Look out for Cease and Desist orders

1238

The first thing you do when you raise an asset dispute is issue a Cease and Desist notice.  Inform the other party to stop using your asset, whether it is a piece of intellectual property, like a logo or badge, a piece of equipment or a physical property.

In conjunction with this you also ask for all monies collected in connection with your property to be forward to you.  Football clubs, for example, regularly instruct people, who produce merchandise with unauthorised copies of their club crests, to stop doing so, destroy all unused stock and send them whatever money earned from earlier sales.

If and when a claim reaches court, the first request to the judge is likely to be to freeze use of all assets and cough up cash from sales. Keep your eyes peeled…

CQN Nine-in-a-row Charity Golf Day 2013

Our Annual Charity Golf Day 2013 will take place on Friday 14th June at Aberdour Golf Club.  This is our 9th annual event and I’m delighted to announce that Lisbon Lion and nine-in-a-row striker, Willie Wallace, will be our guest of honour.

After winning everything available to him in Europe, Willie made a new life for himself in Australia, where he established a second career in the game, while retaining strong links to the Celtic ex-pat community.

We will be raising funds for the 125-4-125 appeal, while encouraging all Celtic fans to get involved and stake their claim on what this club is all about.  Cost for the day’s golf and the evening meal and entertainment is £80.  Cost for non-golfers is £45.

The Annual Charity Golf Day is always oversubscribed so get your application for a place in early by emailing, cqnopen2013@gmx.com.

Look forward to seeing you there.

EN, here’s a quote from you from your post last night

“lets go that way and be backward dicks like Neil Lennon.”

Criticism of Neil Lennon’s management skills is one thing, calling him a dick is entirely something different. We get more than enough of that from the Authorities, the press and the huns.

Your schooling and what you did when the bell went is of little or no interest to me. Don’t be so touchy.

Interesting to read the comments stemming from Estadio Nacional’s critique of NFL. Disappointing that they’ve slipped into personal abuse by bloggers I enjoy ( and am hoping to meet for a pint soon) but none of us is perfect, ( Trust me I know!!)

As I have said previously it’s been an odd season in which not as much progress has we hoped has been made- especially since February.

I am in no rush to change manager- Bielsa is though an intriguing suggestion but I doubt he’d come and if and when Lawwell and Desmond decide it’s time to get a new manager I suspect they won’t look outside Britain,

I agree that there is something – actually quite a lot – missing in terms of creativity in the midfield. I don’t think Dylan Mac is bad but he isn’t as quick as I thought and whilst the much criticised (by me amongst others) McCourt tracks back better than some think he isn’t the answer either. Rogic has looked not bad in patches and physically looks the part- I’d hope he features from the start of next season as he could be the answer.

All Celtic managers in my experience from Jock Stein- cost us v Feyenoord, couldn’t spot a keeper and was too loyal to Tommy Callaghan- to NFL are criticised whether successful or not.

Some of the criticisms of NFL aired today have some validity – mine is he chops and changes the team too much- and to make them di

  5. Thank God that for every Estadio Nacional there are ten thousand realists who appreciate that NFL is doing a magnificent job for Celtic.

Neil may, or may not, become a truly GREAT manager.

    Only time will tell.

However we have never had, & never will have, a more passionate, committed or dedicated boss than the man we presently have.

Thanks , Neil, for what you have already given us.

You are wise enough to ignore the occasional armchair critic who knows more about the job than you do.

Good Luck to you & to Celtic.

On Mulgrew it would be interesting to see his assist stats.

In a results driven business when you have a player who contributes more to a result than others chances are he gets played.

Now if we played another guy who was better in the position Mulgrew gets played in but is not so efficient in results terms Mullgrew gets the nod from a manager who knows that his livliehood depends on results more than performance.

I’m assuming of course that Celtic have the stats on what works and who works best.

Very good point and thats probably it but we played similar last season or tried to copy the MON way of playing. The CL games were a small % of the games this season, we should have flexability to try other things in the SPL games. Its great what we achieved in the CL, I still cant believe That Barcelona game and will be forever thankful of NL for giving us that.

