Sine die Murray for Rangers lying and cheating

953

“The appeal is dismissed.” With those words at the Supreme Court in London at 9:52 this morning, Rangers tax cheating was established as fact. The charlatans who manipulated Scottish football fans were shown to be the disgrace they are.

Rangers made unlawful payments, totalling many millions of pounds, to footballers, who, by the club’s own admission in court, they would have been unable to recruit if they had to pay tax and National Insurance contributions for.

They lied to HMRC.

They also hid documents from HMRC, which only came to light during a City of London Police raid on Ibrox.

They hid documents from the SPL and SFA, failing to honestly register dozens of players.

They cheated the tax man.

They cheated the welfare state, the NHS, the police, councils, schools. They cheated the Army and other services.

The SPL’s (now called Scottish Professional Football League) Commission into these matters must now be set aside. It was conducted on the assumption that Rangers acted legally. Lord Nimmo Smith was clear that his conclusions were predicated on this point.  A fresh commission is required, we cannot just allow the biggest cheats in British sporting history wander off into the distance.

The SFA has failed to call Sir David Murray to account, or the other directors of Rangers, who had explicit responsibility to ensure the club acted within the laws of the land and within the rules of football, both of which it failed to do.

Murray should be sine died. God knows, I cherish every moment Dave King controls things at Ibrox, but he was a director of Rangers with legal responsibility for its actions. They should all be censured.

    PMarsh22 and others,

I’m wondering the same. Are both Rangers (In Liquidation) AND the beneficiaries of the EBT scheme liable to HMRC, for different taxes – PAYE on the part of the employer, and Income Tax on the part of the beneficiary?

  2. GlassTwoThirdsFull on

If the players are chased by HMRC for the tax it shouldn’t be a problem for them. They will have the money set aside to pay back the loans. They were loans after all……

Yes I saw that comment on the BBC website earlier this morning and was bemused by it.

My take on it is that Parliament was already introducing legislation saying that if you received a “loan” from an EBT you would have to repay it or pay tax as of 2019.

What Chris McLaughlin seems to be saying is that by ruling that RFCPLC were due to have paid the tax, then HMRC will have to chase the company at first instance and so if HMRC receive x in the £ by way of the appropriate tax then this will reduce the sums claimable from the beneficiaries of the loans.

That may be correct or it may be wrong but there will still be a knock on the door of players and others for some amount of tax — at least according to a leading tax adviser who I was talking to recently.

On a completely different note — I wrote this following the FTT decision in November 2012.

It is a long read, and at times a little forensic, but it set out my thinking on what the FTT did and said and in particular why that decision would come back to bite MIH and Rangers one day.

I have also long said that the LNS decision will one day become a weapon of destruction as far as Rangers are concerned.

More than ever, I believe that to be the case.

  11. Titles and Cups to be stripped, that’s probably a given. But what about the enormous can of worms this opens on European games and International games played by players who were involved. Would UEFA and FIFA be willing to use the tin opener? This is where the SFA are in cahoots with those in the European and World stage, there may not be the appetite, and who could blame them, to venture forth with this, por cierto.

Macjay, I think you misunderstand me. I’ve no idea how long you’ve been in Aus and for all I know you may have been there throughout the whole known EBT cheating period and may have lost nothing in a financial sense.

But you demanding Celtic supporters who now know they were cheated to “give it a rest” doesn’t quite cut the mustard.

I’ll be writing to Celtic and discarding you’re sage advice.

  14. This is a once in a lifetime opportunity to reform Scottish football and get the SFA to clean up its act. That means clearing out the corrupt blazers and those in authority who presided over cheating either by being complicit or by simply turning a blind eye STRIP THE TITLES.

Celtic, and the other associate clubs (sevco excepted for obvious reasons) the ball is no firmly in your court.

I see Alex Thomson tweeting that Reagan and Doncaster’s positions are now untenable well that should also go for RC Ogilvie and his cohorts in UEFA.

Rumour on twitter that there will be a statement out of Hampden today attempting to put a dampener on title stripping. I would doubt this as it would be a PR disaster given the way people are feeling at the moment. It would only serve to fan the flames.

  18. Someone should point out out to UEFA that their position on FFP is untenable as long as Ogilvie retains a position with them.

He has failed to pay his social taxes

  19. I expect a future blog from Paul67 will give us an idea as to how the Celtic board are going to deal with this

Aberdeen supporters on the Aberdeen chat forum are very much of a mind for title stripping with one contributor asking

“Who’s coming out tonight to celebrate our 1999-2000 Scottish Cup win?”

Ha ha, get the titles stripped.

  22. TTR

I would imagine this will have been planned for in advance, under the what if scenario of the HMRC judgement being upheld, but did they discuss this with the clubs and does it carries their approval. f it has and does the supporters need to take action against their clubs.

  23. from hibs.net

    ——————–

This can’t be dismissed as a Rangers/Celtic thing.

Every Hibs fan and every supporter of every other top flight club put their hard earned cash into a rigged game for years. The authorities are complicit in sweeping this under the carpet.

This is THE biggest scandal in British sport in our lifetimes and people are shrugging their shoulders. I don’t get it.

    ———————–

It’s definitely not a Rangers/Celtic thing. I was at Easter road and had to watch as they celebrated on our pitch winning a title in the last minute of the game when every single player and their whole management team was being paid illegally through EBTs. You can’t be a sports fan and just let that stand.

Rules are there for a reason and they have to be applied to all clubs.

The rules state that if a player is not registered properly then the game is forfeited 3-0. This has to be applied to Rangers just the same as its applied to Spartans when they were kicked out the Scottish cup for missing a signature.

If we are saying that Rangers have different rules then why bother going to watch football at all?

BBC are an absolute disgrace with this “club owned by a different company” guff. Even worse they give work to halfwit EBT recipients like Thompson, Ferguson and Rae. And they make you pay a licence for it!
