Scottish football cannot be haven for lawbreaking

625

I enjoy Roddy Forsyth’s articles and broadcasts but I’m staggered at today’s article in The Telegraph. The initial headline read “Scottish clubs fear bankruptcy if Rangers are stripped of titles for tax avoidance”, but was amended to “SPL (sic.) clubs fear they will be hurt financially themselves if Rangers stripped of titles”.

Justification for this claim lies with the fact that clubs who lost a cup final to Rangers during their tax evasion (not avoidance) era, may have to pay a win bonus to players, which would be enough to tip them into bankruptcy.

These clubs would, we are told, prefer to sit tight as runners up, than be awarded a cup win. One chairman told Roddy, “Celtic might be able to afford that but nobody else could”.

Nobody else could afford a win bonus, so let’s not impose the unwelcome burden of winning on them!  Consider what that makes supporters of these clubs!

Another chairman told Roddy, “my view is that the EBT scheme was questionable and maybe even reckless from the start but they were given expert advice and they acted on it”. “Questionable”, “reckless”, I think the word you’re looking for is illegal.  Paul Baxendale-Walker’s expert advice was only one aspect of his flamboyant commercial undertakings.

Documentation was also hidden from HMRC, the SFA and SPL, and as ‘Mr Black’ told the Tax Tribunal, the ruse was designed to recruit better players.  Who win more trophies.

Falkirk, Queen of the South, Dundee, St Mirren, Dundee United, Motherwell and Ayr United all lost finals to an EBT-fuelled Rangers, as well as Celtic, of course. Let’s hear from any of them who don’t want the matter formally examined.  And let the door slam on their backside on the way out of competitive sport.  Forget what’s happening in Russia, this is going on TODAY in Scotland!

If any of these clubs are campaigning for Rangers to keep their EBT trophies, it’s important their fans know about it.  Roddy doesn’t suggest his two chairmen-sources come from any of these clubs, in fact, he describes them as “SPL” chairmen, the former name for our top flight.

So who are they?

Celtic, Aberdeen, Dundee United and Hearts can all be excluded from consideration.  Think what you like about any of these clubs, but I cannot imagine any of their chairpersons considering this nonsense.  Which leaves:

Kilmarnock.  Michael Johnston is no longer chairmen, that role is fulfilled by Jim Mann.

Partick Thistle: David Beattie.

Motherwell: Brian McCafferty.

Inverness: Kenny Cameron.

Dundee: Bill Colvin.

Hamilton: Les Gray.

Ross County: Roy MacGregor.

St Johnstone: Steve Brown.

To the horror of Accies fans, in 2012 Les Gray said “SFL clubs should not be put in the position to vote on something which may destroy Scottish Football”.  I wonder what Les is saying off the record now.

The Brown family have chaired St Johnstone through many issues, but their fans were off the mark quickly in 2012 to let Steve know their thoughts the last time Scottish football faced a decision to follow the rules, or not.

Roy MacGregor bristled with irritation when others tried to influence him in 2012.  He has a reputation of knowing his own mind.

I don’t know anything about Bill Colvin, Kenny Cameron, Brian McCafferty, David Beattie or Jim Mann, but I suspect the names of both Roddy’s chairmen are on this page.

You’ll never read a better insight into why corruption was allowed to fester in our game than the glimpse available in today’s Telegraph, or that it remains endemic.  Scottish football cannot be a comfortable haven for lawbreaking.

” We would still have signed players of equal abilities if one or two had decided they didn’t want to sign under different financial circumstances.”

What, therefore, was the reason for using EBTs? ( According to Glibby, it was to save money for the Company and the shareholders.).

The side letters stated that the club would take responsibility if HMRC came calling and pay the due tax.

Now that thems liquidated, who knows, maybe TBB’s and Auldhieds would know.

Apparently, the employer paid sums to a Trust. The Trustees set up individual sub trusts and provided loans to those Trusts, effectively money to the players. The loand could only be called in by the Trustees. I think.

    Britain’s biggest-ever sporting scandal.

Rangers cheated on an industrial scale, then lied about it in court.

Three law lords ruled last week that football in Scotland was rigged for 10 years, in favour of one team.

    It’s amazing.

One football club in Scotland, Rangers, chose apartheid 90 years ago. It chose to become a right-wing, bigoted, anti-immigrant, supremacist figurehead. The Establishment Club.

