Europa failure would compound acute challenge for also-rans

I’m not going to laugh at results against Luxembourgers or Lithuanians – it’s not so long since Gibraltarians bloodied the nose of a team who went on to become invincible treble winners. Scottish clubs have a long history of pitching up in June and July wholly unprepared for European football.

These results only retain the ability to concern if they are not resolved by remarkably improved performances. Brendan Rodgers’ Celtic grew in stature last summer until they became a competitive Champions League team in the autumn. Others may do the same this season.

What will be clear long before the lottery of the European play-off rounds, is where the gaping chasm exists in Scottish football: are Celtic our only team competitive in Europe, or is there at least one other?

Neither you nor I care who competes in the Europa League, but failure there if Celtic progress to the Champions League will compound an already acute challenge for the Scottish also-rans.

I see there is a consultation as to what the public would like to replace the OBaF act, the SNP will not remove this until there is a suitable replacement, this was not what was voted on in Parliament, why are the Government being allowed to stall this process by other MSP’s? Football like anything else in life is not secetarian, however peolpe make it so, and if the people supposed to up hold and prevent behaviours that is criminal do not carry out there jobs how is any law going to stop this behaviour.

     

    The spreading of hate sectarian racist or any other criminal viewpoint by any means should be covered and prosecuted every time it happens.

    I was looking through the vids on Celtic TV the other day and one showed clips from the Vagas convention

     

    Then I remembered that the new club had theirs also ,just the week before ours .I had seen a few clips of the pool party on MSM sites and I thought ,not seen any from their beano .

     

    So had a wee snoop on you tube and there were 3 vids .

     

    clicked on the first one and low and behold it was

     

    The protestant govan band walking drums and flutes in hand right through the hotel and casino belting out such melodies as build my gallows and no pope in rome with all the flotsam singing along side swear words and all .

     

    Right on out to the front door were they finished their set with the billy boys .

     

    God alone knows what the locals must have thought of it

There may well be a significant reduction in the numbers of those walking but there are still plenty who happily belt out their songs of hate wherever their favourite team plays throughout Scotland. There must still be a lot of support for them in the Establishment, otherwise why were the extant laws against sectarianism not used against them?

Wee story about their Kulchur.Working in Algeria a good few moons ago,on the edge of the Sahara,building Gendarmerie barracks.The company brought 14 plumbers over,all from NI,to do the plumbing.They arrived on the 1st July.50 degrees,the temperature.They came to me,during the week to ask for permission to have their Parade around the site on the 12th.I kid you not.I found out they had brought all their regalia with them.I said yep,go right ahead.Much to the amusement of the rest of the work force,they lined up,Bowler hats,but no banner.What they did have was the guy in front walking with a then,Ghetto blaster on his shoulders playing their Choons.they walked around the site,getting ridiculed from the sides ,3 times.The ridicule,went straight over their heads.They were dripping with sweat,and in deep distress when they finished.

     

    Anyway to finish off their night they had a Sash Bash over in their rooms,which,I found out next morning,developed into a free for all rammy.They broke doors,windows,and a good bit more damage.

     

    I photographed the damage,at 8 in the morning,took it to the company head guy,who promptly went over,sacked them all,and told them,whatever was left from their wages,after the damage deductions,would be sent on.Next morning they all trooped onto the bus for the 10 hour trip to Oran for their plane home.

     

    They came to look me out,thanked me profusely,and apologised for any damage.Most were saying they had no jobs to go back to.

     

    Best 12th of July I ever had.

    About ten years ago a 58 guy in my office proudly proclaimed that ‘I did a right good turn for one of your lot at the 1973 Orange walk’.

     

    Now this was in front of another dozen men, mostly protestant but couple of Catholics including myself, and a Muslim.

     

    He went on to explain that his old man was leading off the walk down Keppochhill Road when a young guy with a tricolour ran out in front of them. His dad caught the boy of about 17 and just as he was about to ‘sink the steel mace which he made in Weir’s through his head, I pulled him off and saved the boys life’.

     

    A stoney silence fell over the whole office until I said… ‘so your da tried to murder someone is that what your saying?’… ‘Och he was out his nut with drink and the boy asked for it’. I didn’t have to say anything else. You could have cut the atmosphere with a knife.

