Celtic box clever again, and the SFA know it.  Aleks Tonev, who has a strong east-European accent and limited English, denies uttering racist comments against Aberdeen.  Did he?  He might well have, for all I know, but, with only one person contradicting Tonev, the SFA have no idea either.

When this issue first raised its head I don’t think anyone on CQN made a character reference for Aleks, but we concluded this issue was destined to remain unresolved, as there is simply not enough information to consider the matter.  The SFA know this and know that the Court of Arbitration for Sport will find in favour of the player if they persist in trying to ban him for 7 games without collaboration.

Don’t let Barry Hearn fool you, it’s the SFA which is unfit for purpose, not the professional clubs or the SPFL.

It was great to see our very own Mouldy67 on the big screens on Wednesday for his Cycling Santa Appeal.  He left London yesterday morning before resting up for the night in Birmingham.  All going to plan, he’ll reach Glasgow on Monday.

Mouldy (Paul) is running to raise funds and awareness for Neuroblastoma Childrens’ Cancer Alliance in memory of Wee Oscar.  It’s an incredible undertaking and a living example of the Celtic spirit brought to life.

I don’t get the notion, apparently widely held and reported by The Scotsman today, that Rangers (sic) cannot afford to sack Alloa McCoist (© Jobo).  He’s on a contract which the club can continue to pay, while promoting Gordon Durie to first-team duties for little or no extra cash.  They may even have a case to curtail their outlays to him.  I can’t see how sacking him costs money in the short term, and let’s face it, that’s all this lot need to worry about.

Knowing where the bodies are buried

Super Alloa has seen the current directors, and all previous regimes right back to Murray, operating up close and personal.  He knows which cupboards have skeletons lurking, while all of them will be aware of his contract negotiations, and what he has, or has not, been prepared to do for the club.  It’s a classic co-dependency situation.  You don’t sack the guy who knows what you don’t want revealed.

There is also the small matter of management priorities.  Would the captain of the Titanic have sacked the chef for a lousy meal after they’d hit an iceberg?

If you’ve not been involved with the Celtic Foundation before there’s a great opportunity coming up next week.  They’re looking for bucketeers ahead of the St Mirren game on Sunday, 14 December, to help raise money for the Christmas Appeal.

One of the beneficiaries of the Christmas Appeal is Glasgow City Mission, who provide emergency accommodation for the homeless, a dedicated Foodbank and an evening drop-in service that feeds those who are impoverished and in need of a proper meal, for, on average, 130 men and women each evening.

Graham Steven of the Mission said, “We are extremely grateful to Celtic FC Foundation and Celtic supporters for their continued generosity.

“Their much-needed financial contributions make the work of Glasgow City Mission possible. In particular, by funding our Older Men’s lunch club, you are providing a safe space for people to come and enjoy lunch and social companionship.

“Loneliness and isolation are significant factors in many of our clients’ lives – you are helping to turn that around, improving lives and strengthening communities – thank you!”

So next week, you can turn up to Celtic Park a wee bit earlier, get to meet hundreds of cheery Celtic fans, get a ticket to the game, and help to feed, shelter and provide companionship for the city’s homeless.

    just scrolling back … and dont have time to get into a long discussion today…. but, have been involved in this issue in the past, I know for a fact that there is a considerable body of evidence that shows that lower alcohol rates translates into fewer and less serious accidents….. I dont dispute that there is sometimes a political reason behind the legislation, but that doesn’t change the fact that lower alcohol levels do seem to save lives (and a lot of money for society).

    My point about refusal was in relation to a totally random stop. They do happen – the only time I’ve ever been breathalysed was when the police were stopping every fourth car going along Queen Margaret Drive while I lived up that way. Now there was no way that every one was driving erratically or committing any sort of offence, or that the officers could have had any reasonable suspicion that the drivers involved had been drinking.

     

     

    But, as I understand it, refusing a test would still have been an offence. The fact that it was not a lawful request isn’t a legal defence.

     

     

    Next book will be out in 2015 – not sure of the exact date as yet. It’s with my editor right now.

