Gerrymandering SPL with flawed resolutions

661

Resolutions to be voted on at the 30 April meeting are proposals from the Scottish Premier League executive (Neil Doncaster).  They have nothing to do with the Gang of 10 nor are they a Duff and Phelps/Rangers conspiracy.  The resolutions are not set in tablets of stone and have no authority in their own right.  The League has form in voting down executive resolutions, in particular overthrowing plans for a 10 team league last year, so, in theory, the votes could go for or against.

Neil Doncaster, being as thorough as he is, has almost certainly shared his plan with the man along the corridor at Hamden, SFA chief exec, Stewart Regan.  He is also likely to have taken guidance from the Uefa executive, specifically CEO David Taylor, formerly of this parish.  It would be unnecessarily lax to leave legislative loose ends before embarking on such a radical plan, so forget about any intervention by the SFA (cough) or Uefa.

Putting preconceived notions aside (if I can), the resolutions are flawed.

Asking for 8 clubs to vote for a Newco to be allowed into the league, but requiring 11 to vote for a financial penalty to be imposed for an Insolvency Transfer, is beyond ridiculous.  The former provision – the gift of continuity to a defaulter – is easy to achieve.  The latter – the punishment for defaulting – is unnecessarily difficult.  Duff and Phelps will need the support of only one club – let’s say Dunfermline, who are brogue-to-brogue with them anyway and due to relegation will not be affected by the financial penalty, will vote with them.  Why would Doncaster put such a high bar on setting financial penalties?

Arbitrary voting thresholds smack of gerrymandering. Can anyone explain this in any other way?

There will now be a period of debate between clubs; Celtic will oppose any provision for a Newco to enter the league.  Duff and Phelps will be in the opposite corner.  You can expect to hear wailing and gnashing from Rangers (IA) along the same ridiculous lines they have used ahead of the SFA hearings into the behaviour of the club in advance of, and after, Craig Whyte’s purchase of the club.  On that occasion, Duff and Phelps argued that the actions of Rangers’ new owner, or the failure of the old board to conduct their business correctly, should not lead to a penalty on the club.

It doesn’t matter how lax or severe the proposed penalties, Duff and Phelps will oppose them.  Anything lessening of the penalty is worth money to the proposed new buyers of Rangers, so let’s view everything Duff and Phelps say in pound notes.

Rangers have unpaid bills potentially running up to £134mm that’s medicine, operations, road repairs and Help for Heroes.  Allowing them to ditch their history and start afresh, where owners profit by securing a floating charge over the stadium, where fans can continue to be provided with a team in the league, creates an unprecedented moral hazard.  It rewards irresponsibility and would create a queue of clubs ready to do the same.

And on the point of ditching their history… I openly mock anyone who uses phrases like Hybrid Liquidation.  You don’t get Hybrid Liquidation, Partial Liquidation or Liquidation Lite.  You cannot buy or sell history, as Duff and Phelps tried (and failed, I think) to convince Rangers fans.  Liquidation would mean Rangers Football Club, established in 1873 (or 1872 as they now claim), incorporated in 1899, is finished.

Just pay your bills and do us all a favour.

  1. So there could be a situation where FC Taxdodgers could vote with 7 others to get a Newco admitted straight back into SPL then vote with 10 others to allow this to happen with no financial penalty?

And they are complaining about what exactly? Seems like deal of the century, a perfect cheat’s charter.

  2. The Honest Mistake loves being first on

Perhaps, the way forward if Doncaster’s Trojan is voted in, is for Celtic to concentrate on the U19’s and the Next Gen Series.

“Competing” in a corrupt, predetermined league is not an option so Celtic need to make contingency plans.

I personally couldn’t give up Celtic but would look for ways to get my Celtic fix and support Celtic outwith the SPL.

  3. Lennon n Mc....Mjallby on

Celtic must fight these proposals in court,it is ludicrous and surely illegal to stitch Celtic up in this way,the club must have grounds based on this is not what the club became part of the spl to see happen and if the huns via liquidation are going to escape years of non payment of tax what’s going to happen to the two contracts situation,Celtic have been robbed blind of millions due to missing out on Europe,if the spl proposals are borne out of finance then what is going to happen with the money Celtic have been cheated out of?

  4. @OHenleyAlex: As far as I can make out clubs weren’t given any heads-up about this announcement today either. Proposals drawn up by SPL board.

  5. Reply to previous tweet.

@GaryLouise1: @OHenleyAlex Yes, hurriedly drawn up yesterday. Location meeting was held ? Newton Mearns Masonic halls.

  6. What to do? If this shame is passed, it is not sport, we have always thought things were loaded in favor of rfc. Now we see its true.

All the bluster from duff n duffer(shrewd operators by the by) is just that they need to shout its an injustice. To make it seem rfc are being hard done by. Trust me this fix is for the good of one team only.