     

    Believe it or not I actually felt sorry for him.

    Re the Big Tax Case.

     

     

    I am not one for predictions on any blog and am not too keen on those whose opinions constantly tell you what is about to happen based on whispers, innuendo and wild prediction, whilst always recognising that journalists often do have well placed sources who can present them with a scoop long before the story is in the public domain.

     

     

    However, there is just a chance that, very briefly, you will find that the Supreme Court rule as follows:

     

     

    1. That in the case of MIH and Rangers FC PLC, both parties made contractual arrangements with employees whereby they agreed to make standard taxable payments (salary) PLUS separately contracted employment (akin to salary) payments which were to be made to a third party namely specifically formed trusts under the ultimate control of the employees concerned.

     

     

    2. That contrary to the arguments presented by the appellants, this second tranche of payments is not the same as emoluments which are not subject to tax. In other words, the secondary payments made to the specified trusts do not fall into the same category of benefits such as luncheon vouchers, bike loans, season ticket loans and other allowable non-taxable benefits. As a consequence, these payments will be treated as taxable with back taxes plus interest being due on the same.

     

     

    3. Further, the court MAY rule, that in determining whether or not these particular payments are or were taxable, it is not absolutely necessary for the revenue to prove (whether or on the balance of probabilities or beyond a reasonable doubt) whether the trusts set up to receive the payments concerned were or were not a sham or a device to hide just who would be the final recipient of the payments concerned. Instead, the Court MAY state that the test that is to be met is whether or not the payments (any payments delivered in any way whatsoever or to anyone whatsoever) were payments made in furtherance of a contract of employment and as such should be liable for tax and NIC unless the payments fall into a category of payment or emolument which is exempt from such taxes.

     

     

    4. The court MAY say in passing that it is clear in this particular case, that what was intended by the parties (both employer and employee) was that they should enter into a contract of employment whereby the employee was to benefit from (1) ordinary salaried and declared payments which attracted deductions for tax and NIC PLUS (2) secondary payments, which were contractual from the outset, but which would not attract deductions for tax and NIC solely because the method of payment (which did not rely solely on the employer’s judgement or discretion) used to transfer the money from employer to employee. The court MAY also add that such a situation was never the intention of Parliament when it introduced the notion of EBT’s which were designed to deal with a wholly different type of enrichment and benefit as between employers and employees.

     

     

    5. The court MAY make reference to the clear testimony of Sir David Murray in which he made it clear that the whole purpose of this scheme was to enable the football club to employ employees who they could not otherwise afford if they were to be paid by standard or traditional taxable means, and that as such the very means of payment (designed to avoid taxes) played a significant part in determining which employees were to be employed, their rate of pay (overall), the length and terms of their contract of employment and their taxable rate of remuneration.

     

     

    6. As such, the appeal to the supreme court on the grounds submitted must fail, the unanimous decision of the Court of Session will be upheld and the law clarified to the extent that EBT’s, such as they were allowed at the time, were designed to allow employers to gratuitously reward employees with a benefit based on performance during the course of their employment and at the discretion of the employer, but were not intended as a means of rewarding employees as a matter of contract which is negotiated and determined prior to that employee taking up his or her contract of employment in the first place.

     

     

    Just a hunch and not based on any inside knowledge whatsoever!!

Dessy – the OB act like all other affronts to fairness, dignity and humanity – the Guardian act, free university tuition at the expense of £1.2 billion of funding for childrens’ formative education and 240k FE places, the Council Tax freeze which disproportionly benefits those who can afford to pay, the deliberate underfunding of NHS Scotland, the centralisation of the police with disastrous consequences and the unnecessary wasted millions on VAT, the year on year cuts to local goverment budgets which affects those most reliant on council services, the continued failings in farmers’ EU payments – only saved from a multi-million fine by being part of the UK…..as the speed with which the SNP circle the drain increases, they will bloody-mindedly stick to their guns, knowing full well that they are facing wipe-out and a return to their erstwhile place in Scottish politics with their 500k traditional hard-core flag-eaters – we will soon be rid of their one-issue, grievance-laden mantra and thank God, their utter incompetence.
