Paddy time, Europa and Remembrance

Celtic recorded victories over Dundee and Hearts after their first two Champions League games but collected only one point from the two league games following the double header against Barcelona.  They also won after only two of their four Champions League qualifying games, so there is no reason to expect a convincing win against Inverness tomorrow.

Inverness slumped to a freak 1-5 defeat at home to Motherwell last week but that was their first defeat since the same team beat them earlier this season.  Like Celtic at the Camp Nou, they will be set on defending deeply at Celtic Park in order to prevent another collapse.  This could be an occasion for Paddy McCourt to prize them open.

I had a look at the Europa League group tables last night.  Udinese, who eclipsed us in the same competition last season, are bottom of their group this year, as are PSV Eindhoven, Sporting Lisbon, Athletic Bilbao (who beat Manchester Utd home and away last season) and Helsingborgs.  Other recent opponents Rapid Vienna and Hapoel Tel-Aviv are also bottom.

If you’re on Facebook there is a story on the CQN Magazine page about Benfica implying Celtic only beat Barcelona because of cheating.  Drop in and take a look.  On a related subject, I’ve some good material from Spartak in reserve for the days before their visit.

The Annual Remembrance Service, held by the Celtic Supporters’ Association, takes place tomorrow, in memory of Celtic fans no longer with us, with prayers offered for those departed during the last year, including Joe McBride.

The Mass, at St Michael’s at 1350 Gallowgate just up from Parkhead Cross, will start at 12:30 and should be over in around 30 minutes, after which refreshments will be available in the hall to warm you before you head to the game.  All are welcome to celebrate the memory of those who have gone before us.

Lost wedding ring alert! Someone found a wedding ring in Lisbon which was probably dropped by a Celtic fan. Let me know if you know who is walking around with their hand in their pocket this week.

    We are defo in europe after christmas so no reason to let him leave.. Surely big vic would be willing to see season out and finish on high.

     

     

    Plus add to his value in final few months..although to get crazy money seems january is time clubs spend that little bit extra for strong finish.

     

     

    Sad that players who could actually be celtic legends will not stay long enough to achieve that.

     

     

    Quicker we are in competitive league the better.

    Can I just clarify something from yesterday.

     

     

    What I wrote on at length yesterday was not my view on what the FTT should do or should have done– it was my take on what they did do going by what I see in the judgement as published.

     

     

    Further, I retired from what would be called mainstream legal practice about 7 years ago– and in truth I had actually retired from what would be called private practice at least 2-3 years before that– although in name I was still a solicitor– but the truth is I was already away and out of day to day legal practice in all but name.

     

     

    So– I what I am about to do is 1. Break the habit of at least a decade 2. Could just be 10 years out of date– and so could be completely wrong and 3, For many may be mind numbingly boring.

     

     

    I am about to give a (hopefully short) legal opinion on the retail detail of the law.

     

     

    The Judgement refers at length to the Ramsay case.

     

     

    Now I am not after 10 years away inclined to read a House of Lords decision– on tax of all things– from start to finish! I am afraid I would lose the will to live after about 5 pages!!!

     

     

    However, from what I can see from the FTT decision, Ramsay does really no more than reiterate a very old principal that has existed in the law of Scotland for Centuries — and indeed when I think about it– what I am about to say may have some relevance beyond my initial thoughts.

     

     

    In Scots Law at least, a debt– such as a loan– can only be proven by writ or oath- which means that to prove a loan you need the loan doc with the debtors signature on it or the borrower agreeing under oath that he borrowed the money.

     

     

    However, courts have always been able to look behind legal documents to determine if they have actually recorded what was intended, or if one party was lead to believe that they were signing something else, or indeed if the loan document is a forgery, or if the whole thing is total nonsense.

     

     

    So the FTT could have found ( as Dr Poon did ) that the whole thing was a sham if they had felt that they heard sufficient evidence to cast doubt on the veracity of the loan documents. Two judges didn’t appear to say that they had heard enough evidence to reach that conclusion as a matter of fact and law– one judge did, and she explained why at great length.

     

     

    Whether there was enough evidence to reach that conclusion is one thing, whether the law allows you to reach that decision is another.

     

     

    Two judges don’t much comment on the evidence– they more or less say that given the submissions they “HAVE TO” accept that the loans were real etc– and they then make no real comment on what they think if that were not the case whereas Dr Poon goes further.