Talking of That game I believe we started the death of the Greatest football team we have ever seen when we beat that Barcelona team, kind of a weird historical symmetry to think Lennonaccio may have killed the most creative team we have seen.

What is it about Hooper that some people say he is ‘disinterested’ during games? Did he look ‘disinterested’ when he brilliantly pulled down a pass (one of circa half a dozen made directly to him during the game) and drilled it across the area for KC to nearly score?

Was he ‘disinterested’ when he scored our equaliser in the 4-3 last gasp win over Aberdeen? Ditto when he perfectly picked out KC in the box to score the opener against Hibs 3 weeks ago?

If you hark back to the Motherwell game in late February when Hooper was on the bench, Stokes started upfront on his own. The guy hardly got a touch until he was hooked in the 2nd half for Hooper. Coming out of the ground that night quite a number of fans were berating Stokes’s effort. Claims of yup you guessed it, disinterested, lazy, lost it were bandied about.

The simple fact is the system Lenny is currently starting with, is not beneficial to any of our forwards who are no lone frontmen hence the lack of goals. Only when the system is changed during the games and Hooper et al have a partner, do they look comfortable and threatening.

Sorry but the word ‘disinterested’ is one that can not be levelled at Hooper or Stokes. Someone says it and people jump on the bandwagon and use it freely, without looking at the reasons why its not true.

Play them as a front 2, give them proper service, leave out 1 of the defensive midfielders, and watch the goals flow.

Ther 3rd division team get what they deserve to get. What there is about them is not worth getting whereas what there is about us got to Gordon Strachan who arrived unwanted.

The fact McCoist is struggling for a host of reasons is not an argument for dismissing the importance of a manager being as passionate as any supporter.

As regards motivation that too is all down to attitude on the day and when you play Arbroath after a CL game our attitude is going to be sub requirement compared to say playing Barca whilst Arbroath ( who played some good football btw) are way above as we were in playing Barca.

There is no magic motivational wand although I did think talk of resting players after title was secured a couple of weeks back was premature and may have contributed to the results that caused a delay.

In that respect lets hope NL keeps his own mental foot on the gas.

One of the peculiarities of the Sevco IPO is the absence thus far of meaningful volume of trades. I’m neither a trader nor a watcher, but between the 24 Million ‘placed’ shares and the 7 odd Million that were subscribed for at the IPO damned few have been bought and sold since, and indeed, much of the trading has been in volumes that appear to owe more to averaging the share price than meaningful transactions.

The majority of the 65 million issued shares are held by those who ponied up the dough to back Sevco intially – 33 odd Million in total – and will be subject to a lock in period, that is, the holders will not be free to dispose of them within a defined period of time.

The 7 million subscribed shares were bought largely by supporters and are unlikely to move much on the grounds of the ’emotional investment’ they represent.

That leaves 24 odd million ‘placed’ shares sitting apparently with half a dozen investment managers. These guys have seen the value fo the shares plummet in recent weeks, from 75p at opening of trading in December, to a high of 95p post IPO, back to the offer value of 70p, and onwards to today’s 59p and falling.

    The question is…

…why are the fund managers not trading? Really rather peculiar particularly given the remarkable news from Worthington plc earlier this week, casting material doubt on ownership of the company’s assets.

It almost feels as though the fund managers are also locked into a no-sell period for the placed shares.

When the first trades go through in volumes of 500,000, we’ll know that the clamps have been removed, and the price will settle to their true market value.

  16. I’ll take exciting football over overpaid primadonnas like the epl super-egos any day.

The two Cup semi-finals in Scotland last weekend were both riveting matches and had everything you’d want from games of football.

High drama, edge of the seat, both of them.

We may be the biggest, most well off team in Scotland, by a long way, but we don’t have the financial attractions of the game in Ingurland so we work with what we’ve got. And, as far as I can see, we’ve had a good season. After all, we did beat Barça, and it was no fluke. We did better than some of the supposed superstars in the epl.

So, i give a big thumbs up to NFL. Each to his own, but I like him, and I think next season will either improve his reputation greatly or he will move on.

