The football industry is busy with its twice-a-year transfer jamboree this week but there will scarcely be a player, manager or executive in the country who isn’t daily checking on Harry Redknapp’s on-going court case into his alleged tax arrangements.
Harry, of course, is one of the game’s popular figures, everyone likes him, including me, but his evidence yesterday, that he’s been told “The problem with you is you’re named Harry and you have a cockney accent”, will have the nation pondering if he’s another victim of the systemic prejudice against white, wealthy, indigenous-named, senior and successful people from London. There must surely be a support group he can join.
I’m sure Harry’s innocence will be established but the law and tax authorities are right to pursue any doubt that exists in the running of the game, without fear or favour. Where appropriate, pursue the guilty through criminal, not just civil, courts. Only then will the innocent be sure of a level playing field. Lock ‘Em Up, as a Cockney may observe.

I didn’t hear the radio & have idea what darryl said but my taking on the dual contract thing is as follows:
As thing stand rangers are ok. They paid footballers wages as written in contracts given to sfa/spl. Players also received loans from offshore trust but these were not wages or contractual so sfa/spl did not have to know.
Should the FTT find that these loans were in fact contractual & subject to nic & paye, then they become wages at the date of issue. As such they ought to have been declared to sfa/spl at the beginning of each season.
They weren’t so I think these payments are against the rules & that the players may be ruled ineligible. And what happens when you play ineligible players in matches? Think Sion…
Rangers may try & plead ignorance/ innocence in breaking the rules, however the existence of contemperaneous side letters confirming the contractual nature of ebt payments may make this argument too far fetched for even the sfa/spl to believe.

Sounds to me like Darryl King confirmed on Clyde tonight that the Rangers players had a 2nd playing contract covering the ebt and not for image rights like he tried to claim.

Sorry if I’ve picked you up wrong, but just in case.
The EBT doesn’t replace your contract, it’s in addition to it. If your contract says you get £1m a year, that’s what you get. If you’ve told your employer that you’ll only do the job for £1.5m a year, the other 500k could come from the EBT. For the administrators to run the EBT without incurring the wrath of HMRC, those payments are not contracted salary payments, but a loan, nothing in writing, nudge, wink say no more.
If a big fancy dan football star doesn’t like the sound of that, but wants some reassurance that it will be £1.5m he gets and not the £1m in the contract you have given him, you would have to work hard to convince him that all will be as he demands. If the only way a club can find to provide that reassurance is actually put in writing that it’s not really a loan and that he does not have to pay it back, it runs the risk of trouble if HMRC finds out.
All hypothetical, of course.

you are correct and that is the garbled point I was trying to make.
A player is signed by Egg Nog and trumpeted at £30,000 per week. An EBT would be ideal for the player as he is on a realtively short term contract and would receive the loan instead of salary. The requirement to repay the loan falls when the player/employee leaves the employ i.e. at the end of the contract.
However, the £30k per week would not be in his contract. Only the amount that he was getting paid on his contract. I think you are being too generous and I would suggest that the bulk of his contract is paid by EBT. Lets guess £5k.
The employment contract is then submitted to SFA. This either states:
1. £30k and is incorrect and is unlikley as HMRC would have led as evidence.
2. £5k and no one at SFA thinks to challenge that they are paying international footballers at below market rate. Not that there is anything intrinsically wrong with EBT (subject to court challenge – very alledgedly an individual that lives in a house in London with the number 11 on it benefited from such schemes a few years ago).
Scheme blown apart, allegedley, by TFOD confirming in writing that at no point will the loan be repayable.
Hope this makes more sense.
