Ellis throws administration a legal curveball

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

  2. Ernie – he did of course know all about it but I suppose could not, like other Rangers supporters, see it for what it was – something that should have made having anything to do with that club unacceptable. In his case there were many mitigating circumstances but nothing made it right.

    On the contrary i do defend his stance. His comments may have been ill judged given the forum he chose to air them however the sentiments of his statement are factual, bigots and those complicit with bigotry built ships in H&W – an indisputable fact. Your family history has little relevance to the history of institutionalized bigotry and hatred in the Belfast shipyard unless your father and the other ‘decent’ workers openly protested against the treatment of their Catholic colleagues and was willing to stand shoulder to shoulder with them. If he did he has my admiration and gratitude. However he would be amongst a miniscule minority. The majority, even if they claim not to have participated in the violence and intimidation, where by their very silence complicit.

  6. What is about the rangers directors box? Neil told he would be unsafe there and now Duff&Duffer advised by the Police that they are not safe in it anymore.

     

     

    Is this small area some sort of crime hotspot and no-go zone or are the police cutting back their numbers seeing as they are owed £50,000.

    I know I shouldn’t really pay attention to anything any of ‘them’ say but I seem to recall Jandy Sardine saying that if they hadn’t exited administration by the end of cup final day then they would start the next season minus ten.

     

    The rule as posted by Gordon isn’t exactly clear so I guess we’ll just have to leave to the truth and reconciliation boys at Hampden. They may possibly decide that any team not in administration should be deducted ten points to try and ease the financial strain of any club in difficulty.

    The small tax case money was ring fenced by HMRC, days before the money was due to be handed over, RFC appealled. The appealled has now been dropped by Duff & Fudder but the money, like any other money owed has not been paid.

    A secretary of any organisation does a very important job. He/ she is responsible for the smooth running of their organisation.

     

    nothing more, nothing less.

     

     

    They do not speak for their grouping and should not speak, or use their position to speak, on anything that pertains to their members: unless it is in the form of a statement passed by the members or committee.

     

     

    In the case in question, it was either a case of crass stupidity or arrogance that allowed the author to be quoted thus.

     

     

    In either case, he should step down.

     

     

    He has made his Association look cheap and shallow and Celtic supporters are better than that.

    Can he keep all these balls in the air? He’s got too much at stake to walk away from this but how he seals the deal is beyond me. Can see him keeping his head down and being the Owner of RFCia for sometime.

     

     

    Obviously Ellis is another RFC Director more interested in his self interets than his club.

    -Mjallby and Thommo, have they learned to help/work with lennie more , don’t know much about what they do.

     

    -Mathews, how good could this guy be, it’s scary .

     

    -PL, stuck with Lennie, never a mention of a lack of support, yeah mistakes were made a couple of years ago but few would disagree we have a squad that could win next year and with some additions challenge in European competitions. I definitely queried the young team from different markets approach but he’s been proved right.

  19. I remember other clubs going into admin down south with 4/5 games to go so that they took the 10 point penalty in one season, if safe, in a higher league. The idea was then to exit admin during the close season.
