D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

    CFC doing a great job , saying nothing in public , you know it would be twisted to suit an agenda.

    The intimidation does not really surprise.

     

     

    The rangers manager should be ashamed of himself regarding his remarks on the identity of the panel

     

     

    He should make a full public apology straight away.

     

     

    The SFA MUST come down hard on this and not allow their organisation to be bullied in such a manner.

    ” no one complained when we (thems) were signing all these big names IN FACT supporters from all over Scotland went to the games just to see these players, so everybody earned money at the turnstiles and got the pleasure of seeing these players instead of the usual SPL crap. But now it’s ‘ awe they shouldn’t huv signed them ‘cos it wisnae fair how they done it’ ” His own words.

For the manager of Rangers FC to have made that broadcast, on Rangers TV I believe, (though I heard it repeated this morning on Radio 5) is totally unacceptable, and like you I hope the wider reaction in Scotland is one of revulsion. I would like to say I am pleased that the SFA have come out with a statement, but pleased is not the right word, I think it is a disgrace that they have to. I am no expert on the regulations relating to Broadcasting in Great Britain, but I am pretty sure they apply in Scotland as well. And I am pretty sure that McCoist has breached said regulations, and that other broadcasters have made a mistake repeating the content. Time maybe for one of Glasgow’s finest to have a word, in Ali’s ear!

    With respect, Paul, I suggest you read my posts more carefully.

     

     

    I have raised the possibility that the Celtic Board might, by commission or omission, allow a newco huns into the SPL.

  23. So the bastions of Scottish society, described as part of the fabric of our society attack the very establishment they are considered to be an integral part of.

     

     

    As I posted last night, some of them say that the punitive measures are draconian and unheard of. What they have done is unheard of, they have brought Scottish Football into disrepute. Name me one other Scottish Club that has done what they have done?

     

     

    Some have said that Dundee, Livingston, Motherwell and Gretna were not punished so severely during their financial woes. The difference is these Clubs tried hard to make an honest way in Scottish Football, yes they went into administration and were penalised. However, they were not barred from signing Players because they lived within their means in relative terms but eventually ran out of money. And why did they run out of money because they paid their taxes.

     

     

    Dundee, Livingston, Motherwell and Gretna did not use their taxes to pay players wages or buy new ones. How many Teams within Scottish Football and out with do they owe money to!!

     

     

    Here’s a point, Hearts are owed money from them for Wallace. I did not see their game against the minis but from what I hear Wallace assisted with some of the goals. What a joke.

     

     

    Jackson last night said they should suspend the transfer embargo and give them time to pay outstanding debts to Football Clubs. Two questions:

     

     

    Where will they get the money to pay these debts?

     

     

    How long do you give them before you impose the transfer embargo?

     

     

    I would take further measures, I would either stop them playing Wallace and any other players until their previous Clubs are paid in full. Or return the players to their previous Clubs.

    Here is another opportunity to take action against a Club for the actions of of one individual i.e. Ally McCoist. Just as you point out in your leader, D&P are pursuing C&B for the alleged irresponsible actions of Withey, so too should the SFA make further punitive measures against rfc(ia) for the irresponsible actions of Mr. McCoist.

  25. I hope Ernie does take Paul up on his offer. Ernie has a cynical side and that is not in itself a bad thing, in fact I think it is in most cases a good thing.

     

     

    I think Ernie is true to himself which is a virtue to my mind.I believe Ernie’s views post such a meeting would be galvanising (well I would bloody hope so).

     

     

    I also believe that there is more malice in Super Ally than simple stupidity. Let’s see whether the harlot hacks circle the wagons around him or whether they condemn his incitements and call for appropriate punishment, bearing in mind that the silence of the harlots can often be more damning that a multitude of words.
