Politics of the game encroaching on Neil Lennon

It is one thing for football fans and administrators to be embroiled in the politics of the game but it’s no wonder that Neil Lennon tires of such subjects.  His team are top of the SPL and in the knockout stages of the Champions League but he is being distracted by references to his club emanating from the lower leagues.  Maybe he should limit his comments on this subject to those of Walter Smith, “We wish the new Rangers Football Club every good fortune.”  Every “new” club deserves the same courtesy.

Can you imagine the reaction if Neil said the same!

Speaking of which, I see the man who has avoided trying to win friends among other clubs since his arrival in the game last year is now trying to influence people on league reconstruction.  Good luck with that.

We spoke over the weekend about well-run clubs in the SPL (Inverness, St Johnstone, Ross County, Motherwell), where managers come and go but results tend to remain buoyant.  Notably absent from this list was Dundee United, who have underachieved for years, but whose manager, Peter Houston, was today given permission to speak to English Championship side, Blackpool.  Houston has been unable to sprinkle magic dust over Tannadice so, if offered the Blackpool job, I expect him to accept.

United need to ask some fundamental questions should they be forced to replace their manager, like why they have vastly more resources than Motherwell, and appear to be able to produce prodigious young talent, but consistently fail to match the Lanarkshire side the in the league table.  They are a club in need of vision.

    Am glad he’s taken it, if he has, it could be a sign of change, then again it might no.

     

    One thing I do expect, he will choose his own team, if he’s took it I’d hope he’s made that a condition.

    I wrote what I wrote: I’ve never claimed that my words were yours or anyone else’s. Of course, I’d have made myself clearer if I’d said ” a supposedly inclusive group” – i.e. Celtic supporters – rather than “organisation”. Mind you, the only person having problems with my statement seems to be yourself.

     

    When you write “Paul is big enough..”, you lose me; I wonder if anyone else here understands you? Do you mean that Paul would deny what CQN is, or would defend it? There’s a big difference (BTW I nowhere said that this blog is “a Celtic mouthpiece” – quite the opposite).

     

    Of course I understand & appreciate Scotspatsfan, Macjay & others standing up for our traditional inclusiveness: what repels me is those who deny that tradition. Maybe you could make it clear where you stand on this issue.

  19. We all follow with immense interest the developments in Scottish football. The situation with Rangers is moving slowly and rather awkwardly. This is because, in our view, the self-regulation of Scottish football is currently stretching the boundaries of its regulatory creativity and attempts to accommodate situations that mostly relate to politics rather than football. A number of different examples has seen the light in the last few weeks and it threatens to expose the dangers that usually derive out of the incompetency of self-regulation. 

     

     

    Rangers 

     

     

     

    A few weeks ago, we critically examined the main differences between sports law and company law, in terms of self-regulation in football, in this post: http://lawtop20.blogspot.co.uk/2012/06/old-company-v-new-company-in-football.html    

     

     

     

    We also explained that the creation of a new company gives rise to the principle of the ‘separate legal personality’ which distinguishes companies from human entities and confirms that it is only the company who can sue or be sued upon contractual transactions. A company is deemed to have its own legal and separate personality and is, therefore, able to enter into commercial transactions. In the case of Rangers, self-regulation attempts to create a connection between the old corporate entity and the new one by forcing the latter to accept the debts and liabilities of the former. An independent observer would pose serious doubts as to whether there is a connection between the two, or whether such connection could be established. 

     

     

     

    The analysis of the factual background indicates that the parties in this transaction [football authorities and new entity] are attempting to create such connection. Self-regulation, with the application of its ‘sporting exception’ principle, could achieve such connection, as long as the law of the land is not offended. If the regulatory framework of the sporting governing body allows for such connection to be established, without a fragrant violation of any legal principles, then a contractual agreement between the relevant parties could create such connection.