Now how can we as Celtic stop this? I cant see boycotts working as our love for our team will be our downfall, we will trickle back to the away games.

I think it must be legal challenges as obviously no one in Scottish football has an ounce of integrity or any idea of sportsmanship.Mark my words if this gets passed then the stripping of titles will not happen cause the fix will be in for that too.

Must be legal challenges starting ASAP so newco cannot start the league in the up coming season.

Another wee point if newco rfc gets relegated in the near future will there be a restructuring of the league ?

I am so angry and frustrated at this. Total sham, are we Celtic as a whole going to accept this?

    Keep the faith

  8. We would need to get other SPL fans involved.

All fans who aint happy would need to Cancel SKY/ESPN and then the next step would be a planned boycott and also a planned protest.

    Morning,all.

I posted at about 7pm last night that I thought this whole approach by the Scottish football cabal was illegal, and would be challenged on that basis by HMRC,and probably a few others too

I am starting to realise that it is also against every tenet of sport in general, and football in particular-well,I realised at the time, but the ramifications of that are only just sinking in.

If this path is pursued,I can see the SFA,SPL,etc, having their approval to operate withdrawn by the big boys, and an outside management team being installed pro-tem,until we can prove we can be trusted to run things on our own again.

By trying to save the huns, they may well be hanging themselves from a very short rope!

    Any thoughts,all you legal beagles?

We will only get away from them by leaving the rancid SPL.

Nobody else wants us at present.

    The board must engineer change.

They are failing on this massive issue.

    They have NO plan.

If they are shown what is there that the leeches can do to prevent allowing us to go to a beamback at Celtic park?

Saturday was free entry,Im sure they made more than enough to cover that what with charging £2 for a roll n sausage.

  13. If this is allowed to happen surely clubs around Europe take notice of why Uefa has stood by and done nothing, And they have the cheek to preach about fair play rules. They will be outed as a farce organisation if Rangers are allowed to get away with this. It would be great if our friends around Europe got involved if Uefa does nothing, An ideal opportunity for a breakaway?

But these clubs are all crippled with debt. If they can see a way out with a very short-term and minimal pain, then I think they would be mad not to go with it.

We could end up the only team in the league who are in debt!

I know a lot of people say we have no where to go but surely our board can think of something.

  20. This, from the Official Celtic FC site,as well as being given surprising prominence on a CELTIC site, has an interesting tone about it:

    “.Congratulations to Ross County

By: Newsroom Staff on 11 Apr, 2012 09:09

CELTIC Football Club would like to congratulate Ross County on their promotion to the Clydesdale Bank Scottish Premier League. The Highland club were confirmed as First Division champions on Wednesday night after nearest challengers, Dundee, failed to win their match against Queen of the South.

It means that Ross County will compete in the Scottish Premier League next season, for the first time in the club´s history.

Celtic Chief Executive Peter Lawwell said: “On behalf of everyone at Celtic, I´d like to congratulate Ross County on their magnificent achievement in winning the First Division title, and I´m sure they will be a worthy addition to the SPL.

“Ross County are an excellent, well-run club, both on and off the park, and the welcome we received when we played up in Dingwall earlier this season in the Scottish Communities League Cup was first-class.

“Their success this season is thoroughly deserved and we look forward to competing with them in the SPL next season.”

    Hmmmm….?

  21. Starting to wish HMRC had taken over administration instead of letting Duff and Duffer do it.

By the way, still think we should put in a cheeky bid for Kagawa. Was Dortmund’s best player last night.

  22. If the club refuse to have anything to do with a newco

    and especially refusing play them

what sort of tv deal will be available then

do you think all the other clubs will automatically vote in

    a newco then

They don’t really need to make this public only let it be

    known to the other clubs

The only other big problem is that while a lot of us are

pinning our hope on the idea that our own board will

do the right thing, if they don’t, they could destroy us

    as a club.

Celtic PLC could blow all this scheming out of the water

    the celtic purse

This has all just sunk in with me now …… The other teams will vote for this, even in the knowledge that the SPL have introduced these changes to specifically ensure rfcia return to the SPL as a Newco ……..

I really do not know where we go from here ……apart from downhill as a footballing nation ……. Think the legality of these rushed changes needs to be investigated ……… Looks like the cheats have won a battle, but hopefully not the war …….

Speechless ……sad little SFA / SPL……. Looks like you can be relegated on liquidation unless you are rfcia……

  26. @fritzagrandold: Any idea when the SPL’s investigation of Rangers contracts/payments ends? Hopefully before 30th April.

Simpliest method of putting our point across is to refuse to play the debt infested tax dodgers united or newco as it is commonly known, take the 0-3 loss and the loss of points.

Alternatively when playing newco, select a Celtic team from all the Sunday Pub leagues out there, a kind of ‘Be a Pro for a day’ type thing, hell we could even do it for charity, sure the games would have to be abandoned most of the time due to lack of players but it would make for a grand viewing spectacle!
