D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

    His demand that the SFA disciplinary panel members be named in public has stirred up an entirely predictable reaction from the lunatic element of their support. We now have names being mentioned on websites.

     

     

    We know what Neil Lennon, Trish Goddard and Paul McBride (RIP) went through at the hands of Rangers supporting thugs, so it is not difficult to imagine the anxiety being felt tonight by the disciplinary panel members for the safety of themselves and their loved ones.

     

     

    If there’s any justice at all the appeal panel will double the fines and the length of the transfer ban.

    My Season Ticket for a number of years was just on the “good” side of the divide for games against them in the Upper Tier.The amount of stuff thrown at us was incredible.Meanwhile,the police and stewards kept their attention firmly on us.I don’t know the current demographic of the crowd in that area now but,while I was there,there was a high proportion of elderly,young and female fans.If there was an attempt to break through from these animals,I am far from convinced traditional stewarding/policing could prevent it and the Celtic supporters in that area would be exposed to danger.

  26. Admin FC could provide a great financial boost to Division 3 next year.

     

     

    Clyde FC have an average attendance thus year of circa 555. They play 18 home league games giving them a total attendance of 9990.

     

     

    There ground can hold 8000, the largest in this division. Assuming Admin FC filled it twice a season this would give them a total for those two games of 16,000 alone. Even without a price hike this would increase their income from attendances by 160%.

     

     

    East Stirling have the lowest crowds and ground capacity. This season the average attendance is 324 with a capacity of 1880. Two games v Admin FC would only amount to 3760 , if they have that away support. Their total attendance for this year will be circa 5832. Still an increase of about 66% in income.

     

     

    No doubt clubs like East Stirling, Montrose (3100) and Peterhead (3250) will use temporary stands to increase the attendance.

     

     

    The greatest beneficiaries of Admin FC’s largesse could be Queens Park with a Hampden capacity of 52,500.

     

     

    I am sure they will relish their two trips to Hampden next year.

     

     

    Admin FC are, for the first time going to be good for Scottish football. I hope the Third Division ate so grateful that they decide to keep them for a few years. They could become so important to the SFL that they change their rules to keep them in their leagues.

    I’ve sat closeby, albeit in the lower tier, where the majority of the crowd would have been male but I see what you mean. I recall an elderly fan getting smacked with a potato and have seen coins raining down etc.