     

     

    The question you were debating amongst yourselves was almost what do I think– or what is my view.

     

     

    Having considered it— I would appeal.

     

     

    I think there is enough of an argument there to question the actual words used in the majority decision, but the appeal court may well return the matter to the FTT to make findings in fact on the issue of the loans and trusts– you will remember that the two said they were UNABLE to make further findings in fact re those issues.

     

     

    If the matter is referred back with an order to make further findings in fact– what will the judges say?

     

     

    Also, if further evidence that has a bearing on all of this comes to light— could that evidence now be heard?

     

     

    I don’t know the answer to that but personally I think there is an appealable point.

     

     

    My only caveat is to reiterate that I am a dinosaur when it comes to this kind of thing and my views are based on skills long abandoned and very distant memories.

    Why oh why were they ever granted grace to leapfrog more deserving clubs into the league structure proper?

    And what would we do if we were in the state they’re in?

     

    Answer: would never happen.

    They died and are staggering around in a punch-drunk reanimated state. Personally I’d prefer it if they were sealed, entombed and dropped in The Marianas Trench.

    I think its safe to say that 90% of huns get their information on all things Sevco-Oldco-HMRC-EBT from the Record, the Sun and the pub, while we get ours from CQN-RTC-Phil.

     

    It therefore comes as no surprise to see them claiming some kind of victory out of this shameful fiasco. In a way it reminds me of Craig Whyte riding up Edmiston Drive and ‘the people’ proclaiming him as their saviour. I remember the display of euphoria, with wee Ally and Jingle Jackson supplying the sound bites as they lauded this strange hero.

     

    I’ve spoken to a few huns over the last 18 months and not one has offered any analysis on the situation other than what they’ve been spoon-fed by the likes of Jabba.

     

    I pointed them in the direction of RTC but they preferred to do the ostrich on that one.

     

    So when the big L happened it came as a massive shock. They didnt want to know the truth, unless it was an update from a fellow hun in the pub who knew someone who worked with some guy who……One example was the clown on Clyde the other night blaming everyone from Lawwell and Reid to internet bampots and Doncaster for their plight. And they let him rant for 15 minutes.

     

    I said weeks ago that they would kick and scream like hell, and make as much noise and fuss as possible. Its all because their stuck in exile for at least three years while we enjoy a free run on the Champions League, and my god, how it must hurt them to see how well we’re doing without them to hinder us.

     

    They are forever shamed, caught up in a huge scandal, and they know the whole world has watched it unfold.

     

    Its probably human nature to cling onto any hope when you are in a desperate state. I can understand their triumphalism at the tax verdict but at the same time I see another Craig Whyte senario. At this juncture its a Pyrrhic victory but I’m encouraged to read some valuable opinions on here that say its far from over.

     

    I feel another hammer-blow like the Whyte one will push them over the edge, but they bring it all on themselves.

    miki67 that is true of all appeals except if new evidence is uncovered which could not have been reasonably presented at first instance by the appelant. This usually means evidence hidden by the defendant.

    I’d rather Lenny went 4-4-2. Watt and Miku looked superb together in the 2nd half at Tannadice – the one wholly positive thing to come out of that game – and deserve the chance to reprise that partnership. For that reason, I wouldn’t play Commons, as Brown is a better with Lustig down the right. Down the left, I can’t see past Sammi. McCourt has played CM before and done well, albeit in 3-5-2 and 4-3-3.

     

     

    A lot will hinge on Lenny’s assessment of the players’ fitness. Looking at it dispassionately, we will do well to scrape a win today.

    Totally agree. Throughout this sorry saga the Huns have been simply unable to mount a cogent analysis of the facts of Murray’s reign. Anyone who has dared questioned what RFC were up to has been shouted down.

     

     

    Their fanbase operates in a cocoon of soothing noises made by Traynor, Kackson, SSB, Media House, and oddballs like Dingwall and Graham.

     

     

    They are unable to analyse the FTT result because it has already been declared a “victory”. Because of this, I honestly believe some of them are expecting Sevco to be placed in the SPL next year and awarded last year’s title. They are beyond deluded.

     

     

    Whilst the ultimately inconclusive result of the FTT is frustrating, I actually believe that not even a comprehensive and clear defeat would have knocked them out of their delusion.

     

     

    The result is they remain potential prey to sharp people with low morals. Like you, I don’t think this fiasco is anywhere near concluded…