(now I’m just stating the obvious!)

  17. My oft stated view is that NL and Celtic decided to put more emphasis on gaining momentum in Europe this season, due to having less of a domestic challenge.

Do make any impact,we had to adt a more cautious style, or else suffer the fate of previous teams.

It is no coincidence that GS also haf this approach to achieve his successin Europe.

The downside of this is that it meant using domestic games to settle the formation, ad trying to play two different dtyle in one week was beyond a tesm atour level and experience.

Like GS before him, the home form has been described as turgid, but, folks, that was the deal.

The question is ” Does Neil have another style in his locker?”

    That’s my view anyway, although I don’t have a vote (c.monteblanco).

  20. I’d just like to add my support ot Estadio’s main points.

This season above all others, we SHOULD have been able to give more of our promising younger players first team experience.

Ridiculous that players are claiming to be tired with the size of squad we have, yet we have seen players being rushed back from injury or in the case of Ambrose after long arduous flights.

Too often everyone is baffled by the substitutions, these should be game changers if a match is slipping away from us yet mostly the opposite or done much too late and is pointless.

Lennon himself stated when he was banned previously he could see the overall game much better, so why consign himself yet again to the dugout and one of the worst viewing area’s in any stadium ?

A good manager should get the maximum from his limited resources, struggling to beat the likes of ICT & Ross County, St. Johnstone etc doesn’t strike me as getting the best from ours.

I’d like to think he is learning from previous mistakes, but see too many repeated again & again to be convinced.

Now is the time we should set down solid foundations and build a dynasty that no other club can match. We have the opportunity to truly bury The Rangers / Sevco or whatever other incarnation they call themselves AND make a regular mark in Europe.

We need to up our game at ALL levels on & off the park, Times are changing fast and we won’t be restricted to the SPL forever…we should be fully prepared.

Ogilvie transferred shares he held in Rangerd to his wife when he became MD at Hearts.

The rules in the SFA handbook require that club officials do not hold shares in other clubs for obvious conflict of interest reasons.

Thus they need to be released but again they cannot be released to an “associate”. Now at this point Im not sure if approval from SFA to give to an associate or not is required but a wife is an associate as defined in SFA handbook so either CO got permission raising the question ‘on what possible grounds’ or broke the rulesof which he is a master.

Thus whilst at Hearts he had an interest in Rangers doing well.

There is no mention by AT if CO’s wife kept those shares when he moved up the SFA ladder .

However between ebts and shares held surely even the SFA members have to insist he resign if he broke SFA rules or SFA justification for approving transfer ( ifit happened) does not stand up.

  24. EN

I agree about flexibility in so far that once the CL excursion was over I think we should have looked at different systems and approaches and there have been games where we have been very good in an attacking sense, particularly at home (30 goals in 7 games post split is pretty impressive.)

In terms of while the champions league was still going I think it would have been too difficult to get the players to change approach entirely for certain games and that is why games in the league before Christmas had to (in my view) be played with one eye on CL preparation.

Going forward and provided we can keep the bulk of the players, the ability to change systems for games should be better but I share your concerns regarding the creativity in the team but for me, at this stage in the team’s development, I would sacrafice a bit of creativity for better results in Europe.

  25. I am genuinely puzzled by the description of Celtic as an ultra defensive outfit run by a cautious non-motivating coach. I also think the use of the word “dick” directed against NFL undermines any claims EN has to offering constructive criticism.

Dealing with the points in turn:

A Defensive midfield set up- We play 2 from Wanyama/Kayal & Ledley so that reduces creativity it is claimed.

Well, that’s only true if you leave out the other selection choices Brown (29 apps), Commons (42), McCourt (15), McGeoch (12), Forrest (26) and Rogic (5).

It’s only true if you exclude Forrest and Commons as only wingers and, therefore, somehow, not strictly midfielders. However I remember last year’s complaint that we played 4:2:4 and were, therefore, too gung ho and lightweight. Seems that, as fans, we’re a bit like Goldilocks in her first two judgements in always finding things unsatisfactory because they re too much or too little. Never understood why she could not wait for the hot porridge to cool down to a satisfactory moment.

