Strict liability when playing to gallery

2207

Being responsible is not always easy, especially when it comes to running a football club, where playing to the gallery offers vastly better short-term returns, and no doubt a rush of endorphins.

If your fans are engaged in an activity which regularly brings them to the attention of the courts, and your club into disrepute, it doesn’t matter what you think of the apparent offense.  You may chant an offending song in the shower every morning month, but your only public comment on the matter can be to chastise and urge fans to desist.

Clubs in Scotland voted against what is known as strict liability.  This means they are not held responsible for transgressions by their fans – and who wants to be held responsible for the actions of others who protected from personal liability by hiding in a crowd.

Part of the deal on not having strict liability is that clubs must demonstrate that they take all steps necessary to dissuade and educate their fans from carrying out criminal or regulatory offenses.  It’s simply not possible for club to tell fans their illegal actions were justified, as this would place the club itself in the firing line.

The nonsense following the Scottish Cup final is all background noise as far as we are concerned, but be aware the contagion will spread beyond those you could consider highly dysfunctional operators.

Solving Kids Cancer in memory of Oscar Knox

Our own Bundoran Bhoy will run the Edinburgh Marathon on Sunday on behalf of Solving Kids Cancer.  He has put in an enormous amount of work ahead of the event, for a cause which you are only too familiar with.

26 miles is a long way to run.  You can give him some encouragement on his Just Giving page.

Good luck, Tommy.

  1. A persistent belief is that “the King” did not die in 1977. Many ‘big fans’ persist in claiming he is still alive, that he went into hiding for various reasons.

This claim is allegedly backed up by thousands of so-called sightings e.g.down the chip shop etc. The main reason given in support of the belief that Presley faked his death is that, on his grave, his middle name Aron is spelt as Aaron.

But “Aaron” is actually the genuine middle name for Presley. Apparently, either Presley or his parents tried to change the name to “Aron” to make it more similar to Presley’s stillborn twin, Jesse Garon Presley.

The list of jfk’s enemies was long. And that’s not even including his poor wife.

Khrushchev would be far from the top of my list of prime suspects despite Oswald’s time in the Soviet Union.

That’s not to discount the KGB or their military equivalent the GRU. Two entities with very distinctly different agendas from Khrushchev within the complex and murky world of Soviet politics.

US military industrial complex had much to fear in jfk’s Vietnam ambitions…or lack of.

And his former pals in the mafia who helped secure his narrow victory must have felt let down when he allowed their prosecution.

Truth? I don’t know. But strongly suspect not Khrushchev.

  8. In order of priority for shooting:

    1. The manager who could not kid proof an enclosure. IT’s a zoo. Kids frequent. Many are wilder than the animals.

    2. The parents of the wee sh*te that sneaked into the enclosure. Kids can be sneaky and it’s difficult to control them all the time BUT YOU WERE IN A ZOO.

    3. The wee sh*te. He is only 4 but he is American and safe to assume spoiled rotten. Shoot the parents again too just be sure.

    4. The ape. Last resort and no need if 1, 2 and 3 taken care of.

While we’re on a shooting spree I’d shoot the editor of ITV news who only showed the bit where the ape helps the wee bot to his feet. Only seen online, the part where the ape rag dolls him through the water is utterly terrifying. Any parent in the land would have shot it once that situation started to unravel.

I haven`t a clue about who was involved in the conspiracy .

But the Soviet / Cuban connection to Oswald is proved.

Why was he murdered by a Jewish strip club owner who was dying of cancer and knew it ?

Ergo , nothing much to lose.

Probably to shut him up. Just supposition though. But reasonable supposition.

  19. Many of you should read James Ellroy’s American Tabloid, The Cold Six Thousand and Blood’s A Rover trilogy.

  20. I can’t contribute much on the Kennedy assassination as I haven’t read enough about it, although the conviction of Oswald was clearly dodgy. However, I read a book called An Act of State by William Pepper, which covers the Martin Luther King assassination, and it’s a fascinating read. This is a summary from Wikipedia –

    Martin Luther King cases

Martin Luther King Jr. contacted Pepper after seeing a photo essay Pepper had published entitled The Children of Vietnam published in the January 1967 issue Ramparts magazine depicting victims of napalm in Vietnam.[4] Pepper later stated that the contact contributed to King’s more adamant position against the Vietnam War. Pepper was present at King’s April 4, 1967 Riverside Church speech in which King launched a strong campaign against the war.

Pepper thought that King’s assassination was part of a government conspiracy and became James Earl Ray’s last attorney. He postulated that Ray was framed by the FBI, the CIA, the military, the Memphis police and organized crime figures from New Orleans and Memphis. He publicized his position in books and represented James Earl Ray in a televised mock trial in an attempt to get Ray the trial that he never had. Ray was found not guilty in the mock trial, though actually convicted of King’s assassination.

Through his writing, King’s son, Dexter King, took up the cause to prove Ray was innocent. Dexter met with Ray on March 27, 1997, at the Lois M. DeBerry Special Needs Facility, during which he said that he believed Ray was innocent.[5]

Following Ray’s death, Pepper represented the King family in a wrongful death lawsuit, “King family vs. Loyd Jowers and other unknown co-conspirators”. During a trial that lasted four weeks, Pepper produced over seventy witnesses. Jowers, testifying by deposition, stated that James Earl Ray was a scapegoat and not involved in the assassination. Jowers testified that Memphis police officer Earl Clark fired the fatal shots. On December 8, 1999, the Memphis jury found Jowers responsible, and also found that the assassination plot included “governmental agencies.” The jury took less than an hour to find in favor of the King family for the requested sum of $100.[6]
