Conflict of interest Ogilvie

As newco chief executive, Derek Llambias reported to his AGM yesterday, he meets the SFA today to discuss further involvement of Newcastle United owner, Mike Ashley at his club.  Ashley is nearing the end of a power-struggle between his faction, which appears to include the Easdale brothers, and pretty-much everyone else who goes to Ibrox, as well as Dave King and other worthies noticeable by their absence when the assets of oldco were to be paid for.

One of this morning’s newspapers appears to suggest SFA board member Peter Lawwell may retire from this meeting on account of him apparently having a conflict of interest, however, I believe this would be extraordinarily unlikely.  Peter is no more or less incentive to see business being conducted appropriately than anyone else.

That’s not to say there’s not a conflict of interest.  SFA president, Campbell Ogilvie, will also attend the meeting.  Ogilvie passed his Rangers shares to his wife when he became an executive director of Hearts.  SFA Articles of Association expressly forbids a person from having an influence with one club while “directly or indirectly” being a shareholder in another without the prior written consent of the SFA.

Mr Ogilvie may have attained prior written consent of the SFA on this subject before accepting the Hearts job, but if he did, I don’t see the need to transfer his shares to a family member.  This makes Ogilvie look like a tawdry ducker and diver, wholly inappropriate to lead the Association. If I was Llambias I’d challenge Ogilvie the first moment he opened his mouth.

As I said earlier in the week, don’t get too hung up on Ashley’s shareholding.  If it proves a stumbling block he could play The Offshore Game and quickly disinvest to an entity based in the British Virgin Islands (seems to be the hot location for these types), the control of which could never be traced to him.

Those hoping the SFA will inhibit Ashley’s land-grab of retail and other rights are also likely to be disappointed.  JJB and Wigan Athletic owner Dave Whelan established precedent that he was able to conclude extensive trading contract with other clubs while in charge of Wigan without compromising multi-ownership principles.  Ashley can own and exploit all commercial rights of newco.

The key point Ashley will be concerned about in SFA rules is article 13. (3), which forbids persons from having “any power whatsoever to influence the management or administration of another club”.

The rules permit the SFA to grant Ashley permission to increase his shareholding but the phrase “any power whatsoever” is patently clear.  Ashley cannot appoint board members or offer loan players.

There’s always a spring in the step when news of our pal Kano arrives.  That changed when I opened the email from Carolyn yesterday to hear Martin was in Intensive Care.  We know through his time on the blog that Kano brought vigour and resolve to his life years before his illness struck.  If anyone can overcome this, it’s him.

    Been reading back and find it hard to comprehend the amount of posters saying they didn’t expect a statement from Celtic re the death of the hun.

     

     

    I expected a statement. I wanted a statement, and I’m still angry that we did not get one.

     

     

    However, the time for a statement was badly overlooked and has come and gone. Celtic could and should have killed the bullshit on day one. The day the HMRC rejected the CVA and BDO were brought in to liquidate the hun was Celtic’s golden opportunity to do it and do it right. I’m not talking about a gloating statement, I’m talking about a statement that would have worked and not have led to the myth that Celtic need to protect their employee’s and supporters from hun retribution. A statement that the hun horde would have enjoyed. A statement of sympathy at the loss of our rival of 125 years and how we looked forward to any form of new rangers incarnation blah blah.

     

     

    Celtic have some clever law and council. I’m sure they could have come up with a suitably worded script that would have killed dead any pretence of incubators, company’s that run, corporate husks and all the other pish that has since been pedalled. We had a chance go put a massive boot into the balls of the SFA, Reagan and Doncaster and shat it. or blew it, or didn’t grasp the fact it was the time when a statement would have set the record straight

     

     

    Why Celtic did not do this is beyond me, it seems naïve in the extreme.

     

     

    Celtic were weak and allowed the chance to get the whole support onboard pass them by. Any statement now would reek of petty vindictiveness. The best Peter Lawwell can do is a joke at the AGM and perhaps a dig when we meet the new team in our league, if they ever get there.

     

     

    I’m very disappointed in Celtic for letting the chance to kill the hun / MSM / SFA / SPL lie dead, when the opportunity was staring them in the face.

     

     

     

    Celtic shat it when they should have galvanised the whole of Scottish football.

    I was thinking on reading your post its a pity that was not done but do not forget the idea that it was still RFC did not take hold immediately Rangers were put into liquidation.

     

     

    Certainly not in the media who more than any have punted the same club idea. In fact they were quite clear that Rangers had died at the time.

     

     

    By the time the holding company crap had emerged the opportunity had gone because at the time a clarifying statement would have been made it was not needed.

     

     

    Anyone any idea when the holding company idea first emerged from where and how long before it was seized on and peddled?

    Auldheid, the first concoction of “the holding company” I remember was when the trucker was involved, although he used the term “incubator” and talked about taking the good bits into the incubator and leaving the shit outside.

     

     

    My point was that we had a perfect opportunity to issue a sympathetic but unambiguous statement that our rivals were dead.

     

     

    Celtic blew the chance, shat it or decided for their own reasons it was not in their interest. In doing so they lost support and we are still divided on the issue.

     

     

    The best one so far though has to be “the corporate husk”. That is a doozie piece of bullshit from the mouth of the hun.

    Just like to say a big thank you for your efforts and wish you and your family a great xmass.

     

    However, the notion that Celtic were compliant to aid other SPL clubs doesn’t wash. Lawell has now stated on 2 occasions the loss of the 10M, coupled with DD statement points to their wishes.

     

     

    I gave up my season book of 20 years when Longmuir said Rangers would keep their trophy’s regardless, as well as LNS.

     

     

    I still have my shares and been to a couple of euro games but without LNS being revisited my stubbornness will not allow me to give up the golf to prop up a rigged game.

     

     

    I pray LNS is revisited, what are my chances?
