Gerrymandering SPL with flawed resolutions

Resolutions to be voted on at the 30 April meeting are proposals from the Scottish Premier League executive (Neil Doncaster).  They have nothing to do with the Gang of 10 nor are they a Duff and Phelps/Rangers conspiracy.  The resolutions are not set in tablets of stone and have no authority in their own right.  The League has form in voting down executive resolutions, in particular overthrowing plans for a 10 team league last year, so, in theory, the votes could go for or against.

Neil Doncaster, being as thorough as he is, has almost certainly shared his plan with the man along the corridor at Hamden, SFA chief exec, Stewart Regan.  He is also likely to have taken guidance from the Uefa executive, specifically CEO David Taylor, formerly of this parish.  It would be unnecessarily lax to leave legislative loose ends before embarking on such a radical plan, so forget about any intervention by the SFA (cough) or Uefa.

Putting preconceived notions aside (if I can), the resolutions are flawed.

Asking for 8 clubs to vote for a Newco to be allowed into the league, but requiring 11 to vote for a financial penalty to be imposed for an Insolvency Transfer, is beyond ridiculous.  The former provision – the gift of continuity to a defaulter – is easy to achieve.  The latter – the punishment for defaulting – is unnecessarily difficult.  Duff and Phelps will need the support of only one club – let’s say Dunfermline, who are brogue-to-brogue with them anyway and due to relegation will not be affected by the financial penalty, will vote with them.  Why would Doncaster put such a high bar on setting financial penalties?

Arbitrary voting thresholds smack of gerrymandering. Can anyone explain this in any other way?

There will now be a period of debate between clubs; Celtic will oppose any provision for a Newco to enter the league.  Duff and Phelps will be in the opposite corner.  You can expect to hear wailing and gnashing from Rangers (IA) along the same ridiculous lines they have used ahead of the SFA hearings into the behaviour of the club in advance of, and after, Craig Whyte’s purchase of the club.  On that occasion, Duff and Phelps argued that the actions of Rangers’ new owner, or the failure of the old board to conduct their business correctly, should not lead to a penalty on the club.

It doesn’t matter how lax or severe the proposed penalties, Duff and Phelps will oppose them.  Anything lessening of the penalty is worth money to the proposed new buyers of Rangers, so let’s view everything Duff and Phelps say in pound notes.

Rangers have unpaid bills potentially running up to £134mm that’s medicine, operations, road repairs and Help for Heroes.  Allowing them to ditch their history and start afresh, where owners profit by securing a floating charge over the stadium, where fans can continue to be provided with a team in the league, creates an unprecedented moral hazard.  It rewards irresponsibility and would create a queue of clubs ready to do the same.

And on the point of ditching their history… I openly mock anyone who uses phrases like Hybrid Liquidation.  You don’t get Hybrid Liquidation, Partial Liquidation or Liquidation Lite.  You cannot buy or sell history, as Duff and Phelps tried (and failed, I think) to convince Rangers fans.  Liquidation would mean Rangers Football Club, established in 1873 (or 1872 as they now claim), incorporated in 1899, is finished.

Just pay your bills and do us all a favour.

    Your proposal on league restructuring was dependent on both the sfa and the spl accepting it ffs and you call me a bufoon.

     

     

    I offered a very simple and crude suggestion to take both the sfa and spl out of the picture, easily developed. You immediately dismissed it out of hand. You appear more interested in partnering corruption, by competing in that competition, we validate its has a right to administer over us, that is exactly what you are advocating, compliance and know our place, that is the mindset of a victim in my book.

     

    The wallowing selfpity bit is when you greet about why should we suffer because someone else broke the rules, that is a sad sad place to be and no recognise it.

     

    Regardless of the outcome you prefer we compete in and validate corrupt competition.

    You may have a point that an away boycott earlier could possibly have put pressure on the other SPL chairmen but there wasn’t the will or desire amongst the support or the manager.

    Having read Paul McConvilles blog and Paul67’s I was wondering on what basis a decison will be reached that “Oldcos” share can be transferred to “Newco”. What is known about Newco at that point that can give confidence that it will be run by fit and proper persons or that its business plans are sustainable and projections of income and wage expenditure sensible?

     

     

    Would they meet SFA club licensing criteria? No three years of accounts for example. So do the SFA need to change their licensing rules, put in place to avoid chancers taking part. Rules that if anything need tightening not opening up?

     

     

    Is this a rule where in fact it will only apply to Rangers, maybe Hearts but teams lower down will get the thumbs down because the club coming up is a better commercial bet?

     

     

    This is a set of proposals put forward by an organisation whose job it is and whose rewards depend on meeting commercial objectives. They are therefore self serving and cannot go unchallenged by those whose job is supposedly to protect football from itself and its worst excesses and uphold fair play in all its shapes and forms.

    A few weeks or so agto, maybe less, the government flouted it’s privacy laws. They have been met all round with cynicism and big-brother fears.     Neil Doncaster is acting without the clubs. To speculate that Celtic are ‘in on it’ is fair enough, to actually believe that Celtic are is, let me be polite… wrong, wrong, wrong. He is flying a kite – they are proposals. The reaction amongst Rangers fans on forums and Twitter has been positive, as you would expect – they see a Leeds situation, no relegation, assets simply transferred to a newco and start again with the same history. Fans of other clubs are verging on the ‘game’s a bogey, no’ goin’ back’ view. Even some of the MSM, we have @STVGrant with this:

     

     

    If Rangers FC continue in admin next season, they would on current points start on -21. Newco Rangers would start on -10. Eh?

