D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

    The Champions website announcement doesn’t mention prices, anyone have any advance knowledge.

    I doubt I’ll renew my ST if a huns Newco is in the SPL next season. What is the point of going along week in, week out, knowing nothing has changed and that they will continue to win tainted trophies, leagues etc. after all that they’ve been accused of and in some instances been found guilty of?

     

     

    Surprisingly I actually feel they won’t be in the SPL next season. There are too many external bodies looking in now. The SFA and SPL have been backed into a corner and are under the microscope.

    I suspect it will be based upon the severity of the transgressions.

     

     

    That, in turn, will have determined the category of the punishment (minor, major, maximum).

     

     

    In determining both of the above, previous cases will have been examined.

     

     

    If any of these previous cases have resulted in a major category outcome, then precedence is set in terms of those categories. Calibration of the charges against RFC by Lord Nimmo Smith will have left little room for manouvre for the panel when compared to previous cases.

     

     

    However, it appears they have attempted to manouvre as the maximum penalty has not been applied (expulsion).

     

     

    I can think of no other case in Scottish football history that will have been as serious as those considered by this panel.

     

     

    It’s worth noting that these charges will pale into insignificance when the SFA have to consider improper registration of players over a period of 12 years. What we are witnessing right now is merely a dress rehearsal.

  10. Strange posts tonight which appear to be arguing that in times of rangers trouble and impending death it might be good to not keep investing in our own beloved Celtic.

     

     

    Celtic are on record (off the record of course) saying they will not vote for a newco.

     

     

    We have a chance at regular Champions League fitba for a long time to come. But that needs current levels of income to give us a fighting chance of same.

     

     

    The way I see this is that, when and if they die, and are scraping about either in Div 3 or in the middle of the SPL as NewcoRFC, we need to ensure that we are so far out of sight financially that they will never be able to challenge us again. The only way to do this is for us to SUPPORT Celtic – to relish the new opportunities that await post RFC and Glasgow rivalry, put as much clear water between us and any association with them as possible and get back to enjoying following and supporting our Celtic with no reference to a once hated, cheating and sectarian club called Rangers which will no longer exist stoppig only now and then to laugh at the pathetic nature of the new club their dysfunctional family created……

     

     

    But if we all ‘walk away’ then we let their new manifestation back in. Will we still be blaming Peter Lawwell then?

I may be being oversimplistic in my reading of the situation but if a lot of the Celtic support query their renewal of the Season Book won’t that play into the hands of the media who will proclaim from the rooftops that we only get a book because it guarantees watching them twice a season? In other words, in their twisted logic, we don’t want them to die,because we need them. Gies peace.

    I hear the “Celtic will vote for Ragers” line every other day from Celtic fans I know especially one armchair fan I know who is adamant, about it.

     

     

    I agree with you that the soundbites from Celtic Media Team are very different, and some of the recently provoked reaction from Celtic FC, suggest otherwise.

     

     

    Sadly, I don’t think it will matter which way Celtic vote.

    Want Bayern in the final but can’t help thinking that Real would be more likely to beat Chelsea (who I most definitely do not want to win the CL).

     

     

    Work with a lad who supports Rangers (RFC tatoo’s the lot) who walks around in Chelsea tops at work. He is one of those fans who lets you know all about it when the huns win but when they loose (or go into administration) shruggs his shoulders and says he is a Chelsea fan.

I was listening to Arcade Fires “Ocean of Noise” when I was reading…it got to a bit where it says “we can work it out” & then trumpets & a chorus comes in…thought about my own faither & freat Celtic memories…it brought a wee tear to my eye. A cherised memory. Great post. Grateful to have read it.

    Even if it transpired that Celtic were in some way complicit in this eventuality I would be able to differentiate between the actions of Celtic PLC and the club itself.
