Ellis throws administration a legal curveball

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

  1. breenjy what are u expectnig them to say bud. that everythnig is going to be smelling like pansies. things will be tuff but the rangers will always be here. there will be trouble when some of our fans realise this and see that our bored has been taken us for a ride. they will be sold this week and alisdair will be given a massive war chest in the summer to regalvanise their sqaud. my big mate called this spot on and he was the only one that saw that whyte was bad news. we will be in a real fight next year you better believe it bud.

    Awe Naw, Uefa’s Financial Fair Play criteria imposes rules on clubs breaking even over a period with exclusion from European competition for failure. There is no provision to disqualify clubs from domestic leagues for being in administration.

     

     

    I don’t have the SPL handbook with me but as you clearly have the precise quote, why not quote it?

     

     

    From recollection, there is liberal use of the word “may” when it comes to sanctions. “May” has never led any SPL club to be expelled from the league for being in administration for more than one season – as has happened three times in the last 10 years.

     

     

    For the record, yes, Motherwell, Dundee and Livi all failed to provide a set of accounts.

    Not been out and about much this year, so all my footie talk has been with family and friends, all fellow tims.

     

    However during the hun game got some typical texts from a hun ex-workmate.Now not once during this farce of admin have i had a pop at him, so decide then that once the league was won he was ‘gettin it’.

     

    As the wife tried to explain that makes me as bad as him, i said as only men can…

     

    ” He Started It!! “.

     

    So on Saturday i sent a few texts, but no answer, maybe his phone was off.

     

    Then on Sunday he replied with the expected nonsense 4 managers etc,blah, blah, blah.

     

    When i told him i had left half of my jelly and ice-cream for the big ‘L’.

     

    He replied ‘dream on, never happen, loads of buyers’.

     

    So I’ve been wondering is this the general opinion of most huns, am I missing this being stuck in the house or do other huns accept it coming and its just his Harthill existence.

    We can only do what we can do. We seem to have been debating this for a long time.

     

     

    It still strikes me as completely illogical for the Celtic board to have adopted its strategy since Seville if the outcome is the status quo. Why would they put Celtic, including themselves, through that?

     

     

    Some members of the board, from what I have heard, cannot see past the relatively easy money (my description, not theirs) of a series of games each season against Rangers. Others would definitely be completely in line with your view of what should happen. Doves and hawks.

     

     

    However, as mentioned earlier, it ought not to be for Celtic to make a decision on this. The rules are hard to follow in places, as your discussion with Paul 67 today shows, but they are clear enough for us all to see that Rangers must either pay their dues or go to the bottom of Scottish professional football’s ladder. Even if there were a single Celtic view on that, it ought not to count for anything.

    The difference between Joe O’Rourke and Dullas is that Dullas was in a (well paid) position of authority and influence within Scottish football and was therefore obliged to at least pretend to be impartial.

     

     

    I’m not sure we would have been calling for Mingwall’s head if he had done what Dullas did.

    Is there criteria for expelling national association’s from UEFA competition due to financial mismanagement bordering on the criminal ?

    Celtic MAY vote for a newco Rangers then they again they MAY not

     

     

    The SFA MAY choose to expel Rangers IA for the plethora of transgressions that I alluded to but then again they MAY not.

     

     

    Is this where we are at ? i.e the game in Scotland has good governance but then again it MAY not ?

    As a new contributor I must say, and I am sure there are many other new or infrequent posters who will agree that it is so difficult to get a response on the blog unless you are “one of the lads “. I feel a bit disheartened by the fact that I have had minimal response to what I consider to be topical issues that I would really like a response to, from the better informed. Some can go on for ages with trivial matters which can be quite frustrating when you don’t get a reply to the topical issues of the moment.I hope there is not an “old boys club” here that is difficult to break through.     There was a programme (possibly Horizon) some years ago that provided strong evidence to suggest The Titanic sunk due to the use of substandard materials ,principally rivets ,by Harland and Wolff in order to cut costs.

     

    The conclusion was that if the rivets had been up to the original specifications the ship would not have sunk, and that the effect of using the inferior rivets was that they began to pop after the initial impact effectively causing the metal plates on the side to shear off in a kind of cascade effect.

     

    Original spec rivets would have held and although the ship was badly holed it would have survived to complete its voyage,

     

    Much has been written about this over the years and the information is available on the net, but there has been no mention in all the questionable recent hype in Belfast.

     

    Bottom line is if the ship had been Clyde built it would now probably be a museum that people could walk around, rather than a bunch of photos and propaganda in a museum which conveniently appears to ignore the facts of what happened and disgracefully celebrates a shameful episode in the history of the Northern Ireland establishment.

    My own opinion is that he was incredibly naive to think given his position as a high profile Celtic supporters spokesman, his comments would cause consternation / outrage. I totally can see how his comments can be construed as bigoted ( and he may well be a bigot ) however I can equally see how it wasn’t intended to offend, just a misguided attempt at humour.

     

     

    He apologised and therefore gets the benefit of the doubt from me. ( that he is not a bigot )

     

     

    I hope we can move on from this. Its said, he has apologised and no doubt received plenty of vile abuse from some Rangers fans as a result.

     

     

    I will in no way defend the comments but we all make mistakes.
