It’s good to be back.  A power outage at our datacentre on Saturday caused servers to crash and subsequent database problems.  Our thanks to Andrew in Belfast for his invaluable help, again…

Trying hard to ignore speculation of various players coming our way, plenty of time for that later in the month, although I will add a note of caution.  The fact that a journalist gets confirmation from Neil Lennon that he is able to sign a £6m player does not constitute a promise to do so.  It’s little more than bait, for those who still read such sources.

I’ve heard nothing but good things over the years about Georgios Samaras.  He is a player who flourishes on confidence, and support, and does so most often at the highest level.  In Europe he is Celtic’s out-ball, a player capable of bringing others into the game, turning defence into attack.  It is at this rarefied atmosphere that his goal-scoring has also been most effective.  Ironically his style is less effective in the SPFL, where Celtic spend far less time 80 yards from goal.

A considerable reason for the low return in the Champions League this season was that everyone knew how reliant we’d become on Georgios.  He was heavily marked; by the time the ball got to his feet, three opponents triangulated around him.

It’s no surprise he has offers from Spain, and no doubt elsewhere, to consider. If he leaves I hope his lasting memories will be cheers of support, not his harsher experiences.

    If ” criminal intent” is, indeed, an essential ingredient under the Act before a conviction can be made, then the Sheriff was probably correct in his judgement. The question now is: How can ANYONE be convicted under this truly inept Act (or is it a Bill? What is the difference?)

    The OB Act states:

     

     

    “6Threatening communications

     

     

    (1)A person commits an offence if—

     

    (a)the person communicates material to another person, and

     

    (b)either Condition A or Condition B is satisfied.

     

    (2)Condition A is that—

     

    (a)the material consists of, contains or implies a threat, or an incitement, to carry out a seriously violent act against a person or against persons of a particular description,

     

    (b)the material or the communication of it would be likely to cause a reasonable person to suffer fear or alarm, and

     

    (c)the person communicating the material—

     

    (i)intends by doing so to cause fear or alarm, or

     

    (ii)is reckless as to whether the communication of the material would cause fear or alarm.”

     

     

    The guy’s excuse was he only intended his pals to see it! On a public forum. Surely that’s got to come under 6(c)(ii) at least.

    I honestly & personally don’t think the idiot’s tweet could be intending or reckless to whether it would cause fear or alarm because it was a private message.

     

     

    However, if Christopher Hay was prosecuted under the (arguably the lesser charge) Communications Act 2003 Section 127

     

     

    127 Improper use of public electronic communications network

     

     

    (1)A person is guilty of an offence if he—

     

     

    (a)sends by means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character; or

     

     

    (b)causes any such message or matter to be so sent.

     

     

    (2)A person is guilty of an offence if, for the purpose of causing annoyance, inconvenience or needless anxiety to another, he—

     

     

    (a)sends by means of a public electronic communications network, a message that he knows to be false,

     

     

    (b)causes such a message to be sent; or

     

     

    (c)persistently makes use of a public electronic communications network.

     

     

    (3)A person guilty of an offence under this section shall be liable, on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale, or to both.

     

     

    (4)Subsections (1) and (2) do not apply to anything done in the course of providing a programme service (within the meaning of the Broadcasting Act 1990 (c. 42)).

    He would have been found guilty under (1)(a) i.e. A person is guilty of an offence if he sends by means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character.

     

     

    The Police and the PFs insistence in using the unworkable “Offensive Behaviour at Football and Threatening Communications (Scotland) Act 2012” is now causing miscarriages of justice in the other direction. People who should be convicted are getting away with it.

    The Club Financial Control Board ( previously Panel) most certainly have powers. Without them they would be as much use as a chocolate teapot.

     

     

    They were told something about the wee tax bill at 30 June checkpoint that does not stack up against Sherriff Officers calling to collect 6 weeks later.

     

     

    Getting at what UEFA were told and what the SFA did to check what UEFA were told is going to be a challenge because of the confidentiality that covers all clubs during the licensing process but at east we know where to look to establish if the resolution is indeed unnecessary.

    I have the same feeling they would be happy with a few heads, as for meaningful change, no gonna happen, we all know it.

     

     

    If uefa get involved, which I doubt, the last thing they would want is any sort of scandal, if they do, and the sfa are punished, well and good, but if the clubs were to be excluded from uefa comps as a result, I imagine the club would then come alive.

    Can anyone explain what happens if they go to 1p or that low? Can the shares become worthless and would that trigger an insolvency event even if the club was still balance sheet solvent?

     

     

    Is there a threshold for the price of shares to go on a PLC and some form of action is taken, being struck off for example?

     

     

    Know it’s not likely to happen, but just curious.

    I was puzzled by the connection between Res12 and the 5 way agreement being made but I can see it now.

     

     

    Read the Res again. It is NOT about the 5 way agreement it is about how the UEFA licence was granted and subsequently monitored.

     

     

    The other points were back up to support the support dissatisfaction but they were not why the. Resolution was tabled.

     

     

    The Res focussed on the licence issue because unlike any of the other points Celtic shareholders had a point. that their shareholding might have been negatively affected in money terms by specific and well documented rules not being properly followed by the SFA something that cannot be said about the other back up items.

     

    Had the Res led on the 5 way which no one had seen or any of the other points then Celtic would have said it is outside their power and remit to accept a resolution that other clubs also have an interest in and view on and quite right too.

     

    Had the positions been reversed we would have been incandescent at our rivals sticking their nose into our business.

     

    The resolution is in the first para,it reached the AGM agenda precisely because shareholders had raised a point that only affected Celtic. Celtic thought it unnecessary but on hearing the argument agreed to an adjournment because there was enough info presented to suggest that Celtic’ stance was not fully informed.

     

    As to your point ‘re secrecy, we are playing poker here, have a better grasp of the issues which is our winning card and would be daft to show our hand where it would be open to the same misinterpretation you gave the Resolution.

     

    However that does not mean that folk interested in Celtic ‘s welfare cannot have a peek at the cards and you can get a look if you email me via Paul.

     

    The hand looks a good one BUT the SFA know the rules game and might trump our hand if it is not as good as we think or we misplay it.

    Samaras never been my cup of tea I accepted his loyalty to us when he could have gone a few years ago ( I heard he felt he owed us because if that penalty miss at IPox ??) I just don’t get what he contributes over 90 mins and more importantly over a season. A few we flashes are just not enough Good luck to him I wish him nothing but love – but just not good enough for me.
