D&P blow their own argument to shreds in court

1179

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

  7. My neighbour- he calls himself Fury- has started the whole boycotting thing with all his quintessentially British stiff upperlip gusto. I Came home from work to see him staggering like a drunk dalek. Had to help him up the garden path as he had thrown away his Specsavers glasses. What really bothered me was that he told me he had drank a cocktail of buckfast & mad dog from his wife’s moccasin shoe- he wore a red leotard & a pink tutu. He was finding it difficult to speak as his tongue had went rigid, rigor mortis set in and his tongue now looks like a stuffed blue pike. Through the noise I managed to decipher that he had: smashed up the family Vectra. Told the kids they would never eat another MacDonalds & beaten one of them after he found a Mars bar in their lunch box…I then realised he was wearing no shoes as he had thrown away all his Adidas trainers in the bin. Fury is a military memorabilia collector & as he was polishing his Nazi helmet he told me that he is wearing his Stormtrooper overcoat, his Gas mask and re-pinning his luger gun for the march to Hampden on Saturday…just away to phone the Polis…

More of a question than a demand Aw Naw but the very idea it should fold in the face of bullying tells you a bit of how thinking goes in Scotland.

I would expect a strong rebuttal from the SFA and McCoist being called to explain what his motives were in making the statement he did when he did and when (according to Tom Englis) he KNEW who the panel were.

If that is not intimidation I don’t know what is.

“We are a seriously wounded animal”. Not my words, the words of current Manager of Rangers FC. Yes the same guy who demanded the identities of the independent SFA panel be made public. Made public being the specific intention of Ali McCoist. Made a target being the inevitable result. A thoroughly irresponsible and dangerous act. So not only a seriously wounded animal, no much much worse, a dangerous animal.

I hope to meet them when they come to Belfast

I don’t know if it would be a good idea to expose them to the “filth” on Sunday.

Has Murray got the cajones to cheat us again? He’s still got a few years left in the game.

  14. There is a chance on Sunday that they will make off the park hell (on it i’m sure we will take care of them) so I wouldn’t have the young kids anywhere near them