It is only true if you count Big Vic as a defensive uncreative midfielder. That’s unlikely for a scorer of 9 goals this year. Joe has scored 7 goals, 2 down on his contributions last year. Only Kayal is a regular non-scorer.

It is only true if you have a narrow definition of Defensive Midfielder. Vic Wanyama is a fairly complete midfielder; he can become as effective and creative as Yaya Toure or Patrick Viera. Joe Ledley is a box to box midfielder who adds goals; he is more Billy Stark than Neil Lennon. Kayal (24 apps) is the only true defensive midfielder named. He is only selected so much because of Brown’s injury. He has had a dip in his 2nd season and is now trying too hard to impress but yes, I concur, he will never be a regular scorer. That is one thing he has in common with Neil Lennon but he is sadly, far from being a clone of Neil’s playing style.

He would not play a Totti, Ozil, Lubo, or Riquelme if he had one

That criticism could be leveled at MON who struggled to find space for Lubo and Juninho, though he was right about Berkovic.

However, leaving aside the fact that we have no one of that level on our books and we would be unlikely to keep them for long if we did. Neil had persisted, against a growing weight of evidence, in giving Paddy a chance as just such a creative No. 10. Unfortunately, Paddy proved to be, like Antony Stokes, a flat track bully against lesser SPL defences but not one to make an impact in a modern European game or better quality defenders. But rather than just play the “men” in the team (Ledley & Kaya as senior pros), Neil has experimented with giving spaces to Dylan McGeoch and the rookie pro, Rogic, neither of whom could be described as defensive midfielders. They may not have had as much game time as we would like but it is, generally a good idea to give rookie players limited game time in their breakthrough season in order to keep them at their feed. Next year will be the big test to see if Dylan can break on through to a more regular place. I would still give Rogic a further 6 months more than Dylan to develop before that expectation was placed on him.

    non-motivating coach

This is the kind of catch all comment that can never be proven or disporoven. It is almost not worthwhile arguing against.

Like the accusation that a poor game is down to lack of effort from players who are not interested, it is the cliche we throw out first to explain away issues rather than explain them.

Motivational powers is something we attribute to a manager whose team turns performances around or who wins when not expected to. We buy into the half time manager tantrum cliche, love the smashed cups and thrown boots, and feel that the Al Pacino “Any Given Sunday” speech would work wonders in our dressing room. It is a romantic notion but less convincing than the reality that most coaches and managers make their influence felt on the training pitch and not the dressing room. It is not an unimportant area but it is greatly over-exagerrated in its importance to performance.

When a team wins, we credit the winning manager with superior tactics and greater powers of motivation. When they lose, they are tactically naive and have lost the dressing room. Common sense should tell you that all managers win some and lose some but do not change their character as much as that in between times. Common sense and sporting experience should tell you that teams who were tactically organised and highly motivated have also lost games and some good teams have scraped wins despite poor leadership and bizarre tactics ( I believe both Jimmy Calderwood and John Barnes won some matches).

If the criteria for proving you have motivational powers is an ability to win against the superior odds, then we proved that, not only against Barca, but in all our European matches. I doubt we were favourites to win in any away match including the preliminaries, but this non-motivating manager has smashed the CLAW monkey many times over.

Just how does this poor dick of a non-motivating, tactically naive rookie manage to be so lucky, eh?

Yip, the old Greeks knew how to untangle a horrid mess with some unlikely manoeuvring.

Assuming all is above board and no funds have been syphoned off to distant locations, Sevco has enough dough to see out this season with £5M cash to spare.

The problem is next season, where with the current burn rate, they’re goosed by February.

Whether they have to bridge 4 months or 16 months in the SFL will determine in what shape they arrive in the top league, assuming consecutive promotions.

A left field restructure of the SFL in the coming weeks to reduce their penury by 12 months has a positive cash impact on them in the order of £30M, a huge sum for what is essentially an SME, and one that changes the game in terms of investor dilution and exit options.

With that kind of dough on the table, there is no absence of motivation.
