Whitewashing in the age of Judicial Reviews, fans united, we’re gonna do it anyway

588

Mike Ashley’s petition for a Judicial Review of the processes the SFA followed when finding Dave King fit and proper to run a football club is a lightbulb moment. The decision, taken by the SFA board, was not unanimous. I am sure some pointed to King’s enormously controversial past and alerted supportive voices of the potential for trouble ahead.

The dissenting voices were voted down, but just like Heidi Poon, their unwelcome guidance will ultimately be found to be assured.

What Ashley has demonstrated is that anyone can ask for a Judicial Review. CQN’ers could ask for one into the scope, probity and remit of the Lord Nimmo Smith Commission, for example. I discussed this some time back with an advocate who suggested we hold tight.

The SFA and SPFL must tread carefully, they are no longer in control of events. It would be wise for them to wait until the Supreme Court appeal notification deadline passes before choosing any path.

In the meantime, whoever decided to fan the flames by launching the “no appetite” blocking strategy should calm the waters. There is enormous appetite to look into what many within and outside of Scotland are calling the biggest cheating scam in British sport.

People are angry right now, not at the cheating they have suspected for years, but at the authorities attempt at whitewashing.

There are demonstrations and boycotts being discussed. Millions of words have been written.

Groups of Celtic and Hearts fans are becoming unnervingly cooperative, good grief! See what you’ve done, Mr “No Appetite” man? Supportive understanding is NOT how I usually relate to Hearts, Hibs, Aberdeen, United or Dundee fans. Even Motherwell fans!

Before we get Labi Siffre records back in the charts…

Before the PPI industry start sending “Is there a Judicial Review you’d like to instruct” recorded messages to our phones….

A calming word from the SPFL, in the first instance, should be issued. All it needs to do is acknowledge the Court of Session verdict, and that the notification deadline for a subsequent appeal has not passed. This would commit to nothing, but it would also supersede the earlier attempt to whitewash, and perhaps allow some to get back to doing their day jobs.

For the record, a whitewash will simply not be possible. The fan-mechanisms, honed in 2012, are fired-up. We’re gonna do it anyway.

On Ashley, I’ve said this before about him, our enemy’s enemy is not our friend. Ashley has good reason to raise legal actions against those who subverted his interests at Newco, but he is not someone you or I would want associated with our football club. Those who campaign to remove his influence from their clubs (including Newcastle) do so with sound reason. Even if their tactics harm their club far more than Ashley.

Why would a ‘neutral, public serving’ media take such a burying stance?

    hmmmmm……

  2. Extract from an Arab:

I WANT you to think about the 2008 League Cup final.

I know that may seem a little bit cruel, but please do it. Although speaking personally, it might have been the worst experience I have ever had watching Dundee United. I do not say that lightly, considering the bilge I have watched in the last few months.

Why do you think Dundee United lost that day?

Mark Kerr, for his late attempt at a passback? You’d think so, but no.

Kenny Clark? Maybe, but this was a final against a Glasgow team. You don’t get penalties in that situation. Don’t hate the player, hate the game.

Nope. It turns out it was Dundee United’s own fault. Because they paid their taxes.

Think about it: had they used EBTs like their opponents that day did, they might have been able to afford better players. They might have been able to pay a player who could hit a decent backpass. Players who might have been able to take good enough penalties in the shoot out.

Or even a player who, unlike Christan Kalvenes, might have been able to dodge that rugby tackle from Carlos Cuellar.

OK, that may not have been entirely honest, but the cup would have been won on the pitch, which apparently is all that matters.

Dundee United fan Derek Keilloh weighs in with his view and attacks RFC(IL)’s defence of the controversial tax avoidance scheme (full article in Daily Rectum).

  5. THE EXILED TIM:

I think tonight is a victory for us.

Three years ago they were using that megaphone to try and bully us.

Now they’ve stuck it in the loft and are hoping we’ll go away.

They’re beat and they know it.

  7. Does anyone else get that nagging feeling we need to reach out to a larger audience. Despite fall in MSM the average punter by and large will be swallowing the pleas to move on. Would a fund for printed leaflets, save our game, with all bullet point details and links to SFM, be a worthwhile exercise and handed out at all grounds across the country. This is a battle we can’t afford to lose.

  8. James Forrest

Would the SFA be right in saying,

Andrew Dickson is not employed by them and no one at the SFA had a EBT?

ps drop him your link :))))

I assume after reading the last few headlines on here that CFC do not intend to take the lead in forcing the Hun wrongs to be righted ….are they going to do anything overtly

    Or rely on others

Or continue to wait patiently for the “return of Rangers “

  10. I would also like to say a big thank you to every Celtic fan including fans of other clubs for uniting and signing this petition.

