Clyde FC point SFA and SPL to contractual and judicial facts

I received updates direct from last week’s Scottish Football League meeting shortly after it concluded.  My information was that Neil Doncaster in particular was given a torrid time and that the mood among clubs was firmly against agreeing to place Sevco into the First Division.

Within a couple of hours it was clear that many in the media had been given a different impression and that if the vote was taken then, a ‘healthy majority would vote in favour’.  To a degree I think we are all susceptible to messages we want to hear but it has been a feature of this debacle that executives from the national bodies have given clear guidance to the media that ‘Newco’ would be voted into the SPL, as it was, or now into the First Division.

On more than one occasion I’ve heard “You might have heard different, but Neil Doncaster told me….”

There is no shortcut for legwork and attention to detail.  On this subject, credit to STV, who present informed information on how Friday’s vote is likely to pan out, with references.  Of the 30 clubs in the SFL, the report 14 have declared an intention to vote against plans to plant Sevco into the First Division, one will abstain and one has (incorrectly) been told they are ineligible to vote.  Another 14 are yet to declare.

It seems likely that the SFL vote will go the way of the SPL vote.  There is a desire to retain the sporting element to our game among clubs, if not among administrators.

In a statement yesterday Clyde FC nailed several of the myths behind threats made to SFL clubs:

“We have obtained a copy of the Settlement Agreement signed up to by the SPL and the SFL in April 1998 – it is clear that the agreement is not ambiguous in this regard and there is no scope for the SPL to fail to meet the obligations to the SFL except by deliberately breaching the agreement… We have concluded that it defies credibility that the SPL clubs would instruct the SPL to deliberately breach a legal agreement.

“The matter is made worse because of the extent of uncertainty which hangs over Sevco. There is no need to prepare an exhaustive list of the issues as they are well publicised, however the extent of outstanding sanctions that may or may not be levied against a club which has yet to obtain SFA membership, together with the increasing number of possible commercial and legal challenges to the transactions to date simply presents a significant risk to the ability of the club to fulfil its fixtures in any league. Given that some of these matters are in the hands of the governing bodies it seems inexplicable that they are left hanging.”

In short, the Scottish Football League has a binding contract with the SLP which they are entitled to enforce.  Clyde also refer on the matter we have discussed here for many weeks, Sevco are trying to buy a SFA membership which has significant outstanding disciplinary issues against it which could see the membership suspended.  Instead of providing clarity, the SPL and SFA have refused to set deadlines of proceed with hearings.

We can speculate if SFA chief exec, Stewart Regan, will inform SFL clubs in person on Friday of plans to disband judicial oversight from our game instead of asking Lord Carloway’s panel to reconvene.

Despite the valiant efforts of many football fans and clubs, our game has been ruined by years of destructive, self-serving, leadership.

    I agree too. My view is that sevco do not meet the SFL conditions for membership and so should not be afforded a place. But my view and the rules seems to matter little as the governors run amok.

     

     

    I suspect the reason why there has been no ‘invite’ to the SPL is keeping the option open of ‘suspension’ and an 11 team SPL with no SFL vacancy at all.

     

     

    The problem with a general SFL vacancy is that, once in, the newest club could not be removed to ‘re-open’ the sevco slot.

     

     

    The best chance for sevco on a ‘suspension’ would be the vacancy carrying in the SPL.

     

     

    Maybe I’m too paranoid now but our enemies are working hard at trying to protect the ole membership ‘transfer’ at all costs.

    An interesting assertion. Do you mean practising Catholics or supporters drawn from a non catholic background? Interested to know. I carried out a very limited calculation of Catholics that actually attend CP ( That is those who regulary attend Mass) based on census results from Scotland and reports of number of people who attend mass in this country published by the church. For no other reason than it was something to do and i was bored, anyway i estimated that at a full CP 12,000 of those at the game would be practising Catholics. Probably a load of BS as not in any way researched or quantified but an interesting parallel to your post.

