Summary of Rangers situation

1379

In response to some of the more excitable comments from yesterday it might be worthwhile painting the possible scenarios for Rangers.

No Sale

If Bill Miller is unable to complete the sale (remember, he’s not even paid the deposit and has no intention of doing so), the club will reach the end of the season and run out of money.  It will then either expire completely or Duff and Phelps will try to cut a deal with Ticketus to allow Rangers to sell season tickets and retain more of the money than they are currently due.

Rangers could continue to operate in administration for a while to come; Motherwell were in administration for one week short of two years.  The club would be unable to afford player wages after they return to normal in 1 June so would be forced to pare the squad back, whether the ban on player registration remains or not.

Miller completes purchase and the SPL vote him into the league

If Miller completes his purchase, as it stands, the SPL board will have discretion to transfer an insolvent club’s share in the league to a Newco.  Neil Doncaster has pinned his colours to the mast on this issue, Steve Lomas explained St Johnstone’s willingness to also vote Newco in.  Celtic will vote against which means if either Motherwell or Dundee United vote in favour of Newco, they will be allowed into the league.

I have no doubt that both Motherwell and Dundee United will vote in favour of Newco.  The SPL will vote to introduce a new procedure for dealing with Newco on Monday but it’s far from clear this proposal will get enough support.

For Miller, there are complications with this issue.  He would inherit all football and financial penalties due for Rangers and would also be expected to pay Rangers football debts – around £3.5m.

You can largely ignore the £160k Fit and Proper fines from the SFA but the SPL inquiry into Improper Registration of Players for over a decade will be the biggest charge in the history of British sport.  We should be looking at fines commensurate with the financial benefits accrued and multi-year sporting punishments.

If the SPL rule amendments Newco are rejected on Monday (as I expect), there are some who are concerned SPL board will impose lighter penalties than those suggested by Neil Doncaster’s new rules.

Alternatively, Miller could tell the SPL to stuff it and apply to the Scottish Football League.  Ally McCoist has already threatened this in response to the already-imposed fines and the notion is popular among Rangers fans I know.  If the did this, Newco would not have to pay Rangers football debts and would be subject to no penalties or player registration bans.  They could budget for three years of lower-league football and then tool up for the summer of 2015.

You can expect some though talking from Rangers on going to the Third Division in an attempt to spook the SPL into offering limited, single-season penalties.

Among the many unknowns, we can be sure of a few things:

Rangers Football Club, established in 1872, is finished.

Some form of phoenix will happen, if not for next season, then probably by 2013.

The SPL will complete the inquiry into Improper Registration of players, whether Rangers exist or not.  If a Newco is granted Rangers SPL share, penalties will be punitive.

Notions that ‘Rangers’ are going to emerge debt-free, strong and able to compete as though nothing has happened is simply nonsense.  Their club is dead.  They will start a new club, it will either be back in the SPL unhindered in 2015 (or 16) or will be in the SPL next season, heavily burdened for many years to come.

My prediction is for the latter.

Just a wee thank you to all on CQN who sent me messages of support for my campaign to be re-elected to Glasgow City Council.

I got back on the first ballot and so did 1 of my Labour colleagues the 3rd Labour member was elected before the last Nat.

Labour had a fantastic day in Glasgow the amount of Tims who commented on what Salmond has been up to with RFC was very interesting and they say young people dont care about politics.

I have had the pleasure of hosting a Civic Reception in the City Chambers for the Thai Tims which made me so proud and to be able to enjoy that occassion with so many posters from CQN and the other strands of the Celtic family Paul Lennon and those kids make me feel truly humble. I then made my daughter’s week by getting the Thai Tims to come to her school in the East End.

It has been a great week and I still have tickets for the Thai Tims in the Concert Hall. Thanks all once again for all the messages of support

“The registration rests with the club, not a limited company,” said the source. “There is a question how you define a club but, if a newco acquired the league share, it would be the club.”

So, if they don’t want to be transferred to newco, might the players themselves challenge the right of the club to be recognised as the same club?

If they are not considered the same club for TUPE purposes, could this be applied for history, league share etc?

The article seems to say that IF they get the league share then they are the same club as before. If that were challenged by players who want to go, would it prove the licence should not have been granted?

OMG…….even keevins saying the gers should be punished…..?

They have used 2 contracts in an ebt scheme from 1998 to 2012.

During this time it allowed them a financial advantage over 11 teams in the spl and in europe.

This allowed them to win the spl and cups which gained them more prize money.

    yeah we all know this.

    But why….?

The reason why they done all this was because there was a sporting challenge which came from celtic under martin oneil .Which stopped their spl wins and euro champions league involvement. Also reducing their cash flow.

At the end of the day SDM and ra gers could not handle second.

And where prepared to do anything to come first.

So now all the msm and the sp/sfa are wanting ra gers to be allowed to stay in the spl and with minor punishment.

And their whole ethos as to why thery should be allowed in the spl is to make it more of a sporting challenge to celtic imho.

FFS…….they have already had 14 years and £134 million pounds of an advantage and they want another go.

ernie and james forrest have posted today regards their views and how celtic plc and the fans should react.

Well we have all had a great laugh at save ragers .com and the ra gers fighting fund.

Well the biggest laugh might be from the huns as they are shoe horned back into the spl debt free and with sfa and mib assistance.

While we wait on the celtic plc to issue a statement ?

If that statement never comes …..then we all know the answer……?

And any choice we make will be as individuals

Just pray that the plc are well advanced in thier plans, which is no fault of their own that the huns were prepared to go bankrupt to beat us.

Going back to justice and sporting integrity

The whole case requires a fitting punishement for 14 years of cheating and the game must continue at the expense of finnacial gain or we will be back in the same situation yet again.

The love of celtic and everthing it has achieved and stands for will always bring the ups and downs. But for some fans or supporters it will be the end if 1 club is allowed to cheat and escape punishement to keep a football(money) CARTEL going.

The Old Ship Bank brings back memories. My family had 2nd hand clothes shops in The Briggat and Saltmarket, we used to go down there most Saturdays when I was wee and I remember occasionally being allowed to sit in the corner with a packet of salt and vinager and a can of Vimto listening to my elders discussing Celtic, religion and politics.

I discussed the meaning of the word club on RTC today.

    See here http://t.co/VTC631Kc

very big difference between “Club” and the owner or operator of the club.

With Tupe there will be a key difference between the two as the registration might be held by the club, but the actual contract of employment is likley to be with the Limited company that is Rangers PLC.

Also, is Miller actually buying the business as a going concern and will TUPE apply?

He sure as hell is not taking over the PAYE registration of the existing company, nor the VAT number……. so I think there is every chance that the players can in fact walk away.
