Doncaster’s totally inaccurate precedents cause mayhem

SPL chief executive, Neil Doncaster, appeared on BBC Radio Scotland this evening strongly pitching the appropriateness of a Newco to be voted into the SPL.  He gave a couple of examples to back up his position and used gaps in his interviewer’s understanding to paint a strong picture.

While he accepted that a Newco had never assumed a position in an elevated league in Scotland he gave two examples of it happening in England and even went as far as suggesting that “going down the Newco route” was the normal way to exit administration now.

There is a crucial difference between the examples Doncaster gave and all other examples, including Rangers – over 75% of creditors agreed to a Creditors Voluntary Arrangement.

A note of explanation first:

Football clubs are free to change their corporate structure by application to their association.  This has been done my most clubs over the years, in particular in the 19th century when they went from being private clubs to incorporated limited companies.  There was another wave when the PLCs arrived.  Celtic went through this process in 1897 when it became a limited company and again in 1994 when it became a PLC (Celtic PLC remains the same legal entity they became in 1897 with the same company number).

This facility to change your corporate structure has never been a charter to ditch your debts.  Financially distressed football clubs in England often change corporate structure when subject to a takeover.  The new boss comes in with the company he used to fund his takeover (like Craig Whyte’s Wavetower) then applies to the FA to associate the club with his new company.  If over 75% of creditors support a CVA, this is in order and is always granted. The old company is then usually wound up.

Back to Neil Doncaster.  He gave two examples: Crystal Palace and Plymouth Argyle.

Creditors of Crystal Palace agreed a CVA proposed by CPFC 2010 in June 2010.  Following this, CPFC 2010 took ownership of the club and successfully applied to assume its league share.

Mr Doncaster may have been concentrating on matters elsewhere on 6 May last year when Plymouth Argyle’s creditors agreed to a CVA.  The same day Craig Whyte completed his takeover of Rangers.  Following this creditors agreement, the club was bought by the Akkeron Group.

Precedent in Scotland and in England is clear: if you get the agreement of your creditors (by a CVA, for example), the football authorities have no issues.  If you don’t get agreement with your creditors, you’re finished.

Before I get asked the Leeds United question one more time…. 75.2% of Leeds United’s shareholders agreed to a CVA but on the 28th and final day creditors were allowed to act, HMRC objected.  The Football League used emergency provisions to authorise Leeds share transfer as the CVA had sufficient support.  HMRC dropped their appeal soon thereafter.

There is little we can do about controlling the debate on radio.  Neil Doncaster has pinned his colours to the mast and tonight agreed to be interviewed by a journo who is also financially heavily conflicted towards supporting a Rangers-Newco in the SPL.

Doncaster also appears to have sprung the same misinformation on the organiser of the SPL Survey, who the SPL chief was very dismissive off tonight, implying the organiser accepted his view after he explained “the facts”.

This is the bottom line for you and for Doncaster.  Crystal Palace, Plymouth Argyle and Leeds United all convinced over 75% of creditors to support a CVA.

Here is a list of the teams in Scotland and England (in modern times) who failed to agree a CVA:

Chester City
Farsley Celtic
Rushden and Diamonds
Airdrieonians
Gretna

All of them dissolved.  None emerged as a Newco retaining their league status (although Airdrieonians fans bought and moved Clydebank FC).

This man – Doncaster – has no right to present you or SPL clubs with a selected version of English clubs history which plays fast and loose with the most important fact of all – did 75% of creditors agree to a CVA?

Precedents are clear and 100% consistent.  Get 75% of creditors on side or start supporting another football team.

    I believe there has already been a precedent set as regards a national league organisation declining to sanction a member club.

     

     

    The Swiss FA were told in NO UNCERTAIN TERMS by UEFA/FIFA to sanction IN FULL that member club,or they themselves would be sanctioned.

     

     

    The options were-Either Sion gets it,or you do. That means no national team or club team in ANY competition organised by UEFA or FIFA.

     

     

    We will soon see whether our own national organisations believe Rangers are bigger than Scottish football.

     

     

    Or whether sense will prevail.

    I have to say that Neil Doncaster’s comments on Rangers didn’t surprise me one bit.

