Johnston protests but doesn’t deny central charge

There has been a pattern for me in recent days.  I’ve read a statement by a current/former football club director, then I’ve gone looking for corroboration, just in case the report is a sabotaged attempt to make the author appear foolish.

A statement was released by former Rangers chairman, Alastair Johnston yesterday, discussing the current SPL Commission looking into how his board administered football player contracts.  I agree with him that any “capital punishment decision” should not be left to the SPL, but the SPL have no authority to impose capital punishment on a football club.  The decision to terminate a football club can only be taken by the SFA (I am discounting the reckless behaviour of directors), and is perhaps a reason the SFA decided to delegate this inquiry to the league.  It is interesting timing for Johnston to put this on the table.

Johnston’s main thrust is in connection with the SPL Commission, saying “the SFA wrote to us asking for more details about the public speculation concerning our financial and tax situation. The latter obviously referenced the impact of the EBT schemes as creating a potential taxation liability.

“The club responded accordingly and provided details, as it had done in previous years, by declaring player salaries, bonuses, benefits, etc., but also payments made to a Remuneration Trust. The SFA compliance officers must have known, both from the description and context of the reports, that such expenditures had some connection to player compensation.

“However, without any further investigation at the time, Rangers FC received its SFA license to compete in the 2011/2012 season. Rangers, therefore, were entitled to believe that they were not in breach of any SFA regulation requiring reporting of player compensation.”

Mr Johnston clearly implies that the SFA were in receipt of sufficient information to ascertain if Rangers correctly registered players (and considering the SFA president was on the board which sanctioned these decision was have to wonder), but the key point is missing from his testimony.

While disclosing this information to the SFA did Rangers reveal the existence of the alleged second contracts?  For the purposes of the SPL Commission, it doesn’t really matter how much players were paid, or if they received this money through a Remuneration Trust, what matters is: were contracts submitted and players correctly registered?  If not, then it doesn’t matter what else the club submitted to the SFA.

Sir David Murray, then Rangers owner, vehemently denied the existence of second contracts as recently as March this year, so it would appear unlikely that Rangers revealed these allegedly non-existent contracts at an earlier date.

Labouring this point slightly Johnston said:  If the SFA now decide to adopt a more focused evaluation of the data they request from its members in order to be granted a license, they should ensure that the legislation upon which they rely for enforcement and the corresponding sanctions are more transparent and predictable.”

For clarity, the information the SFA requires in order to grant a club licence is not being changed in any way.  The SFA and the SPL do, however, require clubs submit player contracts as part of the player registration process.  It is not the club licence which is in doubt here, it is the registration of players, Mr Johnston, we have to wonder why you are trying to focus away from this matter.

Our own club was brought into the issue: “A lawyer representing Celtic recently was successful in having charges against that club dropped because of the inadequacy of the SFA’s prescribed rules, regulations, and sanctions. The same principle should apply here.”

Perhaps time is playing tricks on Mr Johnston’s memory.  Paul McBride ensured a punishment imposed on Neil Lennon (not Celtic) was enforced in line with SFA rules.  Johnston also meanders on the subjects of match fixing and financial doping, distancing his former club from both, but neither charge is of any consequence.

Despite his extensive diatribe on the subject, at no point does the former Rangers chairman deny the central allegation – that for over a decade Rangers gave dozens of players second contracts which were not registered with the SPL or SFA.  Like Charles Green the previous day, he never suggested Rangers have been wrongly accused, he just complains about the club being accused.

There is a degree in Cognitive Bias in this matter if anyone is looking for material.

  4. BBC Scotland has learned that a verdict on the First Tier Tax tribunal between Rangers and HM Revenue & Customs is expected in October.

     

     

    In 2010, the previous owners of Rangers contested an unpaid tax relating to the use of Employee Benefit Trusts, believed to be in the region of £49m.

     

     

    The club entered administration in February 2012 over a separate tax issue and applied for insolvency in July.

     

     

    The Scottish Courts Service said an announcement would be made next month.

There was an interview on Talksport this morning that I missed the beginning of but the guy being interviewed by Richard Keys was describing a Cabinet Meeting he attended where Maggie went round the table seeking views/solutions. The guy said that the Ministers were obviously afraid of her, that she had a hyponotic quality in her eyes and clearly had already made up her mind that the problem was the hooligans who went to football matches (and lets not forget back then there was a hooligan problem).

