And, they, gave us………. Davie Hay.  Enormous thanks to Davie Hay for coming onto the blog this morning.  It was great to read his responses on playing for and managing Celtic.  If you missed him, catch up from 09:44 here, you’ll enjoy it.

At the risk of commenting on Roy Keane when few of us know much about what happened last night….  I remain pleased we didn’t appoint him manager in the summer.  Very pleased.

Really disappointed at the outcome of the Fifa investigation into the awarding of the Fifa World Cups for 2018 1nd 2022, although, as I type that sentence, the reasons perhaps become clear.  As with all of these things, I’m specifically thinking about the Lord Nimmo Smith SPL inquiry here, football governing bodies ask the questions they want answered.  It’s not the independence of the investigator which is important, it’s who sets the scope of investigation.

    And if the wee tax bill was allocated to the PAYE and NI bill then originally the PAYE was only £5.8M but the total bill was for over £14M

     

     

    So I’m saying the wee tax bill brought the house down because the wee tax bill was proof that they were practising tax evasion which is a criminal offence and all grace was removed where they were concerned.

    Was ring fenced and they never got it, is that what you are saying?

     

    You’ll need to work that one out for me here, if it was ring fenced how could they not have got it ?

     

    If they never got it then that being the initial overdue payable (see what I did there) must have been the one that brought the house down, surely simple logic works here, aye they stopped paying PAYE and NI but had the wee tax bill no been overdue then there would have been similar grace on the bigger one.

    HMRC – Small Tax Case

     

     

    Talking of cases where it appears Club do not wish to pay, as has been commented before, it is understood that HMRC successfully arrested £2.3 million of the agreed liability in the “small tax case”. The passage of time since the arrestment means that, in the event of Rangers going into administration or liquidation, HMRC would be preferred creditors for that sum. If Rangers went into receivership though, the legal position is less clear. On one view, the funds would go to the receiver to satisfy the creditor under the floating charge (Rangers FC Group Ltd aka “Group” which is Mr Whyte’s vehicle for owning Rangers Football Club PLC or “Club”). There is an alternative view, which places me in the minority, that there is a preference for HMRC in that event too. I won’t give myself a migraine analysing that any more, unless and until such an event comes to pass!

     

     

    If the arrestment lasts for 14 weeks without Rangers agreeing to hand the funds over to HMRC, and without an insolvency event taking place, then the funds are automatically paid over by the bank holding them to HMRC. It seems that the 14 weeks expires in early December. Mr Whyte indi9cated that, in the contract he had with the Murray Group to buy Rangers, that Group would pay this bill. There has still been no explanation I have seen as to why this agreed sum has not been paid.

    I had a wee look and by Oct a sum of £9,294,102.14 was billed by HMRC for the wee tax case sum (circa £2.8m) plus unpaid PAYE/Tax/Vat for the balance.

     

     

    Whatever HMRC had ringfenced had not been seized by Oct and given that by Feb 2012 the sum due was reported as £9m+ then the wee tax case was part of what pushed HMRC to act but the uncollected PAYE and VAT were the main spur for administration as these amounts in theory had been taken from players/suppliers but not passed on to HMRC. (Lets call it robbery :) )

     

     

    What influenced me was reading a note that CW was disappointed HMRC were allocating the frozen but not collected amount towards the total bill which I thought was £14m but on checking was reported in Feb as £9m.

     

     

    However neither the wee tax sum or other tax was collected.

    I would say that CWs behaviour in the months from May 2011 up to October in avoiding making any payment to the wee tax case must have played its part in pissing off HMRC by Oct then Feb 2012.

    Just to let you know why I’m being so pedantic, I was trying to explain to a rabid hun that Whyte was not responsible for the the administration, he was responsible for the liquidation but the initial and IMO fundamental demise of the hun was through tax evasion and the wee tax case, yes Whyte could have probably paid it but the bottom line was if his plan was always to liquidate then the best way to piss off HMRC was to laugh at their attempts to punish evasion.

How could someone see Russia opposing Ukraine as an anti-fascist position when Putin’s Russia has strong pro-fascist leanings itself.     However a factor was he was skint and had they not lost to Malmo/Maribor he could have settled. As we know this was part of his dealing with HMRC when he tried to put them off collecting, but I would not clarify that to the guy.

     

     

    I note that the amount owed to HM Revenue & Customs at end of the day was £14,372,042 which will be that £9m odds plus (I’m assuming) unpaid tax/NI/VAT from May 2012 up to liquidation.

    The assumption is based on the “deal” done by CW with HMRC to get around the WTC bill being due/overdue.

     

     

    HMRC would have expected payment by end of August had RFC qualified. CW would have to have borrowed against those future winnings, but HMRC would not have called in SOs in August had CL money been assured. It was CL exit that triggered that.

     

     

    That does not invalidate your theory that liquidation was the ultimate aim to shed the potential BTC though, but the paperwork supports the idea that CW was using lure of CL money to keep HMRC at bay on the wtc.

    If you cast your mind back, Craig Whyte done a due diligence and uncovered the wee tax case in 2010 which he wanted guarantees on as part of that takeover. That is how he got the lot for a quid. The information was not disclosed he had to find it hence all the noise about it hence it being “declared” as you call it.
