D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

    Do not be vague. Name names, and specify dates and circumstances. Identify witnesses if possible and provide supporting documentation if any is available.

    (3) Local law enforcement agencies are usually under pressure if wealthy or politically powerful individuals are involved, so include state and federal agencies as well and tell the locals that you have. In my own experience, one agency that can help in a pinch is the Criminal Investigation Division of the Internal Revenue Service or (in Canada) Victims Services at your local police unit. It is not easy to think of the IRS as a potential friend, but a Swedish study showed that malignant types (the Swedes called them bullies) usually commit some felony or other by the age of twenty. If the family is wealthy, the fact may never come to light, but many felonies involve tax evasion, and in such cases, the IRS is interested indeed. If large amounts of money are involved, the IRS may solve all your problems for you. For obvious reasons the Drug Enforcement Agency may also be an appropriate agency to approach. The FBI is an important agency to contact, because although the FBI does not have jurisdiction over murder or assault, if informed, they do have an active interest in any other law enforcement agencies that do not follow through with an honest investigation and prosecution should a murder occur. Civil rights are involved at that point. No local crooked lawyer, judge, or corrupt police official wants to be within a country mile if that comes to light! It is in such cases that wealthy psychopaths discover just how firm the “friends” they count on to cover up for them really are! Even some of the drug cartel biggies will scuttle for cover if someone picks up the brick their thugs hide under. Exposure is bad for business.

     

     

    (4) Make sure that several of your friends have the information in the event something happens to you. That way, an appropriate investigation will follow if you are harmed. Don’t tell other people who has the information, because then something bad could happen to them as well. Instruct friends to take such an incident to the newspapers and other media.

     

     

    If you are dealing with someone who has considerable money, you must realize that they probably won’t try to harm you themselves, they will contract with someone to make the hit. The malignant type is a coward and will not expose himself or herself to personal danger if he or she can avoid it.

  20. When it comes to the appeal whether Scottish football needs them should not be a consideration. The only issue to hand should be whether the verdicts are correct, and the penalties described in the rules agreed by 42 clubs properly applied. As has been alluded to on here by some learned and well read posters, the panel seem to have neglected to apply a withdrawal of license appropriate with the level of the monetary punishments applied.

    Fair do’s to Hugh and Delahunt for booting into touch the caller saying the panelists should be named. He said judges were named but they responded that jurors were not.

     

     

    In a civilised society the caller might have a point but in a civilised society jurors would not need anonymity.

    My renewal, when it lands on my doorstep, is going to remain unactioned till I know how Celtic are going to deal with a Newco, if that is the way this is all going to unfold.

     

     

    If they abstain, or worse, vote in favour of re-entry, then I’m going to be spending my Saturdays working on my golf handicap.

     

     

    It’s No Newco or No Season Ticket for me.