     

     

    You can see how a Tory lady (lets not debate that) from Grantham would perceive a crowd from Labour Liverpool in that hooligan light. Thus the tone of response was set/approved of from the outset.

     

     

    Maggie, like Adolf (who had a mesmeric voice) was only doing what she thought was right.

    However, although we may look differently at a historical event and re-assess the significance of it we certainly can’t change history.

     

     

    It happened.

     

     

    However, problematic it might be to a national narrative history is not a commodity to be bought and sold.

    In this radio interview Charles Green the Chief Executive if Sevco Scotland Limited starts well when he says “we’ve never been a member of the SPL”.

    However, after that he appears to be all over the place.  The interviewer was rather gentlemanly when presented with several open goals.

     

     

    It would certainly appear that the club and company conundrum is not at all clear to Mr Green.

    Roger Mitchell in the Herald nails it today with unarguable logic, but he also tries to acquaint Mr Green with the long standing rapprochement between the sports hacks and anyone in a position of power at Ibrox.

    It isn’t in their common interest to point out inconvenient truths that will antagonise the Ibrox klan.

    The bottom line is if Charlie doesn’t bring attention to the fact that Sevco are a new club with no titles then the hacks won’t mention it either and everyone can pretend that Rangers didn’t die.

     

     

    Rangers (1872-2012) had 140 years of history and a lot of it wasn’t that happy. The club operated discriminatory employment practices that effectively wrote permission slips for racists and bigots.  Thus authorised the Ibrox klan went on the rampage with depressing regularity.

     

     

    Perhaps if Sevco admitted that they had no history at all then we would all be happier.

    I remember the game at Celtic Park, the first Liverpool played after Hillsborough. I cried my eyes out, I was not the only one that day.

    Back in the day when aberdeen where a good side, a top of the table clash at Celtic Park. Took a friend to see it. He didn’t want to go to the jungle, was worried about possible trouble, so I took him to the main stand. We had seats right next to the tunnel wall. Willie Miller upends big Roy of the rovers and is subsequently sent off. As he made his way up the tunnel every one at Celtic Park was calling him for everything. Unfortunately, apart from shouting at him, a wee guy sitting in front of me spat at him. Before you know it a track side police inspector is signalling to a cop 3 or 4 rows behind me to apprehend the lout. The cop comes behind me and pulls me to my feet and pushes my upper half over the tunnel wall. The police inspector shouts “Not Him” and points to the guy in front of me. The cop then pulls my friend to his feet and again the inspector says no, the other guy. Eventually he gets it right and pulls the wee guy who did it to his feet and pulls him over to the tunnel wall. I’ve now started watching the game again while the inspector, cop and ned have a conversation over the wall. Don’t know what happened next but the ned was allowed back to his seat and I was huckled. No matter how much i protested i was banged up.

     

    When i got out I relayed my story to a lawyer who took up my case. My lawyer placed an ad in The Celtic View asking for witness’s to the incident. 17 people stepped forward and agreed to come to court to relay exactly what they had seen, all exactly as I have described. These witness’s came from all over Britain. On hearing that I had 17 witness’s the cops asked for the case to be dropped only for the PF to decide he wanted it continued. The cops were cacking themselves. Every witness told the judge that it wasn’t me who spat, but the actual perpetrator and that I was wrongly arrested. they also explained that they had seen the cop getting mixed up and lifting me, then my friend, then the ned then back to me. Watertight defence I thought. Unfortunately by the time the case reached court, the cops concocted the following.

     

    Police Inspector “Yes Your Honour, it is true my colleague lifted 3 different people before finally arrestin the accused, but, I can assure you that I saw this man not only spit, but I heard him call Mr Willie Miller an effin orange bassa” (He apparently heard me say that from at least 50 yards away above the noise of 60,000 fans hurling abuse at the dandy don.

     

    When asked why the arresting officer had pulled 3 different people before getting the right one (ie ME) he stated that although he had seen me spitting and shouting, he saw no others do the same, but, the arresting officer had seen 3 of us do it. (me my friend and the actual perpetrator) As they were honest cops they would only arrest the one they BOTH seen. BOTH absolute 100% LIARS. They made 17 law abiding citizens (the witness’s) forever doubt the legal system and cops for ever more.

     

    In the meantime I was left with a hefty fine and a police record (Naw, No that Police)

    Why does the country (ie us) have to apologise? It was police and other authorities and a Conservative Government at the time who did their best to deflect blame.