  14. It took more time talking to the SFA, SPL EUFA and politicians! thereby incurring the highest labour costs of 884 grand, it seems Ogilvie,Regan and Doncaster had a lot of meetings with D&D

     

    In total £489,910.50 of time costs relates to the sale process undertaken by the Joint Administrators.

     

    There are £679,215 of time costs incurred in the period which relate to the Trading Operations of the Club.

    Celtic’s entire support is of course catholic since our support is universal or broad. It is of course not entirely Roman Catholic as a Christian DENOMINATION.

     

     

    As a Scot of Protestant extraction I enjoy using the word ‘catholic’ when referring to anything broad. It helps expose those of Scottish (and other) protestant extarction who have WASP and WATP tendancies

Would that spell out the threatened loss of income to each club should they apply some integrity to their vote on Friday. A vote, which Clyde FC believe they should not be having. Maybe Jim has been spending too much time in Linfield recently (who are on course to meet Celtic after getting through last night), but the recent statement from Stenhousmuir specified £50,000. Vote for Rangers or get fined fifty grand. How much more information do the clubs need?

    What will the SFA/SPL/SFL do if Charles Greens Sevco go into administration before the end of the 2013 /2014 season.

     

    IF Charles Green can’t pay running costs. (do they even have banking/overdraft facilities?)

     

     

    Oldhuns running costs were around 3 or 4 million quid per month and sevco may cost only half of that but it still equates to about 20 million quid per season, quite a few season tickets need to be sold at division 3 prices to run that business! I reckon he will need 40,000 season tickets at £500 a greyskull to break even, and who wants to pay £500 to see the kid on 2nd rate gers playing east stirling on a Wednesday night.

     

     

    You know, when the old huns were on their knees I was never really completely sure exactly which obstacle would deal them the finishing blow and push them over the edge. (lord knows we waited long enough)The new all shiny sevco are not really any better off, as far as I can see.

     

    8 million quid of debt debt inherited from the takeover,

     

    26 million debt due to agent whyte/ticketus,

     

    plus whatever debt they run up in the next few months means that any potential billionaire buyers will need to start the bidding at over 35 million quid or they go back into administration. A very possible/probable scenario.

    starting an spl 2 requires 8 clubs if its 2 x 10 outside the first division how many clubs met the seating critiria.(stronger together)

    sky t.v’s desire to have 4 x celtic vs. rangers games at the insistance of sky has led to the non-competitive nature of our games. small league = to many games against the same team = boring for fans, to few ups and downs

     

     

    scottish football should be looking to start up its own t.v channel, how many people have to buy sky and espn to watch our game, thats 30/ 40 pounds a month. 10.00 per month for live games, extended highlights of all division driven by the promotional ‘ our game’, advertising, pay-per-view for celtic vs. newco etc… should see more income that the awful deals in place at present.

    Ever since the CVA didn’t happen, the grand rescue plan seems to have stumbled from one setback to the next. Those pesky SPL supporters not buying season tickets obviously wasn’t envisaged and now we have SFL diddy-teams who can actually afford integrity since they’ve got nae erse in their troosers anyway.

     

     

    I think that there are political pressures afoot – but it makes you wonder why the CVA was never agreed to by HMRC in the first instance as that decision has been the root of all subsequent problems.

  29. I’m not too bothered where Sevco play this season, though justice and sporting integrity demand that they should not be playing anywhere in the SPL or SFL.

     

     

    What is more important for me is that Rangers are stripped of all titles gained through cheating, so that it is in the records for ever. And also that the SFA becomes a body that can be trusted to run the game properly in Scotland. That means Regan has to go. (The presence of Ogilivie has long since made a mockery of Scottish football.)

     

     

    I don’t think that Doncaster and Regan can be trusted to conclude the investigation into dual contracts. Doncaster still hasn’t finished the investigation into sectarian singing at the Bigotdome in February!

  31. Guy I work with is a Falkirk season ticket holder,elder of the Church of Scotland .His take on it is simple, at best it should be 3rd Div even then he does not think they qualify for that.
