D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

  8. The attempts at placing blame everywhere else other than at the foot of the marble staircase are endless.

     

     

    First it was Lloyds fault. Remember Walter Smith’s statements to the media, designed to get the fans against Lloyds and their rep on the board? Very similar to McCoist yesterday. Lloyds were attempting to get RFC to address their debt. Pity there were very few RFC fans supporting Lloyds at that time – they may not have ended up where they are now.

     

     

    Then it was RTC’s fault for peddling rubbish about a big tax case.

     

     

    Then it was “Pay up Mr Whyte” banners, in an attempt to force Whyte to get the deal done with Murray.

     

     

    Yip, Whyte paid up – £1. Nobody seemed too fussed that Murray couldn’t sell it despite trying to for four years, and then sells it for a quid?

     

     

    Whyte Knight. Hero. Billionaire. Off the radar. Yada, Yada, Yada. £25m plus £5m per season.

     

     

    Can you imagine what would have happened if the SFA stepped in to stop that on the basis of “fit and proper person” test? Seriously, can you imagine?

     

     

    Then it was RTC’s fault again for peddling more rubbish about a big tax case.

     

     

    Then it was HMRC’s fault for wanting the wee tax case money and the VAT and PAYE money it was rightly owed.

     

     

    Then it was HMRC’s fault for wanting paid for the big tax case, which by now had become something of a reality.

     

     

    Then it was Whyte’s fault for not being a Whyte Knight after all.

     

     

    Then it was Murray’s fault for selling to Whyte.

     

     

    Then it was the SFA’s fault for not stopping the sale to Whyte.

     

     

    Then it was Whyte’s fault for going into administration.

     

     

    Then it was Alex Salmond’s fault for not sorting out HMRC.

     

     

    And now it’s the SFA’s fault for applying proper process and punishment.

     

     

    And we haven;t even got to the player registration issues.

     

     

    And all along, somewhere in the background, it has always been Neil Lennon and Peter Lawwell’s fault.

     

     

    Pay your bills. Or take your punishment. The blame lies with RFC.

    Back to the bad news. Rangers are simply not in a position to be bought. The poison from the last two regimes is still seeping out and only a fool would attempt to buy lock, stock and liabilities at present.

    I posted an answer to this on here last night. We are not in any of the ‘transient’ places in the CL qualifiers, those spots are taken up by the Champions of Belgium (13th, 3rd Rnd -> CL Groups), Switzerland (16th, 2nd Rnd -> 3rd Rnd), Malta & Norn Ireland (48th & 49th respectively, 1st Rnd -> 2nd Rnd).

     

     

    As with anything any other fact originally sourced from MSM, always check before repeating (I regularly add our points total up and then theirs, not because I don’t believe them, just because it makes me chuckle).

     

     

    But no, we’re not in line for a CL boost.