     

    Does anybody really think there is a moral dilemma hampering the thinking of Neil Doncaster and the SPL? He’s a businessman running a business and in business the businessman must make the most of his assets, therefore it can’t be any real surprise at what Neil Doncaster said last night about Rangers. It is patently obvious he and the SPL need Rangers to survive as a going concern for their business. Below I’ve copied the SPL Web home page, where is the emphasis?

    Grey, blustery and chilly here in North Ayrshire this morning.

     

     

    Hard to get out of my head the image of these neds, completely out of control and bent on destruction of Celtic property, while two policemen stand amid the chaos, in that, “at ease” posture they do.

     

    What were they doing there? What function were they fulfilling?

     

    What was the point? Why did they even enter the toilet in the first place and why did they stay when they clearly had no intention of intervening?

     

     

    In all my 62 years, I don’t recall ever seeing anything like that.

Doncaster is either 1) Compromised in that his own job would be downgraded in a rangerless spl or 2) Not wanting to be seen as the man who pulls the trigger or 3) Frightened of Sandy’s Billy Boy army sanctions or 4) Possibly at odds with the SFA and seeking to establish a credible pro rangers position vs SFA

  9. Doncaster knows he’ll be unemployed soon. Regan and the SFA know if they don’t follow the UEFA line then Scotland will be hammered, so they will step in (the spin will be for the good of the game) and restructure Scottish football under their name. They will run the leagues.

Further to the Swiss FA story, they just refused licenses for four first division teams including FC Zurich one of the biggest teams over here, Young Boys, Servette and our old pals Sion were also refused, the reason for this massive shake up in the Swiss Top division : Financial irregularities.

     

     

    Basically since Uefa kicked their backsides over the Sion game the Swiss FA have had a right good look at their league and decided enough is enough.

     

     

    If the Swiss league can do it so can the SFA, can’t they!!!

  12. For the long term good of the game in scotland we will need to take a step back to move forward. We need clubs with a financial model which is reliant on being able to self-finance, not beg for the crumbs from a bankrupt (morally & financially) club.

     

    The Sky/ESPN TV deal is the biggest milestone around Scottish football’s neck. The game is not run to improve quality, to develop better players or even, god forbid give the fans what they want. It is run for a TV deal based around 4 games. Break that reliance, take the pain in the short term and reap the benefits long term. Some teams may fold, tough, if they are not sustainable as stand alone companies then maybe its time for them to go.

    Surely the SPL chief executive Neil Doncaster’s blatantly false statements broadcast nationally have to be challenged and questioned by all?

     

    I could do a few copy and pastes from Paul’s article myself in compiling a letter to the SPL and the BBC, (who allowed the falsehoods to be broadcast).

     

    But it would be better coming from someone with a bit of “weight”. (No, not Traynor.)

     

    I know Alex Thomson’s been good so far; surely this would be straightforward for him to pick up on to redress the errors broadcast last night?

  14. Doncaster has been shown to either lie or be totally incompetent (or both) on national radio and tv. Paul67 has quickly put the facts out which were readily available and easy to understand.

     

     

    My concern ( apart from the newco reentry fraud) is that Doncaster represent the SPL on a number of key fronts.

     

     

    – he is chief exec and based on above he is incompetent and not fit for purpose

     

     

    – he has to deliver the sky contract ( which he has failed to do so far ) . Sky will not take this clown seriously. It is like negotiating with a footballer who can do a Bosman. He has allowed the Sky contract to run out and has not signed and sealed the new contract , allowing sky the possibility to renegotiate vastly reduced terms. This is gross incompetence and Ralph Topping and the SPL Board should sack him.

     

     

    – his refusal to answer a straightforward question on when ( rough timeframe ) of when the double contracts investigation would be complete was embarrassing. I wonder if it is independent as with this charlatan involved it will be swept under the carpet.

     

     

    Doncaster showed himself up as an inept last night and is not the mover and shaker we need in charge of the SPL. He needs to be sacked and we need to bring in an experienced operator and chase this cowboy.

    Over last 3 years. They are focussed on clubs developing talent as a vehicle for better representation at national level.

     

     

    The current top tier works against this.

     

    Time for change- timing couldn’t be better…if there’s one thing SNP want it is stronger national identity. Pre 2014 this will be the main govt driver and despite Salmond’s recent baloni I think his thirst for power will see him exert influence on SFA.

