Doncaster’s totally inaccurate precedents cause mayhem

SPL chief executive, Neil Doncaster, appeared on BBC Radio Scotland this evening strongly pitching the appropriateness of a Newco to be voted into the SPL.  He gave a couple of examples to back up his position and used gaps in his interviewer’s understanding to paint a strong picture.

While he accepted that a Newco had never assumed a position in an elevated league in Scotland he gave two examples of it happening in England and even went as far as suggesting that “going down the Newco route” was the normal way to exit administration now.

There is a crucial difference between the examples Doncaster gave and all other examples, including Rangers – over 75% of creditors agreed to a Creditors Voluntary Arrangement.

A note of explanation first:

Football clubs are free to change their corporate structure by application to their association.  This has been done my most clubs over the years, in particular in the 19th century when they went from being private clubs to incorporated limited companies.  There was another wave when the PLCs arrived.  Celtic went through this process in 1897 when it became a limited company and again in 1994 when it became a PLC (Celtic PLC remains the same legal entity they became in 1897 with the same company number).

This facility to change your corporate structure has never been a charter to ditch your debts.  Financially distressed football clubs in England often change corporate structure when subject to a takeover.  The new boss comes in with the company he used to fund his takeover (like Craig Whyte’s Wavetower) then applies to the FA to associate the club with his new company.  If over 75% of creditors support a CVA, this is in order and is always granted. The old company is then usually wound up.

Back to Neil Doncaster.  He gave two examples: Crystal Palace and Plymouth Argyle.

Creditors of Crystal Palace agreed a CVA proposed by CPFC 2010 in June 2010.  Following this, CPFC 2010 took ownership of the club and successfully applied to assume its league share.

Mr Doncaster may have been concentrating on matters elsewhere on 6 May last year when Plymouth Argyle’s creditors agreed to a CVA.  The same day Craig Whyte completed his takeover of Rangers.  Following this creditors agreement, the club was bought by the Akkeron Group.

Precedent in Scotland and in England is clear: if you get the agreement of your creditors (by a CVA, for example), the football authorities have no issues.  If you don’t get agreement with your creditors, you’re finished.

Before I get asked the Leeds United question one more time…. 75.2% of Leeds United’s shareholders agreed to a CVA but on the 28th and final day creditors were allowed to act, HMRC objected.  The Football League used emergency provisions to authorise Leeds share transfer as the CVA had sufficient support.  HMRC dropped their appeal soon thereafter.

There is little we can do about controlling the debate on radio.  Neil Doncaster has pinned his colours to the mast and tonight agreed to be interviewed by a journo who is also financially heavily conflicted towards supporting a Rangers-Newco in the SPL.

Doncaster also appears to have sprung the same misinformation on the organiser of the SPL Survey, who the SPL chief was very dismissive off tonight, implying the organiser accepted his view after he explained “the facts”.

This is the bottom line for you and for Doncaster.  Crystal Palace, Plymouth Argyle and Leeds United all convinced over 75% of creditors to support a CVA.

Here is a list of the teams in Scotland and England (in modern times) who failed to agree a CVA:

Chester City
Farsley Celtic
Rushden and Diamonds
Airdrieonians
Gretna

All of them dissolved.  None emerged as a Newco retaining their league status (although Airdrieonians fans bought and moved Clydebank FC).

This man – Doncaster – has no right to present you or SPL clubs with a selected version of English clubs history which plays fast and loose with the most important fact of all – did 75% of creditors agree to a CVA?

Precedents are clear and 100% consistent.  Get 75% of creditors on side or start supporting another football team.

    Totally agree: Scottish football needs to find its true level: a domestic league relying on 4 dubiously entertaining marquee games a season has been a disaster waiting to happen – that, plus the trifling fact that the huns have been illicitly funding themselves – and thereby massively distorting the game here – to the tune of about £10M per year for the past 15 years (or more).

     

     

    Not to sort this now postpones the inevitable, sustains the unpalatable and allows space for the sort of disgusting and depressing spectacle of watching the establishment contort itself in a futile bid to accommodate the Foe Malign …

    Last night I listened to our SPL chief executive Neil Doncaster make several false statements during a BBC radio broadcast.