We all faced obstacles in 2012 when our governing body tried to place RFC into the SPL this didn’t work so they tried to place RFC into Division 1 and thankfully we all have morals we stuck to our guns and showed them fans rule.

Here we go again in 2015 and in the same position trying to do what’s right for our game and face the Media/SFA head on but I have no fear because if we show the same level of commitment in 2012 then we can be victorious once again.

Keep fighting for what is right and we can defeat every one of them again.

This article is just to remind every fan what happened when Spartans made 1 error, RFC cheated for 12 years and they want us to move on ? not a chance.

The biggest scam in this country and every other country must not be allowed to be swept aside or the game in this country is finished.

  11. JamesF

I wish I was as positive as you are, too many false dawns imo, for years now, we have said that’s it, they are fecked, we have them, the cheating, the corruption laid bare for all to see, yet the hun are still playing out of the bigot dome, the sfa are still doing sfa re the cheating, in fact they are facilitating the cheating.

The cabal are up their necks in this, the gravy train, they will fight like the dogs they are to keep the money rolling in, their power and supremisist being means so much to them to give up with a whimper.

It’s in their dna to hate.

Yeah they can attempt semantic arguments like that all they like, but the policy making body of the SFA, the Congress, has him as a member.

That he’s allowed to sit in that post is outrageous.

  13. WEST END OF EAST END @ 7:35 PM,

    That’s interesting…

Now I’m not sure if what your colleague says is correct, many Foreign Football Clubs have been striped of titles. It would appear to be total folly if say in the light of serious match fixing, titles couldn’t be stripped.

However, there in no mechanism in the articles of association for a Club to transfer it’s membership, from one Company to another in the case of an insolvency event. In fact there is a clause prohibiting it.

Strange then it was this very clause that was used by the SFA Board to transfer Rangers SFA membership to Sevco Scotland.

    Judicial Review Embdee?

    Hail Hail

  14. You know I do have to admire the human capacity for ongoing delusion.

So the latest cry is wait for the appeal period to end. Then you will see Celtic, ahem, Spring into action.

Honestly? I mean Thor stunning contribution to the LNs enquiry was to say that they were “surprised”. They have studiously avoided and curtailed res 12. Th only time they put their head above the parapet is to attack their own support.

And here you all are. Jam tomorrow. Honest. They will come good. Honest.

No they won’t. They want you at the back of the bus.

    They are betraying you.

Sure come December there will be another reason to wait.

Personally I think Celtic are right to keep quiet just now,let the world see how Scottish football fans feel and not just Celtic fans, the msm would love Celtic to batter in just now,Celtic and the other clubs who have integrity in Scotland should be the velvet glove which covers the iron fist of the fans.

    Patience.

  19. Lennon sure. Let’s the support do the dirty work while they betray you behind your back.

Are you really not paying any attention?

    They are shafting you.

They will never break cover. They have told you how much they love and desire the Hun.

They have never said anything unless it was derogatory about the Celtic support.

They were involved in the 5 way agreement.

They wanted the Huns in the top league.

They don’t care in any way about you and I. We are just money to them.

But here you all are, once again, saying wait. Wait for what?

For them to screw you over again.

Hunnery will do everything it can now win this,it’s down to the fee paying public to come together and be heard,if it’s got to this stage with Celtic saying very little, surely it’s working?

  22. An inter club walk on Hampden could be one way to let the pro sevco cabal know what fans think of their relentless propaganda.

An organised peaceful event involving potentially thousands of fans from all over would send a message of intent. The Celtic fans would definitely be up for it, not sure about the others.

Unlike boycotts it wouldn’t punish Celtic or its fans.

Wee Bobby Collins, Peat who described our complaints in the 2010/11 season, as tiresome , was indeed, horrible.

Wiggy Smith, could he possibly have been Murray’s place man in the SFA at a time where his presence and loyalty to the Ibrox club, were there for him to take advantage of.

What exactly were Wiggy’s business qualifications to do a CEO job.

Him and Peat tried to move the 2008 cup final to a later date to help their club but not inform Queen of the South about it until the decision was made. Fortunately, someone at the SFA , with a sense of reality, heard about it and let the Doonhamers board know. They were not to pleased about and the final was played on the original scheduled date.

Smith still makes my stomach turn anytime his smug, horrible coupon appears on the telly