    Just off phone to a fellow CQNer, he was at Player of Year gig on Sunday. He said that Forster is unlikely to sign for us, that coming from Lenny. My mate was up drinking withLennon and afew other til all hours in morning. My mate also spoke with Paddy McCourt, he’s definitely away in Summer due to lack of game time. Can’t blame him in all honesty. I’m disappointed that Paddy is leaving but can totally understand why he wants away.

  19. From day one of this scenario . the end game has been to protect rangers football club . the constant delaying tactics all part of the plan . The total list of misdemeanours commited by this club have a football governing body punishment , NONE of these punishments are being administered to them , which makes this a stitch up and shows scottish football and the administrators of scottish football to be the corrupt organisation we all knew it to be . I also feel as i and others have stated many times on this site that all the noises in objection to all thats going on with the lets save rangers fraternity ,is coming from the fans , when are our club going to get into these people and make a stand , never mind all this keeping our powder dry guff , celtic f. c . should have flexed their muscles a long time ago . We have had our fun now the serious stuff must begin , if our club sit back as they are doing and just accept the slinky underhand manouvres at sfa HQ then we will see a club who have cheated EVERY club in scotland ,some even in europe get off scot free . And if the supporter of our club and all the other clubs accept the blind eye being turned to allow this club to stay afloat then it renders the WHOLE of scottish football a complete and utter joke . You only have to look at the you tube video posted last night containing the filth and hate while destroying the toilets at celtic park to ask yourself why oh why are this outfit being kept afloat . As much as i love my club .and have spent most of my 62 years globetrotting with , i cannot subscribe to a league under the governance of this corrupt body , to do so would be a nod and a wink to them

I can appreciate that Neil Doncaster has to do what he feels is best for the overall game in Scotland, I get that, honest it is after all his job, the best for the overall game in this instance appears to be at the cost of the integrity of the game, it is after all first and foremost a game, one which should be played on a level playing field with the same rules for all, that my friends is the crux of the matter for me, ” a level playing field” I also get the fact that sporting integrity was always at risk in this scenario, it is after all rangers we are talking about not gretna livingston motherwell or dundee, this is rangers a scottish institution in the words of the scottish first minister, what Im kind of struggling with here is the fact that Neil Doncaster was so factually ill prepared for his latest moment in the spotlight, his facts have been proven to be incorrect, his statement is now laughable, and it took our own internet bampot all of a couple of hours to correct that for him, it just goes to show bull**** does not beat brains after all.

    If Doncaster is so sure everyone needs the Huns for the money they bring in maybe he should consider the teams that they owe money to. A third of the SPL are owed money by the club who bring sunshine and money to our SPL.

     

    They have cheated with contracts and tax but hey, they bring us money. Celtic, Hearts, Dundee Utd, Dunfermline and possibly more might disagree.

     

     

    We shouldn’t kid ourselves that operation save the Huns is a new thing. The referees and SFA have been active on this for a few years.

  24. Morning Celts, I’ve been in Lanzarotte since last week so never got to read or hear what doomcaster said or what the SPL clubs decided, bearing that in mind . There seems to be another wave of anger around the blog, mostly to doomcaster but also some saying they won’t support CFC if they allow this to happen.

     

    I’d hang fire on all of those kind of thoughts, there are various smoking gun events awaiting to happen, there’s Uefa watching, we have a Celtic board that IMO are streets ahead of the rest in Scotland.

     

    Their day is coming…….. All my opinion of course.

    The worrying thing for me is not Doncaster’s outrageous economy with the truth (he is, after all, essentially a politician)… No, what worries me is that he was clearly speaking on behalf of the clubs whom he had met only a few hours before.

     

     

    Whatever we think of him, he is not acting alone. He has a mandate, and that mandate is to get RFC or its successor into the SPL by hook or by crook.

     

     

    I’m afraid UEFA will need to get involved if we are to see justice here.

    I have a feeling that the shrewd hierarchy at Celtic are giving them enough rope to hang themselves here. If we allow things to develop as they seem to be, and a Newco Rankers are allowed to flout all previous precedent and parachute straight back into the SPL, then it will be blindingly obvious to UEFA that our claims of corruption within the Scottish game are well founded. That may be the evidence we need to extricate ourselves from this grubby little backwater and head elsewhere. Maybe that has been our plan all along?

