D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

    ernie lynch, I read you so often assure Celtic fans here that the Celtic board will somehow assist Rangers in their attempts to survive. This has gone on over many months despite any evidence of support or the occasional public comments from Celtic.

     

     

    Has is ever occurred to you that you might be wrong and all you are doing is polluting the minds of other fans?

     

     

    I have heard Celtic’s views and hopes on this matter since October, they have been unequivocal and very helpful with connected matters.

     

     

    The reason I write is that I think it is enormously dangerous to our football club for notions that the management are lying to their supporters and keen to assist their opponents, so I have a proposition for you.

     

     

    Instead of casting doubt about the Celtic management at a time in our history when unity is more important than ever, email me: celticquicknews@gmail.com and I will do my very best to facilitate a meeting for you to look the people in charge in the eye and put your concerns direct to you. You will then be in a position to make a vastly more informed judgement.

     

     

    Until then, perhaps it would be better to encourage solidarity at our club. Of course, if all you are wanting is to blow off some steam on the internet without taking any of it seriously, fee free to ignore the offer.

    Scottish FA spokesperson: “We are deeply concerned that the safety and security of Judicial Panel members appointed to a recent Tribunal has been compromised by a wholly irresponsible betrayal of confidential information.

     

    “The Judicial Panel consists of volunteers from across the spectrum of sport and business in Scotland. They are appointed on the basis of anonymity yet all three panel members have reported intrusion into their personal and work lives, including abusive and threatening communication.

     

    “This has been extended to directors of the Scottish FA, whose private details have been published on internet sites and who have, themselves, been victims of abusive communication.

     

    “This culminated tonight in a visit by Strathclyde Police, who are taking seriously the threats made towards the individuals involved. We are thankful for their advice and support in these matters.”

    The reason I won’t renew is that it turns out I’ve been spot on all my lifetime of watching Celtic – the deck has been heavily stacked against us and I’m not paranoid.

     

     

    The Celtic board have a once in my lifetime opportunity to end this corruption in favour of one team, by helping to kill that team off.

     

     

    My love of Celtic will never change, but my contempt for this board should they prioritise short-term commercial interests over integrity will override my love for my club. I believe many feel the same

    I disagree, I have enquired about the proposed actions from a number of Celtic supporters with regards to this.

     

     

    Only a couple have stated their intention to find other hobbies. The vast majority will renew their season tickets and continue to support the club vocally and financially.

    I dont do moaning on web sites, I get off my backside and try to work for change, but if it does not come from the massive outrage this is to Celtic, the game in general and the decent folk in Scotland, I will walk away (much to my wife’s satisfaction).

     

     

    However I am fairly confident that the forces for good will prevail and I look forward to just enjoying or not enjoying the football. just based on what happens on the park.

  19. Ally McCoist….what to say? When I first read his comments, I gave him the benefit of the doubt. I remembered how stunned I was when I read the judgement and as it sank in, and I thought perhaps he was speaking without thinking in the heat of the moment. Now i’ve heard it, he sounds calm and calculating. No excuses.

     

     

    He has shone a light on the very ugliest side of Rangers fans.

     

     

    He has made it very awkward for an appeal panel to overturn the decision in the face of intimidation. He’s made it more likely, not less, that Rangers go under.

     

     

    And he’s got people talking about threats and intimidation. They talked about it with NL – but this time they’re not suggesting that the panel members brought it on themselves. Maybe now there’ll be more sympathy and understanding for Lennon next time the stinking rancid side of scottish society attacks him.

     

     

    Ally McCoist. Might not have have put the final nail in the coffin of RFC, but he’s handed the hammer to those who will do the job.

  21. with the threats against the judical panel whats the chances of getting anyone to

     

    add further sanctions or expel rangers in future investigations with this hanging over them, if the sfa cannot get anyone to take the decisions then its time to hand it over uefa, come to think of it its probably the best way out of this for them.