It coined a sectarian employment policy – no Irish, no Catholics – and for 90 years none of the governing powers in Scotland so much as batted a fucking eyelid to that.

Because Rangers was just the sporting manifestation of the status quo.

“There’s an air of Protestant supremacy about the place,” smiled Rangers manager Walter Smith in 1999. On record.

Not one Scottish journalist asked him what exactly he meant by that. The horse gets used to the bridle.

If you were Irish, or of Irish parents, growing up in Glasgow, you were left in absolutely no doubt that you were the underclass, tolerated so long as you kept your mouth shut, and beaten up if you didn’t.

Future generations may wonder why it took so long before such an obviously-toxic and unsustainable entity as Rangers withered and died.

For me, they arrogantly thought they were Scotland -We Arra Peepul – but I do hope that my country is a wee bit better than that.

I hope Scotland moves on and joins the 21st century.

To do that, it will have to leave behind Rangers and everything Rangers stands for.

  17. Sipsini

In my opinion…I can’t think of anything at all that SDM would gain by an having his name anywhere near an appeal on something for which he is not liable. That’s why he sold it to Whyte for a quid. He wanted shot of it before the roof fell in. Now he can say with a blank stare “I ran the club in it’s most successful (ahem) period.” Back to the future would mean he was blindfolded in a minefield.

Now if he had an indemnity clause in his contract from the club/business for any legal matters then ensued from his role with them, then maybe he’d sleep better at night…

Oh wait..isn’t that what Charls is saying to Lord Doherty.

Murray has just melted away from his busted 690 million-in-debt-to-HBOS empire with millions in his pocket (6.3M from EBTs) and his family now own Alexanders the bus people as a profitable family owned concern.

    Murray, Whyte, Green, King…

There’s a thread running through that list…now what can it be?

    Hope you are well.

I would have thought that the statement today will have angered a few suits around the clubs, and I would wager they are talking to each other.

First thing to say is that some brilliant stuff written this week on them, not least by P67. This week feels very significant to me. It seems that the whole crumbling edifice of corruption between RFC, Sevco, the banks, the football authorities and the mainstream media is finally falling completely apart. I am increasingly confident that justice will now be properly served and that enough fans and clubs in Scotland will demand that it is seen to be done. The traditional convention that Scottish football exists only for the purposes of Hun supremacy is going, going and hopefully soon to be gone forever. Davie Boy’s statement tonight wreaks of the dying days of the ancien regime before the revolution. Threats from a position of weakness, reminding clubs they have a fiduciary duty to their clubs to make sure “Rangers” are strong enough to win…

Consider the vast forces and threats ranged against them and their acolytes in the press’s narrative that this is same old club, well on the path to restoring its rightful place as the dominant force in Scottish football and sporting culture:

    – EBT appeal is lost to HMRC.

    – Title stripping campaign is gaining momentum, supported by the largest clubs in the country and their fans.

    – Charles Green’s potential legal fees present an existential threat to the new club.

    – His advocate points out in court that not paying Chuckles’ legal fees presents an even more existential threat – that the transfer of assets post-liquidation would constitute the proceeds of crime were Green to consequently be convicted.

    – Charles Green himself is now supporting a legal argument that destroys the myth that Rangers and Sevco are one in the same. That’s from the creator of Sevco no less.

    – Mike Ashley has bided his time and is now striking at King’s moment of greatest weakness – a merciless corporate beast determined to destroy you can’t be a comfortable place to be.

    – Ashley has appointed himself to the Board of Rangers Retail.

    – King faces contempt of court proceedings at Ashley’s behest that may see him jailed.

    – Ashley has initiated proceedings against the SFA re it’s determination that King passed its fit and proper test.

    – Oh, and lest we forget, their accounts confirmed Sevco are in dire financial straits and at risk of going under even if all of the above didn’t apply. Huger over leveraged…. Again!!

There are so many fundamental threats both to their narrative and very existence that it’s hard to keep up. Yet what we get is the old No Surrender defiance and associated media compliance. These guys in our press have no shame and no professional pride. Their industry is deservedly dying as a consequence. The press in Scotland always relied on football to sell their papers. The industry has failed to keep up with the times, both in terms of technology and the democracy enabled by social media. No one believes what they write any more. The party’s over. Justice will be done.