     

     

    Fans of each of the ten clubs (ignore Yorkston and thems) has to tell their clubs not in my name. This isn’t over, not be a long chalk. These are proposals, preposterous, panicky and Paul67 hints at it (maybe), there’s no way they will have been run past UEFA at this stage.

     

     

    We’re understandably annoyed and angry at this, but as usual this blog becomes a poorer place with the in-fighting and the lack of class. Champions a few days ago, aye, still Champions. Celtic are not ‘in on’ the Doncaster words and there’s a long way to go on this. I know the end-game I want.

  13. The SPL’s new rule proposal gave D&D a get out clause today. (Might even have been a collusion between the 2)

     

     

    I reckon that D&D were finding it difficult obtaining the, non returnable £1m, deposit from the preferred bidder. Too many hurdles ahead for that sort of commitment me thinks.

    The spl is made up of member clubs, said member clubs have to agree on any proposed changes to the rules, and I doubt that Doncaster would have proposed said changes without said board members approval, of which we are a member.

    Put yourself in Peter Lawwell’s shoes. If anyone has a right to be pissed off at Rangers it is him. They run themselves like a cowboy outfit at Celtic’s expense and at Lawwell’s expense in terms of criticism for doing the job he was appointed to do.

     

     

    Neil Lennon too has suffered criticism when Rangers on finance steroids were depriving him of trophies last year and Tony Mowbray, for all he was not the right man, he too suffered greatly at the hands of the huns. These are all good Celtic men and like all good Celtic men they will be spitting mad and in no mood to compromise.

     

     

    Celtic can only lose by not opposing these proposals by every means at their disposal and the idea that they are “in on it” belongs to a past era when no one had any idea of the full extent of the corruption Celtic have faced. and the Board were the default target.

     

     

    It is time those days were gone too.

    I reckon the club licensing issue which is the SFA’s province and is based on UEFA FFP principles could kill it. They would have to be watered down to allow a license to be granted and I cannot see UEFA accepting that.

    It’s one thing running it past David Taylor, quite another getting the whole thems scenario past the whole of UEFA.

     

     

    The worst case scenario (for us) as I posted here the other night is that they will take a short-term hit points-wise and be in Europe via a newco transfer of assets. Given Platini’sand UEFA’s stance of late, given HMRC’s stance, given the feelings of fans of other SPL clubs, given the strength of media reporting (Thomson, others), given that their bidders are to a consortium, clowns… this ain’t finished. imo. .

    I believe that this time around the Board will act from within like a commercial ‘Trojan Horse’ – with the correct implication to the Support.

     

     

    My summation: the Board will imply/ offer a scenario to the Gang of 10 – either accept the short-term benefits of the newco or face the wrath of the Green Pound.

     

     

    The Celtic Board (with the backing of the Support) have the financial clout to ride out the storm. If they ‘open the gates’ by means of carefully worded directives – the Support (outwith) will determine the longterm outcome.

Much of the Scottish public gets it, the MSM may not get it, but they are a pitiful irrelevance. Tell your work colleague – aye they should have paid their taxes so I’ve no sympathy for them.     uefa agreed a confidentiality pact, whilst govt were involved in negotiations, remember the subject of the negotiations and justify uefa’s very public actions.

     

    The uefa rep obviously had uefa’s permission to make the confidentiality agreement.

  34. So the sfa and the spl have been working away to allow the newco into the spl and change the rules to suit their plan.Neil Doncaster and Stewart regan are more interested in changing the rules then enforcing them when the rANGERs are involved.

     

     

    NO SUPRISE THERE …?

     

     

    Liquidation was the plan from day 1 and a few people in the know knew this was the only option.

     

    So what do we do as a club and a support ?

     

     

    Dermot Desmond will control the way we choose to move on as a club and IMHO that will be to keep Celtic plc in the spl and the cash coming in.

     

    As long as the fans are buying season tickets and the sky money is coming in there will be little change.

     

    Fergus McCann built the stadium and got the season book sales up all this was his vision not Dermot Desmond’s .Over the last 10 years the Celtic support has paid for everything.But will stand corrected if anyone can provide some figures etc.

     

     

    That now leaves it up to the Celtic support and each and everyone of us will have to make a personal decision on how they continue to finance the club.

     

    The level of help they receive from the spl,sfa and other spl clubs will determine how we react to each one.

     

    1.bhoycott ?

     

    2.cancel sky/Espn ?

     

    3.cancel season book

     

    The first 2 choice would have to be a long term policy and would not stop the newco getting back in as the time is so short till the vote.Some of the away support just will not stop going under any circumstances and this is what gives the spl and sfa a big stick to hit us with.The 3 option is at the extreme for some and if they want to watch a rigged set up then that would be their choice as even the wwf got large crowds and filled out venues world wide.

     

    This set up will change the whole of Scottish football and if the newco is voted straight back in then IMOH it is not about football anymore but just a CARTEL to take your hard earned cash an fund a corrupt business model.

     

     

    So it will all come down to the Celtic support and how we made change or accept change.

     

    Can we get enough numbers organised quickly to tell Celtic plc the sfa and sfa…..