    Here, we could see that the current Rangers hierarchy attempts to create a connection between the two entities, by forcing, with public statements, the fans to accept that the Rangers history cannot be erased. This, however, has the potential of putting the new entity into a dangerous state of uncertainty and unlimited liability. We, personally, fail to see this manic insistence on the issues of ‘history’ and ‘titles’. Nobody can erase the history and/or the titles of Rangers from the memory of the fans and the relevant football documents. The Rangers history will always be there and it would be difficult for anyone to take  such history away. But such history ends in 2012 and a new one begins with the creation of the new entity. It is illogical to suggest that you can ‘lend’ or ‘buy’ or even ‘transfer’ the history of one company to another. The legacy could, of course, be used and it will be used by Rangers fans. It is difficult to erase such legacy and it is highly unlikely that such legacy will ever expire. 

     

     

    The same goes with the issue of the titles won by the old entity. The titles will stay with the old entity and they cannot possibly be transferred to a new entity, who is attempting to create a new ‘club’ for the purposes of entering the national game. The titles belong to the old entity, who won such titles in the sporting arena. It is again illogical to suggest that a new entity can have, the titles won by another entity, transferred to it. What is the purpose of such hypothetical transfer and what is it going to achieve in practical terms, other than to create a dangerous connection between the two entities? Scottish football authorities have already indicated that condition of membership for the new entity would require it to accept responsibility for the wrongdoings of the old entity. We, therefore, see no logical and practical advantage from the connection of the two entities.

     

     

     

    Furthermore, several commentators have produced the argument that the current rules allow for the transfer of membership of the old entity to the new entity. Even if we were to accept such contention, we fail again to see the necessity of this transfer, which is only going to create a dangerous unlimited liability for the club and it will allow third parties to pursue the new entity for the wrongdoings of the old one. We can appreciate the limitations that exist in relation to the ‘3-year accounts’ rule, but such rule can be avoided in  a number of different ways. We are not here to offer legal advice, but those advising Rangers could easily identify such ways. 

     

     

     

    Further, we regret to state that this situation is threatening to embarrass Scottish football. Responsibilities exist on the part of, both, the Scottish football authorities and the new entity who controls the new football club of Rangers. The former, have a sacred duty to observe equality, accountability and transparency, whereas the latter, has a duty, towards its fans, to ensure a financially viable new entity, which would create a secure future for its football club in Scottish football. Whatever the negotiations were between these entities, they have, with respect, failed miserably and the result is now leaving a bitter taste to those who prefer to watch football every week, rather than reading a legal analysis on the corporate responsibility of those who run the game. 

     

     

     

     

    Finally, it is our view that the only secure future for the new club of Rangers is to accept reality and build on the new challenges ahead. It would be unfair and illogical to accuse the hierarchy of new Rangers for the wrongdoings of those who brought the club in this position. This is why the new entity must take advantage of the benefits the law of the land offers and attempt to negotiate further on the benefits self-regulation offers. We are not here to offer guidance as to how this could happen, but instead to encourage those who run the club, to identify such benefits and obtain them for the good of their club. They owe it to their fans and to Scottish football as a whole.

    As to my comments on our host, Paul has in the past been accused of being a mouthpiece for PL and myself and others have jokingly referred to him as a board lackey!

     

     

    We sometimes need reminding that this is not a Celtic website, but Paul’s blog. His rules on what’s in and what’s out and he’ll defend his right to enforce that.

    But I think Shutting Down the Steelworks was a Blessing in Disguise..

     

     

    By the Time I was 30yrs. I had Lost 7 Uncles/Relatives to Cancer..All worked in Steel works in Lanarkshire..

     

     

    All other Uncles who Worked out with Steel works are Still Going strong 20+ Years later..

     

     

    This could be Extreme Coincedence but I believe Thatcher knew that to Make the Industry safe You would have needed to Flatten it and Start Again..

     

     

    This is Just my Personal opinion..

     

     

    I mean Governments were warned about Asbestos but Used it for Years..

     

     

    Many Steelworkers went on the Shit Jobs but Many made Great Career moves..

    I think, had the steel works survived, health and safety would require screening, I find it more likely they were closed to limit liability for the health problems they knew were building up.

     

    Oh and to destroy unions and the society surrounding the industry, rave scraping was making profit when she closed it.

I can’t believe the Singing Dick is a Tim, I reckon he is laughing his heart out that he has messed up the Blog and has Celt arguing with Celt. As previous posters said this is Paul 67’s blog and if he is happy to allow Kojo & The Singing Dick to continue to post then so be it, the rest of us either have to put up with them or pack up ourselves.