     

    I am concerned that Mr Doncaster either needs urgent legal instruction on the subjects he was talking about, a matter of great alarm to me given his current employment in our national sport, or he was deliberately trying to mislead the Scottish public.

     

    His statements, as I am sure you are aware, concern precedents set in Scotland and England regarding football club company liquidation, administration and the admission of new companies to established football leagues.

     

    Please regard this letter as a formal complaint from a member of the Scottish public and I expect a publicly broadcast rectification / retraction of Mr Doncaster’s erroneous statements made on our behalf in his capacity as Scottish Premier League Chief Executive.

    The consolations I will take from this if the game in Scotland is cloned will be that the hun in whichever form will no longer have the use of ebt’s,the bank will never be its prostitute again and the huns won’t find a manager held in such esteem as the Myth who’s reputation was built upon the former two consolations,the huns,when they struggle,will have no patience like during Le Guen’s time,they will also,you would hope,be watched like hawks in their economic affairs,there will need to be a communion set up in Scottish football just to keep an eye on them!

    My sister told me there is an African student over on work experience, he says if this is a drought I’m not hanging about for the rainy season.

     

     

    Yesterday for the first time in a long time I purposely watched an English Premier game, after the match I thought Man City will win the FAPL and prove it’s biggest League money can buy.

     

     

    I then logged in to CQN to discover that the SPL is the shabbiest League money can buy.

     

     

    Of course none of this is news.

     

     

    One thing is worth pointing out again for the NewCo LetsGo brigade, who are as Paul points out ever willing to bring comparison to Leeds United.

     

     

    To survive Leeds had to sell their training ground and Stadium. WHEN RFCia eventually do this and they must the cash raised will go secured creditors, the buyers may or may not wish to lease one or both to a Football club.

     

     

    It is only one in many strands that gives lie to the myth that there will be a Strong R@ngers next season which will be the financial powerhouse of the SPL.

    Whilst Paul67 was correct to turn attention to Doncasters grossly misunderstood/leadings statements on shortbread last night, after listening to the interview there the thing that jumped out at me is what he said re. the current legislations. I was aware that as it stands an SPL newco can be admitted to next seasons league solely at the discretion of SPL board member with any sanctions/punishments decided on an individual basis. What concerns me is the postponement of yesterdays vote. Theoretically the huns could go into liquidaton this week and Govan Dodgers could walk in next season with minimal/no sanctions.

    Can you please advise whether there is a “cooling down” period, during which I may be able to cancel 2012/13 season tickets renewed & purchased last week.

     

    I do not see any mention of such in the club’s Ts&Cs & as yet have not investigated with respect to legal or consumers rights therefore I would be grateful of any info or or sources you could direct me to.

     

    FYI, the reason for my inquiry is that I must think long & hard now as to whether I’ll attend SPL matches in future, in the event that currently rumoured gerrymandering in the case of Rangers FC comes to pass.

     

    It would be with great regret that I would have to cease supporting the club I’ve always loved, but if they have to participate in a league where the rules are subverted to accommodate one club to the detriment

     

    of all else, then my supporting days will sadly be over.

    Crawford Allan will referee Celtic’s match with St Johnstone tomorrow night with Iain Brines in the middle for Sunday’s trip to Dundee United.

     

     

    Allan has refereed Celtic twice this season with the last game being a 1-0 win over Motherwell in February where he handed out five yellow cards.

     

     

    Brines has been his usual accident prone self all season and took charge of the Scottish Cup quarter-final between Dundee United and Celtic in March.

     

     

    Robbie Neilson was ordered off after a brutal challenge on Georgios Samaras with Celtic scoring four goals without reply in the second half.

     

     

    Alan Muir will take charge of tomorrow night’s Rangers v Dundee United clash at Ibrox with Willie Collum refereeing the Rangers v Motherwell match on Saturday.

     

     

    Collum awarded four penalties on his last visit to Ibrox with Rangers missing twice from the spot in their 3-1 win over the Paisley side.

    This is an odd one. If ‘getting in before the vote’ is important, and if they’ve been in discussions for 7 weeks, and given that the vote was meant to take place yesterday, surely there’d have been greater haste on the part of the administrators and less dilly-dallying?

    effectively i’m saying for increased revenues, let the successful bidder show any and every game they so desire, even if via the red button. the cameras are already there anyway, as they provide highlights packages.