    And,remember-Sion were hammered because of breaching regulations in ONE season of UEFA competition.

    I thought Neil Doncaster was embarrassingly poor last night. Whatever his position might be, and whatever his interpretation of the existing rules might be, and whether I or anyone else agrees with them or not remains unclear as the man could simply not express himself in a coherent fashion when asked any semi pertinent question.

     

     

    Further his grasp of essential facts was woeful. His assertion that there is a thin line between a CVA and Liquidation shows a fundamental misunderstanding of this entire process. A CVA is reached with the agreement of the vast majority of creditors involved in an insolvency process. A Liquidation is something that can and does happen despite the views of the creditors– whether it be driven by the company itself or by one creditor saying “enough is enough- I am calling a halt to this NOW!”. Liquidation is an arbitrary process not a consensual process. A CVA– by its very name CREDITORS VOLUNTARY ARRANGEMENT– is not an Arbitrary process.

     

     

    If Mr Doncaster does not get this then all I can say is that I am just glad that he is not a Pathologist. If he were he would presumably argue that there is a fine line between death through natural causes and suicide– or even murder. Just a fine line you understand between voluntarily choosing to do something, and the grim reaper, nature or a big bad man with a gun deciding you will cease to exist whether you like it or not.

     

     

    Also, anyone with experience in ultimate Insolvency– Liquidation, or personal Bankruptcy will tell you that the whole history and ethos of the law as it has developed over hundreds of years is that ultimate insolvency is always for the benefit of the debtor– never the creditor.

     

     

    It is a way of shedding debt that you just cannot pay. In olden times a debtor would be known as Notour Bankrupt– nominally bankrupt– if he took shelter in the grounds of a monastery or church where they could not be pursued for their debts or settling their honour bound obligations. If you ever left the grounds of the church then hey presto you could be pursued for the debts– through the court or with the sword. Religion is not as popular as it once was!

     

     

    The modern law holds to the same ethos. You can escape debts, but there are sanctions. If you go down the bankruptcy or liquidation route you don’t trade or carry on in exactly the same way as you did the day before. Your status changes at least for a time!!

     

     

    Anyway, Doncaster got many facts wrong last night or at very best he did not highlight certain home truths. There are no clubs in any in English who have been allowed to carry on without agreeing a full CVA. None. Nil . Nada.

     

     

    Some have done it with New Co’s, Wholly owned subsidiaries, and other routes but at the end of the day, a way was found to settle with 75% of creditors.

     

     

    In every instance where that did not happen– then the fine line became a brick wall. Not mythical, imagined but very real– an a company that hits a brick wall does not go any further!

     

     

    On a separate note, if everyone is so damned concerned about the “Sky” deal– then a petition or survey showing that football fans will boycott the goods and services of any company advertising on Sky during SPL games, or which sponsors Sky broadcasting SPL games featuring a new and resurgent Rangers all new squeaky clean company will cause an about turn in the current thinking.

     

     

    The SPL executive might choose to ignore football fans, but if football fans threaten the real source of money that everyone seeks to protect and the money men in those companies are given serious cause for concern as to whether or not their companies results will be harmed by being associated with “damaged goods” like this gerrymandered excuse for a football league, then I can assure you they will not sign the advertising contracts. Commerce is Commerce!

     

     

    And without Advertsing contracts the SKY guys will not care a jot who plays who or when or how often. They will also not care who or where Rangers are if by being associated with them they lose market share– or are even threatened with losing market share.

     

     

    It is not only Rangers fans who can boycott sponsors– there are another 11 teams in this league— or has nobody noticed that?

  30. The SPL strategy , at least the executive strategy, is starting to become clear.

     

     

    First…….Don’t do anything until you know who you are dealing with. The SPL are clearly terriified of being accused of scaring any potential bidder/saviour away. They must be praying for the blue knights to succeed. Their bid has been so publicly about a CVA only, the SPL can then take the correct action on any Newco.

     

     

    If the blue kights fail to get an agreed CVA, then the SPL won’t be blamed. The downside of the BK bid is that it brings the other BK as part of it. Kennedy has an ego of Murray proportions, and , based on his running of Sale Sharks, sees no problem in running at huge losses in pursuit of the prize.

