Criminal Justice Information database, where the missing data can be found

Following yesterday’s article on the cosy relationship between the police and Scottish Government, who are alarming a remarkably wide range of society, a flurry of information has been passed back to me, including the following notes on the Integration of Scottish Criminal Justice Information Systems (ISCJIS) database.  The First Minister has stonewalled requests to breakdown religiously aggravated crime, claiming the Crown Office have destroyed their records, but my source suggests the information is available for analysis in the ISCJIS database.  I’m told:

“The material stored (in the ISCJIS database) ranges from simple conviction records, to DNA, and social status. The data is used primarily for presenting Criminal History in court cases, and in identifying suspects in criminal investigations. It is also used of course to measure the social impact of changes in Legislation and Enforcement Policy, as evidenced by the current furore. It will also be used to predict the impact of such changes, particularly as regards Equality and Diversity impacts, which is a statutory requirement of any proposed Legislation.  You see, the ‘missing’ data is actually necessary in predicting the impact on Equality of the Offensive Behaviour Bill.”

“Essentially, if you want to know how many Section 74 Breach of the Peace convictions (Aggravation for Religious Prejudice) or even charges, there were at a given point in time in a given court, you simply search on the Breach of the Peace Conviction Code and add the modifier code ‘P’ indicating Religious Aggravation. All such offences are then returned, with full access (rights permitted) to the Reports and Case Notes.”

To assist the First Minister, below is information on what the enquiry form he has to complete looks like.  This is a link to the operation manual and if he’s really stuck he can call the helpdesk on 0141-585 – 8333.

We can only speculate why the authorities are so reluctant to disclose information on, on a subject so close to their hearts.

OFFENCE AGGRAVATION
DEFINITION: The code for a crime or offence that adds to the Offence Code by highlighting particular circumstances relating to the specific incident as opposed to the actual charge.
DATA ITEMS: Crime/Offence Aggravator.
PERMISSIBLE CHARACTER SET: Code field – Alpha or Zero.
RANGES/VALUES: The code field is 1 character long and consists of an alpha code, which identifies the Aggravation to the offence committed. It is possible that a charge can have a combination of up to 6 aggravations. An aggravation description may be held in a text field within individual systems and will be an automatic expansion of the Offence Aggravation code into text to specify the nature of the Aggravation.

OFFENCE MODIFIER DEFINITION: The code for a crime or offence which provides additional information for the specific incident as opposed to the actual charge.

RANGES/VALUES: The code field is 4 characters long and consists of an alphanumeric code, which identifies additional elements of the charge. The code will consist of an alphabetic character followed by 3 numeric characters. If no modifier exists, 4 0’s (zeroes) characters will be transferred. An Offence Modifier description may be held in a text field within individual systems and will be an automatic expansion of the Offence Modifier code into text to specify the nature of the Offence Modifier.

    I would like the board to release a copy of the charges we faced and a copy of the judgement. They have no good reason not to do so.

     

    I would also like to know in specific detail what the reasoning was for the former referee Eddie Smith to report us to the UEFA delegate.

     

    Was he suggesting that there was a breach of the criminal law, or was he applying the standard set by Article 11 of UEFA’s discipinary regulations?

     

    If the former why were there no arrests, if the latter, is that part of his role as match commander?

     

     

     

    Regarding your points;

     

     

    Would these be able to be addressed through Celtic shareholders to tabling questions to the board?

    Overall, the Euro games have highlighted the value of players like Ki, Ledley and Samaras, while showing that others still have a lot to learn.

    It was 1-1 and if I remember Raith put the ball out for a throw in due to an injured player. If I’m right we took the throw in but instead of giving it back, we put it out for another shy down at their corner flag.

    I thought your question was trying to make some comparison about UEFA convictions.

     

    IMO the dividing line is legal/illegal, imposing sanction for anything else is disrespectful, the board are showing as much respect to the Celtic support as the establishment, no good enough.

    Gerry McNee was not an isolated figure on this issue. He received a receptive audience for this on the Programme (Scotsport, I believe) where he uttered it. He received a receptive audience from fellow journos for being a good Uncle Tim. And he even won some friends in the Celtic family- Kev Jungle of CQN regularly speaks highly of him.

     

    So, while you and I may have no respect for him, his logic or his skills, he is more influential yet in Scottish football than you or I.

     

     

    BTW, I am not arguing that Irish Songs or the Tricolour are in clear and present danger. I am suggesting that dropping “Ooh ah up the Ra” will not satisfy our enemies; it will not stop Eddie or Campbell or Stephen from demanding further UEFA punishment. It will not stop Leckie or King or Traynor from calling UEFA to task for not continuing the onslaught.

    The reason I ask is that in N.E. England pubs are openly advertising 3:00 games on TV involving Newcastle.

    Of course we’ve been unfairly targetted but for years and years (& not always under pressure from outside) the Club and official supporter organisations have urged that the chants stop. Not because it was illegal (or illicit, whatever that means) but it was embarrasing and offensive to some, including our own support.

     

     

    We have not been clever.

    Another poster pointed out that we should have lodged an appeal on the basis that this is a first offence. I would concede that there is logic in that.

  21. With the best will and understanding in the world – please give it a rest. We are being lured into fighting the wrong fight on other people’s terms.

     

     

    That we are singled out in Scotland? As plain as the nose on your face and always has been.

     

     

    That our assailants haven’t had the support of exixting laws, which they don’t enforce – they try to change them and the current suggested changes, if challenged in the correct instance, would never pass muster.

     

     

    Some of our suporters persist with chants which few of us want to hear and let the club down as well as exposing us to the current attacks. They are not illegal only disturbing to many of us and offensive only to those who find our very existence offensive.

     

     

    Sooner or later someone was going to take advantage of that. How better than to use legislation which doesn’t even exist?

     

     

    Neither FIFA nor EUFA permit challenges in any court which allows them to make as many daft, unreasonable,, unjustifiable, eccentrent and corrupt decisions as suit their purpose i.e. we really are the people at a level which Rangers can’t even comprehend.

     

     

    WHY?

     

     

    Which business, anywhere in the world (with the obvious exceptions) can declare themselves to be above the law and get away with it? Should they relegate every association which challenged them, they would soon run out of members and therefore power.

     

     

    I have no idea how many generations it will take to instill some reason in Scotland – certainly more than I would wish for – BUT – if they feel the need to approach Europe to get at us, why don’t we and many others do the same?

     

     

    Like it or lump it most of us live in a democracy of some sort. That means the right to free speech and inhibits the rights of those who unjustly try to prevent the concept.

     

     

    Do you want to fight and win (little point otherwise)? Choose your opponent, choose your ground, find your allies and use the law for us as others try to use made-up laws against us.

    Regardless of what anyone of us think about the IRA in any of its’ manifestations, I find it hard to believe that the Board of Celtic Football Club, would accept a verdict by a UEFA Committee, based on the evidence of one Strathclyde Police Officer. It is a form of guilt by proxy, which, despite being, ostensibly at least, the Guardian of our club, the Board, in my opinion are not privy to accept on our behalf. On all or any of our behalf. It is the acceptance of a verdict, which, whatever view we hold, (and as Ard Macha has already pointed out) criminalises Republican songs for the first time. And not only that, it provides evidence and support for the criminalisation of the Celtic Support to be found in legislation likely to be passed into law this very same week. That’s you and me! That’s all of us!
