Strict liability when playing to gallery

Being responsible is not always easy, especially when it comes to running a football club, where playing to the gallery offers vastly better short-term returns, and no doubt a rush of endorphins.

If your fans are engaged in an activity which regularly brings them to the attention of the courts, and your club into disrepute, it doesn’t matter what you think of the apparent offense.  You may chant an offending song in the shower every morning month, but your only public comment on the matter can be to chastise and urge fans to desist.

Clubs in Scotland voted against what is known as strict liability.  This means they are not held responsible for transgressions by their fans – and who wants to be held responsible for the actions of others who protected from personal liability by hiding in a crowd.

Part of the deal on not having strict liability is that clubs must demonstrate that they take all steps necessary to dissuade and educate their fans from carrying out criminal or regulatory offenses.  It’s simply not possible for club to tell fans their illegal actions were justified, as this would place the club itself in the firing line.

The nonsense following the Scottish Cup final is all background noise as far as we are concerned, but be aware the contagion will spread beyond those you could consider highly dysfunctional operators.

    Oh one more thing, there is no need to wait for HMRS’s determination of the outstanding tax, it is the responsibility of the tax payer to calculate and submit it, awaiting the determination was anothe squirrel to try and create confusion.

    Yip. TOG also note that assorted clubs have been sanctioned for not declaring a future tax liability – one that is yet to crystallise, let alone one that fell due many years previously.

     

     

    I agree in principle with the TOG opinion, but it’s arguable, and doubtless, will be argued.

    The English FA Cup final was a 5.30 kick off. BBC SCotland had to curtail their coverage (just as ‘Sunshine on Leith’ was beginning) so they could switxch to Wembley. I was watching all of this and would guess the cuo presentation was around 5.20pm. Or within 5 minutes eiterh way. So about half an hour after the final whistle.

    It’s interesting… seen a comment in defense of the Craig Whyte defense…

     

     

    It went summit like this…

     

     

    It’s nothing… it’sequivalent of filling out you Driving Licence application and saying you have no medical conditions that would bar you from getting the Licence.

     

     

    When I read it, a few of points occurred to me…

     

     

    Firstly, the attitude that if someone makes it easy to lie, then it’s kinda their responsibility if you do. Where I was brought up with this being the worst shame. If you lied/cheated/conivved when you were “on your honour”, that was the worst kind of deceit.

     

     

    Secondly and more importantly, the imperceptiveness of it all…

     

     

    Furinstance, say I was epilepic, I have, for the first time since my diagnosis had to apply to renew my Driving Licence…

     

     

    Well if I tell the truth I lose my Licence, my job, what about my Family… Well you could see how someone could be tempted…

     

     

    Now here’s the thing, it’s one thing to lie, it’s a totally different matter when you’ve been Found Out.

     

     

    That’s the point with Res 12, it’s not the initial lie that’s at play here, it’s the consequences of being Found Out. There has to be repercussians or the whole things a nonsense.

     

     

    Let’s look at the Driving Licence scenario. I’m driving along a busy Street on a lovely Sunny afternoon and I have a siezure…

     

     

    I mount the kerb, take out a Bus shelter and severely injure some waiting passengers.

     

     

    Now then, I get Found Out, my Insurance Company doesn’t pay out ’cause I lied to them, I have a huge bill for damages to injured people and street furniture. The DVLC take a dim view and I’m banned and to top it all the Polis do me for GBH and a host of other things.

     

     

    So for me, the Craig Whyte defence and the mind set that condones thid is wrong. The initial lie is bad enough, but once you’re Found Out there HAS to be CONSEQUENCES.

    As a long-term resident (sometimes prisoner) of the parish of St. Bernard’s, Shawhead, I was one of those who was dismayed at the name change. Didn’t stop me drinking there though! WAY more mirrors than The Big Tree… :-)

  28. Good afternoon, enjoying a quality cider in the garden after sorting out various pots and hanging baskets. Just the one though, as 5pm vigil mass beckons. Got the 5k done in my anticipated time; as expected Jobo is about 8 minutes ahead of me but I think I have a good 15 years on him so I will rest easy.

     

    Looking forward to CL final tonight, great to see Big Billy with the cup installed in the Champions Way in central Milan. What a tribute. Fancy Atleti to do it in 90 minutes, 2-0. Will be having some Tapas to set the mood after vigil Mass.