     

     

    In life its generally better to judge people based on their actions , rather than their words. Kennedy is a Rugby supporter, who’s affiliation in football is with a team other than Rangers, who has been a liquidator of business’ and who’s ego has taken his rugby club to balance sheet insolvency

     

     

    Does that remind you of anyone? Rugby, Edinburgh, Ego, huge losses, other football club affection………

     

     

    Anyway back to the SPl

     

     

    Secondly……no matter what the pressure, do not provide information on the TV contract. Make no mistake Sky are working in tandem with Doncaster over this. The very last thing either of them want is to be forced to provide the answer to the key commercial question…

     

     

    What value would the contract have if Rangers were not in the SPL ?

     

     

    Make no mistake Sky NEED SPL football. It is an extremely useful timeslot filler. Sky fill their timeslots with a bewildering variety of product. Much of it is minority sports, and much of attracts tiny viewing audience. The last thing Sky need is more obscure product in key viewing times. They are already maxed out on English football, and there is no demand for other European leagues.

     

     

    Commercially Sky will not walk away from a product which includes Celtic. The SPL walked away from Sky previously for Setanta, and Sky came straight back in at the first opportunity.

     

     

    They would prefer it to include Rangers, but it would still fulfil a valuable function for Sky without Rangers, Especially as Sky would be very interested in an SFL product with Rangers included.

     

     

    So Doncaster and Sky will do absolutely everything to avoid answering the question of how much an SPL contract is worth without Rangers……..because the honest answer is it is worth plenty.

     

     

    The MSM have been totally dishonest about this. Traynor and Young in particular. They are whipping up a Lord Haw Haw campaign of intimidation and doomsday scenario’s. They have been joined by the likes of Fraser Wishart, who’s comments on this have been quite disgraceful. He stated openly that it would cost each SPL club £1.5 million if Rangers were not in the SPL .

     

     

    He knows that is a lie. He knows that figure means ZERO TV revenue. he is ignoring the ESPN contract, He is ignoring that Sky will offer a contract regardless of whether Rangers are in the SPL or not. He is also ignoring that an Spl without Rangers is only a temporary situation, and that any contract can contain terms which adjust the financial aspect when Rangers gain re-entry.

     

     

    So basically the SPL have 2 strands to their strategy.

     

     

    1 Do nothing until a preferred bidder is chosen

     

    2 Say nothing about the TV contract, because understanding the true position allows fans to have financial logic as well as sporting integrity on their side in their demands Rangers start in SFL 3

     

     

    There has been a complete absence of leadership shown by the SPL. Doncaster is a deeply unimpressive figure, and Topping has popped up once and then disappeared straight back to his bunker in Willie Hills

     

     

    This leaves the third issue under SPL remit.

     

     

    The 15 year cheating by Rangers of all SPL, SFL and European clubs, by breaching registration rules. Now this isnt a claim made out of frustration at a glass chinned SPl. It isnt a Celtic supporters fantasy concoction. It is and will soon be shown as fact.

    Why would Doncaster be allowed to spout such nonsense yesterday. If there is no hope for them (and I sincerely hope this is the case), why would he go on national radio and build up their hopes? Surely his board will be having words with him this morning?

     

     

    Now we’re in May, is this their last month? Can they pay any more bills?

The details of just who had an EBT, who had a second contract, how much they were paid, how much was undisclosed ( for the same SPL and SFA to determine )…. and what if in all that time it was shown that David Murray spent more money than any other team in Britain at the time.

    Great Post as usual Paul.

     

     

    Doncaster is selective in has facts but what is more worrying was his backing of the Kilmarnock Chairman’s view that financial considerations have to be considered along side sporty integrity.

     

     

    Which is saying depending on your size you can manipulate and break the rules without penalty. If that is the view of the majority of Chairmen then I would question if they were’ fit and proper’ people to be in charge of the sport.

     

     

    The whole idea of having a governing body that is separated from the clubs to take decisions that are good for the long-term good of the game now looks a necessity.

     

     

    Having a group in charge of the sport that is only interested is the amount of money that can be made from it has always been a recipe for disaster as far as the good of the game is concerned.

     

     

    If the SPL lets a newco in on the nod and whitewashes the double contract scam this will be in the longer term be a disaster for the game because every team in financial trouble will follow this route.