    There’s probably a gag in there that I don’t get, but if it was genuine, then the request was unlawful. But you cannot argue at the time. They would later simply invent another justification for the request that would stand up to scrutiny.

    The fact that in most jurisdictions you don’t lose your licence for being between 50 and 80 mg.

  11. Football tomorrow, and I will be attending my first away game of the season! Changed days indeed, Just love getting it up the local “family club” ,doesn’t always happen but feeling that we can win well tomorrow.

     

    I do not doubt that Strathclyde,s finest will be torn tomorrow between watching out for guys who have overdone the intake of steak and ale pies and the massed ranks of Fenian seat smashers.

  12. Re the drink limits, as far as I know in Ireland the limit was also dropped from 80 to 50 but they allowed a buffer zone between these limits. If you are over 80 you face an automatic 2 year disqualification from driving. ( Normally on first offence you can appeal after a year and you can get your license back). If you are in the buffer zone over 50 and under 80 and its a first offence you can pay a fine of 200 euro fine plus getting 3 penalty points on your license but you avoid a driving ban. There is an ultra low limit of 20 on all learner drives and those who don’t hold a full license. Not sure if its similar in Scotland but it seems to be working ok here.

    Very true, I am a keen advocate of punishment fitting the crime. However any DD conviction whilst not always be worthy of a years ban ( same applies to any 12 point tottting up case). Most employers will not tolerate it due to insurance concerns.

    I agree about laws being enforced, esp the drink driving law here, but I have yet to find a bar where they allow smoking.

    You’ll know better than me mate – I was generalising about how laws are enforced. Been a while since I’ve been to Spain but certainly was in France in the summer and there were people smoking in bars. However, I think you make the point anyway – enforcement varies between Euro countries.

  16. My understanding is that mass traffic stops – or fishing trips – are unlawful. If a driver can prove that the police acted unlawfully in making the request, then any refusal is not an offence. A refusal to comply with an unlawful request is the essence of it. My response to WWW above deals with that a wee bit. The onus does fall on the driver to prove the request is unlawful, and the police are masters at retrospectively providing adequate justification if they are challenged. Frankly, a police stop exercise that randomly requires every driver or every fourth driver to provide a breath specimen is a great start. They are in essence random breath tests which are unlawful. Random stops are not illegal though, but the police must have the grounds to ask for a breath test. I agree that random stops do happen.

     

     

    Bit of the Tonev about this – it will often be one person’s word against another – you versus the cop. But since the standard of proof in this is beyond reasonable doubt, it is fascinating how Sheriffs almost always feels obliged to believe the cop to meet that standard. You would deep pockets and 8 years to spare to chase this all the way through the appeal courts.

    Zero tolerance on any alcohol levels while in control of lethal weapons.

     

    bloody oxygen thieves, no allowed to smoke in yer bloody cars but you can pump my air full of toxic exhaust, and yous are telling us what the acceptable level of drunk should be to drive a lethal weapon.

     

    The polis will lift you or stop you for whatever reason they want to use, tinkering with levels will make a political difference only, so coming from my perspective I welcome every move towards zero tolerance on drink and driving

    rwe … may be different from Canada (although I doubt it) …. you seem to be confusing/conflating two things … being stopped, and being breathalyzed…

     

    the RIDE program (holiday roadside stops to see if anyone has been drinking) are legal …. but, legally, before they can ask you to take a breathalyzer, they have to have probable cause to suspect you have been drinking (not a hard test, and as you say, the courts usually believe/side with the cops on this issue) ….

    Lennon’s Passion, I have been at a few games down south over the years and the swallay they sell to fans is not the strongest, around 3 – 3.5% proof.

     

     

    I have a feeling if swallay can be served at games here, it will be low strength.

  26. I was stopped a few months ago outwith the village, the guards were stopping every single motor, they made it clear it was for alcohol, nothing else, I passed, hadn’t touched a drop.

     

     

    Quite often here as well, they will set up road blocks on the motorway, there will be say 20 cars, guards with machine guns etc, you have to go through a cordon, they will select who they want to stop, thankfully always been waved on through, trust me the Qs are horrendous.
