ineligibility (he was a director of a football club which was liquidated within the last 5 years), and other matters, most notably, his 41 convictions for breaking the tax law in South Africa, and the blame laid at his door by the SPL’s Lord Nimmo-Smith report, make up material reason why the SFA may consider him not Fit and Proper to run a football club.

After targeting Peter Lawwell yesterday, the campaign today turns direct to the SFA, who are accused of allowing Craig Whyte to “bluff his way through the Hampden [non-existent] ‘test’ by simply filling out an official SFA form”.

As should be patently obvious to anyone with a dozen or more brain cells, the SFA form is neither a ‘test’ nor a certification of appropriateness from the SFA.

The obligation to ensure a football club appoints Fit and Proper directors lies with that club’s board.  If the board fail in their duty to the game, the club is liable to sanction from the SFA.

So who was on the board which appointed Craig Whyte as a director of Rangers?

Our emerging heroes, the men who chased away the billionaire, Dave King and Paul Murray.  As non-executive directors of Rangers they had a responsibility to the club’s stakeholders that their interests were being protected.

The Institute of Directors factsheet on the role of non-execs quotes the Cadbury Report, saying they “should bring an independent judgement to bear on issues of strategy, performance and resources including key appointments and standards of conduct.”

It was the Rangers board’s responsibility to instruct the necessary checks on Craig Whyte’s appropriateness to be a director of the club.  They either failed to do this, or if they did, failed to act on the information, or withdraw their names from the club’s register of directors.

Sir David Murray may have controlled the majority of shares, but as recent boardroom events at newco demonstrate, there is a great deal non-execs, when in a majority on the board, can do to inhibit major shareholders if they believe the interests of other stakeholders are being jeopardised.

Non-execs are not there to wear the blazer and attend supporters’ events, they are the eyes and ears of the supporters, shareholders, employees and creditors who are not privy to the inner workings of the club.  In this respect, Mr King and Mr P. Murray failed Rangers on a cataclysmic level.

They are, in every respect possible, perfect for the job of running newco.  My prediction (no inside info) is the SFA will fold under sustained media pressure, set aside their ineligibility rules and allow Mr King and Mr P. Murray to work their magic one more time.

    Dave Kings SFA sponsored procession was never in question. Paul Murray acting as director presently is all that we need to know here. The rest is just Old Firm sponsored smokescreen.

     

     

    It is all about perception. Lawwell did not want it but would not stand in their way. Arguing that directing by proxy was just as effective. As CQN has intimated a few times in the last few weeks. The SFA need to convey that they are in the huns camp to keep them onside, that means the three bears over Ashley.

     

     

    That does consolidate the conjecture that Res, 12 publication has nothing to do with cleaning up the SFA and is designed to boost ST sales on the back of our kids being dumped for the bigots pound.

    Reagan and Doncaster will be gone by the end of next season if Sevco are promoted job done. Reagan and Doncaster have enjoyed superbulous wage rises since coming into office. One can assume they are performance related.

     

     

    Reagan has been manipulating the news management Agenda by talking about Dave Kings SA mishaps which is clearly being done to buy time as King and the present director Murray are ineligible based on two of his own organisations statutes.

    Public company makes huge loss on land bought from ex-Rangers chairman

    A quango has made a multi-million pound loss on contaminated land it bought from a company led by former Rangers owner Sir David Murray.

     

     

    Clyde Gateway paid £4.5 million to the businessman’s property company for 16 acres of derelict land in Dalmarnock in the east end of Glasgow five years ago.

     

     

    However, it was later revealed that Murray Estates had paid just £375,000 for the plot in 2005 and the purchase was followed by the economic downturn, which decimated property values.

     

     

    Now, the public body set up to capitalise on last year’s Commonwealth Games has admitted it has sold the site for £4,822,480 plus VAT, after spending £3 million making it suitable for use.

     

     

    Six further acres were included in the pot, amounting to a further value of £1,690,000.

     

     

    With the Clyde Gateway spend on the land totalling £9,239,000, the loss on yesterday’s deal amounts to £4,416,600 when VAT is stripped out.

     

     

    Glasgow Cathcart MSP James Dornan said the disposal underlines the “poor value for money” taxpayers received due to the original price paid for the land.

     

     

    He said: “I welcome the building of new homes on this prominent site.

     

     

    “But the figures show how we, as taxpayers, got a bad deal when Clyde Gateway purchased the land in the first place.

     

     

    “Clearly, we all got poor value for money when Sir David’s firm was handed £4.5 million for it.”

     

     

    Clyde Gateway purchased the former Dalmarnock Power Station, which contaminated the surrounding land with chemicals between 1915 and its closure in 1977.

     

     

    Pollutants included Japanese Knotweed, which is known to damage property and the site was also used by fly-tippers.

     

     

    The land lay outwith Clyde Gateway’s operating plan but the public body said it pressed on with the purchase, mainly because it was an eyesore.

     

     

    Records stated Sir David’s Murray Estates had paid just £375,000 for the land in 2005.

     

     

    In justification, the public body said it had asked the property firm Ryden to carry out an independent valuation, which had produced a figure of £7,330,000.

     

     

    Clyde Gateway yesterday revealed it had sold the riverside site plus six further acres to social landlord Link Group, which is planning to build 550 homes, including social housing, for £4,822,400.

     

     

    The money has been provided by Glasgow City Council through the Scottish Government’s housing supply programme.

     

     

    Clyde Gateway refused to say if the land was independently valued again and, if it was, what was believed to be the current value of the site.

     

     

    Its chairman, Lord Smith of Kelvin, who chaired the Commonwealth Games organising committee, said:”The deal epitomises what Clyde Gateway is all about.

     

     

    “We have stepped in to deal with market failure and, having initially purchased the site and followed it up with a spend of £3 million on decontamination and infrastructure improvements beneath the surface, we have found a very able and willing development partner who will deliver the type and quality of housing that the community here requires.”

     

     

    Clyde Gateway was asked what Lord Smith meant by “we have stepped in to deal with market failure” but declined to explain.

     

     

    Murray Estates also declined to comment.

     

     

    A spokesman for Glasgow City Council said it provided £5.8million from its Affordable Housing Supply Programme (AHSP) budget via the Scottish Government to “fund the acquisition of the site by Link Group and the creation of what will be a high-quality, mixed-tenure development in Dalmarnock.

    If you vote for Kris’ goal in the league cup semi-final for goal of the season, do you have to say it was scored against Rangers, as per the official Celtic FC website?

     

     

    Didn’t they make the excuse before that they called them Rangers in promotional material for the game as they had no choice, as it was an SPFL competition?

     

     

    So, when it’s the Club’s own POTY awards, and they do have a choice, they refer to them as, er , Rangers!

  27. The way I see it the club should at every opportunity be calling them The Rangers, as thisis their name after all.

     

     

    No need to use any other names or name calling. As many other clubs and people have found this seems to wind them and the smsm up more than anything but it is there name after all so what’s the harm?

     

     

    You never know if our board were strong enough to stand up to them and their lapdogs we might find all other s would follow suit. :)
